Description of the Proposed Work and Price:
Franklin Residence
System 1: Basement and First Floor
Furnish and install one (1) Bryant 912SC48060S 17 92 % efficient single stage gas furnace, (1) Bryant
113ANA042 3.5-ton 13 SEER PURON air conditioner, matched with one (1) Bryant CNPVP4217
3.5-ton PURON indoor coil, one (1) MERV 10 air filter with upgraded cabinet, and one (1) Honeywell
5/2-day programmable thermostat.
System 2: Second Floor
Furnish and install one (1) Bryant 912SC36060S 14 92% efficient single stage gas furnace with one (1)
Bryant 113ANA030 2.5-ton 13 SEER PURON air conditioner, matched with one (1) Bryant CNPVP3014
2-ton PURON indoor coil, one (1) MERV 10 air filter with upgraded cabinet, and one (1) Honeywell 5/2-
day programmable thermostat. Price includes all necessary ductwork, registers and grilles, labor, and tax
as per Airtron's design and specifications.

LIMITED WARRANTIES: Per Airtron's installation warranty policy (see reverse side) and separate equipment warranty by Manufacturer.
THE TERMS AND CONDITIONS SET FORTH ON THE REVERSE SIDE SHALL GOVERN THE PERFORMANCE OF THE SERVICES SET FORTH ABOVE.
Purchaser assents to the terms of this agreement without signing the agreement if Purchaser directs Airtron to begin performance.
All terms of this agreement are binding on Purchaser and its successors and assigns. This document represents the entire agreement
between Purchaser and Airtron and supersedes all prior negotiations, representations, or agree nts. No changes are binding on Airtron
unless they are in a written document signed by Airtron and Purchaser.

Terms and Condition
Scope of Work and General Terms
1. Airtron's scope of work is described on the first page. If there are separate written specifications in addition to the description on the
first page, those specifications shall be provided in writing for the Purchaser's approval before the commencement of work.
2. This document represents the entire agreement between Purchaser and Airtron and supercedes all prior negotiations, representations
or agreements. No changes are binding on Airtron unless they are in a written document signed by Airtron and Purchaser.
3. Airtron's scope of work shall NOT include (and Airtron shall have NO liability for) the identification, detection, abatement,
encapsulation or removal of asbestos, radon gas, mold or products or materials containing asbestos, radon gas, mold, or other
hazardous substances. If any such materials are encountered, Airtron may stop working or terminate this agreement, as it sees fit.
4. Unless otherwise stated in this agreement, payment for materials, equipment and services is due at the time they are provided and
delivered. Failure to make payment when due shall give Airtron the absolute right to stop providing services and to stop further
delivery of materials and equipment. Purchaser is liable to Airtron for all costs incurred in collecting amounts owed by Purchaser,
including all repossession costs and expenses, and attorney's fees and expenses. All amounts Purchaser owes shall bear interest at the
rate of the lesser of 18% per annum or the maximum amount permitted by law until the amount due is paid in full.
5. Title to materials and equipment will not pass to Purchaser until Purchaser has made payment in full for the materials, equipment and
services provided pursuant to this agreement. The risk of loss of all materials and equipment, however, passes to the Purchaser when
they are delivered to the jobsite. Purchaser may not sell, assign, or transfer any of its rights under this agreement, or ownership or
possession of the materials or equipment unless Purchaser has made payment in full for such materials, equipment and services.
Purchaser shall execute any and all documents provided by Airtron which are necessary to perfect Airtron's security interest. Purchaser
hereby authorizes Airtron to execute any and all documents necessary to perfect Airtron's security interest.
6. Purchaser shall provide a safe jobsite and working conditions. If Purchaser fails to do so, Airtron will have the right to cease further
deliveries of materials and equipment and to cease providing services. Purchaser shall purchase and maintain insurance adequate to
cover and personal injury or property damage that occurs on the premises.
7. This agreement is entered into and shall be construed under the laws of the state of Indiana. Any cause of action arising between the
parties shall only be brought only in a court located in Marion County, Indiana. In the event any of these terms and conditions is found
to be unenforceable or invalid, the validity and enforceability of the remaining terms and conditions will not be affected.
Warranties and Remedies
8. Airtron warrants that installation services provided under the agreement will comply with state and local laws and regulations in effect
at the time they are provided. Airtron warrants that installation services provided by it pursuant in this agreement will be free from
defects in workmanship for a period of one (1) year from the date the services are performed. All warranty work shall be performed
during normal working hours, an additional charge shall be in effect for warranty work requested after hours. Information regarding
safety and maintenance as found on Airtron's website (www.airtronindy.com) is also available in hard copy. Please send your written

9. PURCHASER'S SOLE AND EXCLUSIVE REMEDY OR BREACH OF WARRANTY IS THAT OF AIRTRON SHALL REPAIR THE DEFECTIVE
INSTALLATION. AIRTRON'S LIABILITY FOR DAMAGES SHALL NOT EXCEED THE CONTRACT PRICE OF THIS CONTRACT, AIRTRON SHALL NOT
BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, GENERAL, OR CONSEQUENTIAL DAMAGES. Purchaser agrees to look solely to the
manufacturer(s) of such materials and equipment for satisfaction of any and all claims related to the quality and performance of such
materials and equipment or arising from an defects that are not the result of improper or defective installation. IC 32-27-3 contains
important requirements you must follow before you may file a lawsuit for defective construction against the Contractor or Builder of
your home. Sixty (60) days before you file your lawsuit, you must deliver to the contractor or builder the opportunity to make an offer
to repair or pay for the defects. You are not obligated to accept any offer made by the Builder or Contractor. However, if you
unreasonably reject a reasonable written offer and commence an action against the Builder or Contractor, a court may award
attorney's fees and costs to the Builder or Contractor. There are strict deadlines and procedures under state law, and failure to follow
them may affect your ability to file a lawsuit.
10. Airtron shall not be held responsible or liable for any losses, damage, or delays caused by fire, flood, severe weather, accident, terrorism,
or act of God or the public enemy, war, insurrections, strikes and other labor disagreements, or by any other cause beyond its control.
The start and completion dates in this agreement may be affected by the above unforeseen conditions and by equipment availability,
owner changes and adverse weather conditions.
