We are asking that the 8 feet high fence be approved, even though the current standards are limited to 6 feet. We are only replacing an existing fence. We also request that the community be allowed to place the fence in the same footprint that it currently exists, which does not allow for the required setback, the space simply doesn't exist. We simply ask to keep what we have but be allowed to replace it for aesthetics and reduction in long term maintenance costs. Should the variance not be granted, the community will be forced to maintain the current fence that is habitually falling over in sections and not only unsightly but way too costly for the community to preserve. If the variance isn't granted and the fence becomes irreparable, the owners on the exterior perimeter will be tortured by the headlights of passing cars, the constant noise of the pedestrians and the vehicular traffic. Sadly, these owners stand to lose peace of mind and also property value. We really appreciate your consideration of this variance. October 7, 2019 Carmel Board of Zoning Appeals Carmel, Indiana A petition seeking a variance approval by the Ashton Homeowners Association to replace an existing 8' fence alongside 146th Street and a portion of Hazel Dell Parkway is being presented as an agenda item at your October 28th meeting. We respectfully request approval of our request for the following reasons: 1. The existing 8' thirty year old wood fence has deteriorated virtually beyond annual repair. 2. The Association spends several thousand dollars each year in repairs that only temporarily sustain the structural integrity of the fence. 3. As a member of the HOA Board,I have been a part of researching alternative fencing options. The most important consideration of a new fence is to maintain the current height of 8 feet. Over the course of my 25 years in this neighborhood,both 146th and Hazeldell have grown to 4 lane roads and are heavily traveled. Additionally,there has been continued growth in retail and medical facilities that have taken advantage of this prime location and heavily trafficked area.In order to ensure our neighborhood safety,privacy and noise levels, we NEED an 8ft vinyl fence. An 8 foot vinyl fence would help to alleviate some of the noise of this intersection and also ensure our privacy making it difficult for trespassers or animals to enter our neighborhood. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: We are simply replacing an already existing fence, but upgrading the material. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: We will be replacing a poorly degraded fence with a brand new one in new condition and of higher quality materials and better installation procedures. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: Ashton homeowners will lose their privacy and will be forced to look at a failing fence that is nearly irreparable. Requiring a lower fence will allow headlights from passing vehicles on Carmel's busy 146th and Hazel Dell intersection to shine in their windows.
