DEPARTMENT REPORT

(V) Browning Residence, Garage Setback.
The applicant seeks the following development standards variance approval for an accessory building:
4. Docket No. 19090025 V UDO Section 5.02.B Detached garage located 25’ behind house face
required, Garage 288’ in front of house requested. The site is located at 12650 Clay Center Rd. at B
& B Park Subdivision Lot 1. It is zoned S1/Residence. Filed by Joe Viewegh of Viewegh and Assoc.,
LLC, on behalf of Christian Browning, owner.
General Info & Analysis:
The Petitioner seeks variance approval to place a new detached garage in front of the house, between it and
Clay Center Rd. The site is 7.16 acres in size and has many mature trees. It is located west of Springmill
Streams neighborhood. In addition to a driveway that connects to Clay Center Rd., there is an access drive from
the rear of the lot, which connects to the Claridge Farm neighborhood to the south. Please see the Petitioner’s

The Unified Development Ordinance (UDO) states the following for the minimum front yard setback for an
accessory structure:
Except as otherwise provided for Corner and Through Lots, when detached from the Principal Building,
Accessory Buildings shall be set back a minimum of the greater of the following:
[1] twenty-five feet behind the Front Line of Principal Building;
[2] twenty-five feet behind the Principal Building Setback Line.
The minimum front yard building setback for the S1 zoning district is 40 feet. However, the existing house sits
575feet back from the road. The proposed garage will sit 290.5 feet off the road. (For reference, a football field
is around 360 feet in length). The garage will be built with high quality materials and will complement the
existing house.
The Petitioner addressed all planning/zoning review comments, and the Planning Dept. supports this
variance request.

The Dept. of Community Services recommends positive consideration of Docket No. 19090025 V.
