Docket No. 18010004 Z: Westbridge PUD Rezone The applicant seeks rezone and primary plat approvals for 13.91 acres to change to PUD/Planned Unit Development. The site is located at 4281 W. 106th Street and is zoned S-1/Residential. Filed by Randy Green with ISBG Capital LLC. *Updates to the Dept. Report are written in blue Project Overview: This proposed PUD seeks to create a new subdivision with 3 single-family lots, 39 townhomes, and 35% open space. Currently it is zoned S1/Residence, which allows for a maximum density of 1 lot/acre, and the petitioner proposes about 3.02 units/acre. Surrounding the property are businesses to the west, common area for Weston Place neighborhood to the north, large S1/Residential lots to the east, and smaller S2/Residential lots to the south. Project Update: This project was originally filed in December of 2017 but did not have a Public Hearing until June of 2018 because the petitioner tabled the item as they weren’t ready to present to the Plan Commission. The project was then sent to the Residential Committee for review where it was heard and discussed at several meetings and subsequently tabled multiple times so that the petitioner could try to address the outstanding comments. The last committee meeting this project was heard at was March 28, 2019. At that time the Committee discussed many items, including the drainage. The Carmel Engineering Department was at the meeting and gave an update, stating that they did not support the project moving forward and that they had major concerns regarding the floodplain. The petitioner agreed to continue to address the drainage concerns and not come back to committee until the drainage issue had been resolved. The petitioner has still not addressed the Carmel Engineering Dept. comments, and has not submitted any new information, that we are aware of, since July of 2019. According to the Plan Commission Rules of Procedure, when a petitioner has failed to appear at two consecutive meetings, the case may be dismissed for lack of prosecution. This Westbridge PUD Rezone petition has failed to appear at 6 consecutive meetings. It appears that this project is not ready to move forward, and so the Dept. would recommend that the Committee dismiss this petition for lack of prosecution. Recommendation: The Department of Community Services recommends the Committee Dismiss this item for lack of prosecution.
