I don’t think that a Consent to Encroach will be necessary for this work, but we also don’t typically allow for grading to be done within the easement, unless it is to restore proper drainage. In this case, if you can keep all raising of the grade at least 3 feet from the property line, then you should be good to move forward. If you need to do work there to restore drainage, then you will just be responsible for making sure that water is able to have positive drainage from both properties through the disturbed area and not block any drainage. During inspections, you may be flagged for doing grading work within the easement which prompts me to come out and take a look. To get ahead of this, I would ask that you contact me once the rough grading is complete so that I can verify the drainage pattern. 2 Thanks and please let me know if you have any questions, Jarrod Huff, P.E.
