The petitioner was not present.
Mrs. Litvan read a letter from Mayor Reiman regarding the Baur Commercial
Park buffer zone (which is a part of the official minutes and attached to
the master copy) .
Mrs. Litvan stated that this item should be deferred until the city
takes some action regarding the buffer zone .
Mr. Kiphart related that no plans have been brought in to his office .
Mrs . Badger moved that this item be dismissed for lack of prosecution.
Seconded by Mr. Litzsinger.
Motion carried.
Mr. Kiphart is to send notification of the Board' s action to the petition-
er and Mr. Baur.
This application cannot be placed on the Board' s agenda again for three
(3 months .
111 7: 30 P.M. , Public Hearing on Docket No.V56-83, Use Variance Appli-
cation for Union State Bank for property located at 20 First Ave .
N.E . to be used as office space . Two zoning classifications are in-
volved (R-3 and B-1) . Property involves 0 .24 acre .
Filed by James Nelson for Union State Bank.
The public hearing opened at 7 :54 with Mr. Nelson making the presentation
for a dwelling to be used as office space. Photos were shown.
Mr. George Burrell, President of Union State Bank, was present.
A permanent variance is requested and approximately five (5) people will
occupy the dwelling for office purposes.
An area map and the plans were shown.
They wish to add six (6) parking spaces to the rear of the property.
Mr. Nelson stated that the variance is justified because (1) the character
of the area has so changed that residence use is not the highest use for
this property, (2) there are 2 zoning classifications, B-1 and R-3, on this
property and (3) the variance gives the Board and Mr. Kiphart' s office con-
trol of the use of this property.
The public hearing closed at 8 :01 .
Mr. Litzsinger expressed concern about starting a precedent here on this
land use issue .
Mr. Nelson responded stating that there are certain cases where it is
justified- the area has so changed.
Mr. Kiphart requested that the petitioner provide landscaping on the north
side of the property and suggested 6 hemlocks, 5 to 6 ft. tall.
The petitioner agreed to this request.
Mr. McFadden moved approval with the addition of 6 hemlocks to be 5 to 6
ft . tall each, as Mr. Kiphart requested, and that this variance for perpetuity
is to run with the land .
Seconded by Mrs. Book.
Finding of fact was completed by members.
The motion carried 7 to 1 (Mr. Litzsinger voting NO) .
3h. 7 :30 P.M. , Public Hearing on Docket No . S 57-83, Special Exception
Application for fuel sales facility for Crystal Flash Petroleum,
545 S. Range Line Rd. in B-1 zoning.
Filed by Nm. Waddick for Crystal Flash.
The public hearing opened at 8 : 22 with Mr. Waddick making the presentation
for bulk fuel sales facility for trucks.
Greg Cobb, Mgr. for service stations for Crystal Flash, was present.
The only change will be the addition of a 10' x 14' dock to be located
at the rear of the building. All of the pumping is underground.
Renderings and photos of the facility were shown.
The above ground tanks located across the street will be shut down and
removed by the end of December 1983.
