A RESOLUTION OF THE CITY OF CARMEL,INDIANA BOARD OF PUBLIC WORKS AND
SAFETY REGARDING THE RELEASE OF A DRAINAGE EASEMENT
WHEREAS, in 1987, the City of Carmel, Indiana (the "City") obtained a drainage easement (the
"Original Easement") across a portion of an approximate 1.3 acre parcel of real estate located at 431 East
Carmel Drive in Carmel, Indiana (the "Property"), such easement and property being more specifically
described in Exhibit A, which is attached hereto and incorporated herein by reference; and
WHEREAS, the Original Easement has never been utilized by the City, and it is not needed for
either surface or sub-surface drainage; and
WHEREAS, in order to facilitate the sale and redevelopment of the Property, the City is willing
to release the Original Easement.
NOW, THEREFORE BE IT RESOLVED, that the City of Carmel Board of Public Works and
Safety hereby makes the following findings:
1. The foregoing Recitals are fully incorporated herein by this reference.
2. The City has determined that the Original Easement is no longer needed for any City purpose.
3. The City shall execute and record the attached Release of Easement together with the
Easements.
4. The City hereby designates Jeremy Kashman, Director of the Department of Engineering for
the City of Carmel, Indiana as its agent for purposes of releasing the Original Easement. Mr.
Kashman is hereby authorized to execute all documents required in connection with releasing
the easement and to take all other lawful actions necessary to complete the release of the
Original Easement as set forth herein.

DRAINAGE EASEMENT
KNOW ALL MEN BY THESE PRESENTS: That RALPH L. WILFONG,
hereinafter called the Grantor, of Hamilton County, Indiana,
in consideration of the sum of Ten Dollars ($10.00), the receipt

hereinafter called the Grantee, a perpetual non-exclusive
easement for the Grantee's storm sewer and drainage system

as follows:

angles to, lying to the right of and adjacent to
the following described line. Said Strip of ground
is located in part of the Southwest quarter of Section
31, Township 18 North, Range 4 East, Hamilton County,
Indiana, more particularly described as follows:
Commencing at the Southwest corner of said quarter
OD section; thence North 01 degrees 04 minutes 45 seconds
West (assumed bearing) on and along the West line
of said quarter section 1752.85 feet to the centerline
of Carmel Drive (the next five courses being along
the centerline of Carmel Drive); thence North 89
degrees 55 minutes East 600 feet to the Point of
Curvature of a curve to the left, said curve having
a delta angle or 20 degrees 00 minutes and a radius
of 1145.92 feet; thence in a northeasterly direction

thereon, except driveway and parking areas. 1
In the event any construction or work is performed in
connection with the operation and maintenance of storm sewer
and drainage system, the Grantee shall restore the surface
' of Grantor's land to the same condition as it was prior to
the commencement of such work. The Grantee covenants to main-
tain the easement in good repair so that no damage will result
from its use to the ad3acent land of the Grantor, his successors
and assigns.
Grantor hereby covenants that Grantor is the owner in
fee simple of the real estate, is lawfully seized thereof,
and has authority to grant and convey the foregoing easement,
and guarantee the quiet possession thereof, and that Grantor
will warrant and defend Grantee's title to the easement hereby
granted against all claims.
