Hollibaugh, Director L E T T E R of G R A N T October 29, 2019 Jim Shinaver Nelson & Frankenberger, LLC 550 Congressional Blvd., Suite 210 Carmel, IN 46032 Re: BZA Docket Nos. 19090008-9 V: Napleton Kia of Carmel Dear Mr. Shinaver: At the meeting held on Monday, October 28, 2019 the Carmel Board of Zoning Appeals took the following action regarding the Development Standards Variance (V) requests filed by you for the property approximately located at 4600 E. 96th Street: APPROVED with Conditions: Docket Nos. 19090008 V & 19090009 V Development Standards Variance approvals for: 1. Two signs allowed, Five granted (no ground ID sign), and 2. Reduced number of trees in west & south perimeter bufferyards. These variances were granted with the conditions of the Petitioner planting 20 trees at the off-site floodplain mitigation area (King of Glory church site) and that Napleton revisits the potential for additional tree protection along the east property line. Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development Standards Variance approvals are valid for three (3) years. By that time, either continuous construction of the improvements must be underway, or a written request for a one-time, six-month extension of the approval must have been received and approval granted by this Department.
