Home My WebLink AboutGTE Mobilnet of Indiana d/b/a Verizon Wireless/Second Amendment to Lease Agreement Tenant Site Name: GN Cannel City Tenant Site ID: 129065 gigisuBN SECOND AMENDMENT TO LEASE AGREEMENT ;TO THIS SECOND AMENDMENT TO LEASE AGREEMENT ("Second Amendment") is made and entered into this day of , 2019, by and between the City of Carmel, Indiana, acting by and through its Board of Public Works and Safety ("Landlord"), and GTE Mobilnet of Indiana Limited Partnership d/b/a Verizon Wireless("Tenant"). WHEREAS,on August 27, 1997,Landlord and Tenant entered into that certain Lease Agreement ("Agreement"), whereby Landlord leased to Tenant tower and land space located at 473 Third Avenue SW,Carmel,Indiana,as more particularly described in Exhibits A and B to the Agreement;and WHEREAS,on April 5,2017, Landlord and Tenant entered into that certain First Amendment to Lease Agreement ("First Amendment"), whereby Landlord permitted Tenant to replace a portion of its antenna array and to add related equipment to the Landlord's tower;and WHEREAS, Tenant now desires to modify its equipment on Landlord's tower and Landlord is amenable to such modification. NOW, THEREFORE, in consideration of the mutual covenants contained herein and for other good and valuable consideration,the receipt and sufficiency of which are hereby acknowledged,Landlord and Tenant agree as follows: 1. Capitalized Terms. Capitalized terms used but not specifically defined in this Second Amendment shall have the meanings ascribed to them in the Agreement, unless a different meaning is clearly required by the context hereof. 2. Additional Improvements. Exhibit D-1 to the Agreement is hereby deleted in its entirety and replaced with Exhibit D-2 attached to this Second Amendment. Exhibit D-2 documents the equipment Tenant is permitted to install on Landlord's tower. 3. Effect of Second Amendment. All other terms,provisions and conditions set forth in the Agreement and not specifically amended herein shall be and remain the same as provided for in the Agreement.
