The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: We are simply replacing an already existing fence, but upgrading the material. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: We will be replacing a poorly degraded fence with a brand new one in new condition and of higher quality materials and better installation procedures. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: Ashton homeowners will lose their privacy and will be forced to look at a failing fence that is nearly irreparable. Requiring a lower fence will allow headlights from passing vehicles on Carmel's busy 146th and Hazel Dell intersection to shine in their windows.
