HomeMy WebLinkAbout19090107 HOA ApprovalArchitectural Review Board Proposed Improvements to 10598 Huntersfield Drive Mr. & Mrs. David Desmarais Neighbors, I have been asked to put together a presentation to the HOA Board and ARB for proposed changes the subject home. While this is a departure from the normal practice, 1 will attempt to present h to Proposal as accurately as I can, with the stipulation that it is 100% the homeowner's responsibility to respond with any changes to what is presented here. The proposal contains several tasks, which I attempt to set forth below. I respectfully request forgiveness for any errors in my attempt at service. Re -Paint The neighbors want to change the exterior color from the current color to a neutral gray, with trim remaining white, and shutters black. Preliminary Response: It has generally been the position of the ARB to inquire with regard to color changes simply for the purpose of discouraging extreme color choices. The change to gray, with white trim and black shutters, does not appear to be extreme. Discussion is welcomed. Repairs to Chimney The wood on the existing chimney chase is weathered, especially on the south side. The proposal is to replace the weathered wood and repaint, with the same color scheme (gray with white trim). .11rie iminary Response: a proposed repairs are entirely consistent with HOA guidelines and covenants, an 4 ntenance, but discussion is welcomed. The neighbors wish to install two new windows in the south wall of the house. The intent is to d natural light to the kitchen area (separated from the north wall by adjunct space). Window selection is to match the existing windows on the remainder of the house. Placement of the windows is proposed as being generally above the air conditioning unit (to the east) and to the west of the range hood exhaust (in the approximate location of the existing satellite dish (which is to be removed). Proposed windows are generally not visible from the street. Preliminary Response: The south side of the house is visually screened from the south neighbor, and not generally visible from the street. The site visit also made clear the functional preference for adding natural light to the interior kitchen area. Given the parameters, and with the understanding that the new windows have been selected to match the existing in size, color, and materials, the proposal appears consistent with HOA covenants. Radfordcookmedical.com, mbhomepartners kw.com, p.lello.iacygmail.com, mkatz@marckatzlaw.com, cindykoehier5 gmail.com, mbailey@clgintl.com Dave, The Board and ARB have considered your response to the previous email regarding your proposed improvement projects, as previously presented and shared, and we respectfully offer this note as confirmation of the position of the ARB/Board. The conclusion reached in those discussions is that five of the six proposed projects are considered to be in compliance with the covenants as follows: • repairs to the chimney chase; nge ®f s®I®ref-�r�ra�� addition/installation of matching windows to the south side of the house; and As stated previously, the proposed wooden privacy fence is not approved. As stated previously, wooden fences have been consistently discouraged by the Board and ARB. As you have noted, a few neighbors (ironically including the previous owner of your house) have chosen to construct wooden screens without notifying the ARB/Board, and as such, without ARB/Board approval. When we become aware of cases such as those, we have historically sought courses of action that are respectful and neighborly. We can discuss those other cases further with you, if you wish, at the upcoming annual Board meeting (tentatively scheduled for August), but generally, we try to handle such discussions privately, with the affected party, whenever possible. To bring your proposal to its simplest conclusion, the ARB/Board respectfully suggest that, if you propose to replace the natural privacy screening on the west side of your pool, it should be replaced with natural materials. We do not collectively or individually profess to have sufficient expertise in landscape architecture to fully comprehend whatever conditions might be affecting your current landscape material, and therefore cannot offer effective suggestions or'solutions' thereto. The existing natural material on the west side of your pool appears to be in compliance with the covenants, if that observation is helpful to you. Both the Board and ARB wish to be respectful in presenting this decision to you, and wish to clearly state that we do not offer this decision disrespectfully or dismissively in any manner. The position of the Board and ARB is that, at the end of every process and discussion, we are neighbors, seeking as well as offering, mutual respect and acting in the nrighborhood's collective interests.
