CARMEL BOARD OF ZONING APPEALS
DEPARTMENT REPORT
OCT. 28, 2019
(CA) Sprunger Residence/Pool Setback, Commitment Amendment.
The applicant seeks the following approval:
1. Docket No. 19070011 CA Request to modify existing commitments related to variance Docket
No. 18110001 V. The site is located at 2180 / 2198 Steffee Dr. It is zoned S1/Residence and located on
Lots 8 & 9 of Towne Oak Estates Subdivision. Filed by Rick Lawrence of Nelson & Frankenberger, on
behalf of Jason & Sarah Sprunger, owners.
General Info & Analysis:
The Petitioner seeks approval to modify the commitments made with a prior side yard setback variance
approval (Docket No. 18110001 V), and would now like to be able to have a house built on Lot 9. (That prior
petition was heard by a BZA Hearing Officer.) Please see the Petitioner’s informational packet for more
detail on the commitment amendment request.
It should be noted that the neighborhood was developed in 2007, and the subject site has always been two
platted, buildable lots.
The amended site plan for Lot 8 shows that the house is located 1-2 feet from the side/east property line, and the
proposed pool/decking (that was going to encroach 20 feet past the side/east property line) will no longer be
built. Lot 9 will not have any structures encroaching onto it. However, it is important to note that the
driveway for Lot 8 does encroach onto Lot 9; the Petitioner will need to provide a conceptual site plan to
show how a potential house can still be built on Lot 9 with that hindrance.
The Petitioner addressed all planning/zoning review comments, and the Planning Dept. supports this
variance request.

Recommendation:
After all comments and concerns are addressed, the Dept. of Community Services (DOCS) recommends
positive consideration of Docket No. 19070011 CA.
