HomeMy WebLinkAboutUtility Easement_Recorded 10-17-83WX-1261 J.O./Est. 8174 Parcel No. 3969 UTILITY EASEMENT L93-13I IS BOOK PAGE —4 5-0— The undersigned, in consideration of the sum of One Dollar ($1.U0) and other consideration, receipt of which is hereby acknowledged, hereby grants unto Indiana Bell Telephone Company, Incorporated, its successors and assigns, a right of way and easement to install, construct, operate, maintain, repair, supplement and remove, at any time or times hereafter, its communication systems consisting of poles, anchors, conduits, manholes, cables, wire, and fixtures as it may from time to time require or deem proper therefore, in, under and upon a strip of land located in Section 30, Township 18N, Range 4E, Township of Clay, County of Hamilton, State of Indiana, more particularly described as follows: Part of the Original Town of Bethlehem, now Carmel, in that part known as the Mills Addition to said Town, as recorded in Deed Record E, page 512 in the Office of the Recorder of Hamilton County, Indiana, to wit: Beginning at the northeast corner of Lot #3 thence extending west on and along the north line of said Lot #3 15 feet, thence north 10 feet, to the south line of Lot #2, thence east on and along said south lot line 15 feet, thence south 10 feet to the point of beginning. Also the right of ingress and egress over and across said strip and land adjacent to said strip for the purpose of exercising the rights herein granted. The Grantee agrees to be responsible and pay for all damages to the Grantor's property and/or crops that have been caused by the construction and maintenance of said communication system. The Grantor warrants that no structure or building, except fencing, driveways or streets, shall be erected upon said easement. The Grantor agrees to notify the Grantee before any construction of any fences, driveways or streets is started. The Grantor reserves, after the completion of said system the full use of the land which is not inconsistent with the existence and maintenance of said communication system but does agree to notify the Grantee of any proposed change in elevation or glade within the area of said easement. c_ September Witness our hands this 14th day of Sep�19f3j, ,•,•.
