1.CONTRACTOR TO VERIFY ALL UTILITY LOCATIONS IN THE FIELD
PRIOR TO BEGINNING WORK. CONTRACTOR IS RESPONSIBLE FOR
ANY DAMAGE TO UTILITIES ASSOCIATED WITH WORK. UTILITIES
SHALL BE REPAIRED TO SATISFACTION OF THE UTILITY OWNER
AND/OR OPERATING AUTHORITY AT NO ADDITIONAL COST.

MANUFACTURER'S RECOMMENDATION, AFTER INSTALLATION IS

5.FINAL PLACEMENT OF PLANT MATERIALS, ETC. SHALL BE
APPROVED BY LANDSCAPE ARCHITECT BEFORE PLANTING
OPERATIONS ARE TO PROCEED. ALL TREE LOCATIONS SHALL BE
MARKED WITH A WOODEN STAKE INDICATING VARIETY AND SIZE
OF TREE.
6.NO SUBSTITUTIONS OF PLANT MATERIAL WILL BE ALLOWED. IF
PLANTS ARE SHOWN TO BE UNAVAILABLE, THE CONTRACTOR
SHALL NOTIFY LANDSCAPE ARCHITECT PRIOR TO BID DATE IN
WRITING. ALL PLANTS SHALL BE INSPECTED AND TAGGED WITH
PROJECT IDENTIFICATION AT NURSERY OR CONTRACTOR'S
OPERATION PRIOR TO MOVING TO JOB SITE. PLANTS MAY ALSO BE
INSPECTED AND APPROVED OR REJECTED ON THE JOB SITE.
7.ALL PLANTS ARE TO MEET OR EXCEED AMERICAN STANDARDS FOR
NURSERY STOCK, 2004 EDITION, AS SET FORTH BY AMERICAN
ASSOCIATION OF NURSERYMEN.
8.PLANTS AND ALL OTHER MATERIALS TO BE STORED ON SITE WILL
BE PLACED WHERE THEY WILL NOT CONFLICT WITH
CONSTRUCTION AND AS DIRECTED BY OWNER.
9.ALL NEW LANDSCAPE PLANTINGS SHALL BE GUARANTEED FOR A
PERIOD OF ONE YEAR FOLLOWING FINAL INSPECTION BY
LANDSCAPE ARCHITECT. AT END OF THIS PERIOD, PLANT MATERIAL
TERMED DEAD OR UNSATISFACTORY BY LANDSCAPE ARCHITECT
SHALL BE REPLACED AT NO ADDITIONAL CHARGE BY THE
LANDSCAPE CONTRACTOR.
10.ALL DISTURBED LAWN AREAS SHALL BE HYDRO-SEEDED OR
SODDED AS SHOWN PER THE LANDSCAPE AND EROSION
CONTROL PLANS.

south. Perimeter Bufferyard A required along the north, east, and west boundaries, and a
Bufferyard C is required to the south.
·Perimeter Bufferyard A: 5' wide + (4) Shade or Evergreen Trees + (10) shrubs per 100 LF.
·Perimeter Bufferyard C: 15' wide + (6) Shade or Evergreen Trees + (1) Ornamental Tree +

Note - West bufferyard is located in a utility easement, no trees are permitted in this
location - a variance will be required.
Foundation Plantings
Foundation plantings to be within beds at least 5' side, with exceptions for approach drives,
courtyards, plazas, and pedestrian access points. Primary landscape materials used shall be
shrubs, ornamental grasses and ground cover, with shrubs spaced at no more than 5' apart
unless separated by impervious surface.
Parking Lot Perimeter
(4) Shade Trees, (20) Shrubs per 100 LF of parking lot perimeter.
·Due to utilities, easements, and adjacent concrete wall, trees are prohibited within the
parking lot perimeter.

Request: UDO Section 5.39 (H) (2) Single Tenant Building; Permitted number of signs on a Single
Tenant Building to permit Napleton to erect six (6) total signs on the Kia Dealership building.
FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of the requested variances will not be injurious to the public health, safety, morals and
general welfare of the community because:
The approval of the requested variance will not be injurious to the public health, safety, morals and
general welfare of the community because the number and size of proposed signs is consistent with
other automobile dealership signage in the general vicinity of the subject Real Estate and the
additional signage will provide additional identification for the general public traveling on the
adjacent roadways.
2. The use and value of the area adjacent to the property included in the variance will not be affected in
a substantially adverse manner because:
The use and value of the area adjacent to the real estate that is the subject of the requested variance will
not be affected in a substantially adverse manner because the number and size of proposed signs is
consistent with other automobile dealership signage in the general vicinity of the subject Real Estate
and the additional signage will provide additional identification for the general public traveling on
the adjacent roadways.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because:
Strict application of the Zoning Ordinance results in practical difficulties in the use of the
Applicant’s site because absent the additional signage, the Applicant will be unable to properly and
adequately identify its location to the general public traveling on the adjacent roadways. The
additional signage will assist in providing proper identification which shall assist in efficient and
safe wayfinding to the site.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards
Variance Docket No. 19090008V is granted, subject to any conditions stated in the minutes of this
meeting, which are incorporated herein by reference and made a part hereof.

plantings in the west and south perimeter bufferyards due to existence of utility easements in these bufferyards.
FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE

general welfare of the community because, despite the variance being requested, the proposed landscape
plan complies with all other UDO planting and landscaping requirements and has been reviewed and
approved by the Urban Forester. Further, the landscape plan for the Real Estate will provide appropriate
and attractive landscaping for the Real Estate.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The use and value of the area adjacent to the real estate that is the subject of the requested variance will
not be affected in a substantially adverse manner because, despite the variance being requested, the
proposed landscape plan complies with all other UDO planting and landscaping requirements and has
been reviewed and approved by the Urban Forester. Further, the landscape plan for the Real Estate will

types of landscape material (i.e.: trees) and absent the variance, the Applicant will be unable to develop its
site as proposed. Further, the Applicant is only seeking a limited landscape variance. Despite the variance
being requested, the proposed landscape plan complies with all other UDO planting and landscaping
requirements and has been reviewed and approved by the Urban Forester. The landscape plan for the Real
Estate will provide appropriate and attractive landscaping for the Real Estate.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
