COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Jeff Worrell; Council Members: Laura Campbell, Ronald E. Carter, Kevin D. Rider, Sue Finkam, Anthony Green, H. Bruce Kimball, and Deputy Clerk Jacob Quinn were present. Council President Worrell called the meeting to order at 6:00 p.m. AGENDA APPROVAL Councilor Rider moved to add Resolution CC-10-21-19-04 to the meeting's agenda. Councilor Campbell seconded. There was no Council discussion. Council President Worrell called for the vote. The motion Iwas approved 7-0. INVOCATION Pastor Gary Vaughan, Harvest Bible Chapel North, delivered the Invocation. Councilor Campbell led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS Council President Worrell read a proclamation for Community Media Day. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL Gail Thomas expressed concerns about small cells and 5G technology and spoke in support of Resolution CC 10-21-19-03. John Koppin, Indiana Broadband and Technology Association, spoke in opposition to Resolution CC 10- 21-19-03 and stated that there is no consistent scientific proof that long term exposure to these devices has negative impacts on humans. Steve Immel expressed concern that after numerous requests for the Christkindlmarkt financials, he has been unable to obtain them. 1 Jennifer Hallowell,Indiana Technology & Innovation Association, asked Council to defeat Resolution ICC 10-21-19-03 as passing it would have a chilling effect on Indiana's and Carmel's ability to expand connectivity. Hans Collins requested that Council remove from the Carmel city budget the amount of money that is currently being collected to cover a portion of the cost for Hamilton County's 911 service. Sean Hendrix spoke in opposition to Resolution CC 10-21-19-03 and encouraged Council not to slow down innovation. John Schuler, OneZone, expressed concern with Resolution CC 10-21-19-03. Reliable and fast interne connectivity is essential to the businesses that choose Carmel. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS There were none. CONSENT AGENDA Councilor Rider moved to approve the consent agenda. Councilor Campbell seconded. There was no Council discussion. Council President Worrell called for the vote. Wire Transfers $1,445,707.23 ACTION ON MAYORAL VETOES There were none. COMMITTEE REPORTS Councilor Finkam reported that the Finance, Utilities and Rules Committee had not met. Councilor Green reported that the Land Use and Special Studies Committee did meet. Ordinance D-2484- 19 is returning to the full Council with a positive 2-0 recommendation. OTHER REPORTS—(at the first meeting of the month s1)ccificd below): Dr. Beresford and Tara Ascioti from the Carmel Education Foundation thanked Council for their donations to the organization. OLD BUSINESS Councilor President Worrell announced the Fourth Reading of Ordinance D-2477-19; An Ordinance of the Common Council of the City of Carmel, Indiana, Adding Section 6-73 to Chapter 6,Article 4 of the Carmel City Code; Sponsor: Councilor Worrell. Item remains in the Land Use and Special Studies Committee. Councilor President Worrell announced the Third Reading of Ordinance Z-645-19; An Ordinance of the Common Council of the City of Carmel, Indiana, Rezoning Real Estate to the S2 Residential District; Sponsor: Councilor Campbell. Item remains in the Land Use and Special Studies Committee. Councilor President Worrell announced the Third Reading of Ordinance Z-644-19; An Ordinance of the Common Council of the City of Carmel, Indiana, Restating and Amending an Ordinance to Establish an Impact Fee for the Purpose of Planning and Financing Park and Recreational Infrastructure Needed to Serve New Residential Development ; Sponsor: Councilor Campbell. Item remains in the Finance, Utilities and Rules Committee. Councilor President Worrell announced Resolution CC 09-16-19-02; A Resolution of the Common Council of the City of Cannel, Indiana, Approving an Amendment to the Cannel Clay Comprehensive IPlan Regarding the Zone Improvement Plan; Sponsor: Councilor Campbell. Item remains in the Finance, Utilities and Rules Committee. Councilor President Worrell announced the Third Reading of Ordinance D-2484-19; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 6, Article 4, Section 6-66 of the Cannel City Code. Jon Oberlander,Assistant Corporation Counsel, presented the proposed changes passed by the Land Use Committee. Councilor Finkam moved to amend Version A by inserting on line 40 after boundaries,excluding the parking lot for Monon Square. Councilor Campbell seconded. There was no Council discussion. Council President Worrell called for the vote. The motion passed 7-0. Councilor Finkam moved to amend Ordinance D-2484-19 by inserting Version A As Amended in whole. Councilor Rider seconded. Councilor Finkam moved to reduce the Community Relations and Economic Development budget by$375,000 for the music and film festival funding. Councilor Rider seconded. There was no Council discussion. Council President Worrell called for the vote. The motion passed 7-0. Councilor Green expressed concerns about the lack of funding for police officers. Councilor Finkam moved to approve Ordinance D-2483-19 As Amended. Councilor Rider seconded. . There was no Council Idiscussion. Council President Worrell called for the vote. Councilor President Worrell announced the Second Reading of Ordinance D-2488-19; An Ordinance of the Common Council of the City of Cannel, Indiana, Amending Chapter 8, Article 6, Sections 8-56(d) and 8-58(a). Item remains in the Finance, Utilities and Rules Committee. PUBLIC HEARINGS Councilor President Worrell announced the First Reading of Ordinance D-2489-19; An Ordinance of the Common Council of the City of Cannel, Indiana, Authorizing and Approving an Appropriation of Funds From the Operating Balance of the General Fund(Fund#101)to the 2019 ICS Budget. Councilor Rider moved to introduce the item into business. Councilor Campbell seconded. Timothy Renick, Director of Information and Communication Systems,presented the item to Council. Council President Worrell opened the public hearing at 6:59 p.m. Seeing no one who wished to address Council, Council President Worrell closed the public hearing at I6:59 p.m. Councilor Rider moved to suspend the rules and act on this tonight. NEW BUSINESS Councilor President Worrell announced the First Reading of Ordinance D-2486-19; An Ordinance of the Common Council of the City of Cannel, Indiana, Concerning the Construction of Additions and Improvements to the Waterworks of the City of Carmel, Indiana; Authorizing the Issuance of Revenue Bonds for Such Purposes. Councilor Campbell moved to introduce the item into business. Councilor Rider seconded. John Duffy, Director of the Utilities,presented the item to Council. Council President Worrell referred the item to the Finance,Utilities and Rules Committee. Councilor President Worrell announced the First Reading of Ordinance D-2490-19; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 3, Division II, Sections 2-39, 2-40, 2-42, 2-48, 2-51, Division III, Sections 2-60 and 2-61 and Division VI, Section 2-85 of the Cannel City Code. Councilor Finkam moved to introduce the item into business. Councilor Campbell seconded. Barb Lamb, Director of Human Resources,presented the item to Council. Ordinance D-2490-19 was approved 7-0. 4 ICouncilor President Worrell announced Resolution CC-10-21-19-03: A Resolution of the Common Council of the City of Carmel, Indiana, Requesting the State Legislature to Take Action to Protect Indiana's Residents and Guests From any Harmful Effects of 5G Technology. Councilor Campbell moved to introduce the item into business. Councilor Carter seconded. Councilor Green introduced the item to Council. Benjamin Legge, Assistant Corporation Counsel,presented the item to Council. Council President Worrell passed the gavel to Councilor Campbell. Council President Worrell addressed Council. There was extensive Council discussion. Council President Worrell moved to create a task force to study this issue further. Councilor Finkam seconded. There was no Council discussion. Councilor Campbell called for the vote. Motion failed 3-4 (Kimball, Campbell, Carter and Green opposed). Council President Worrell regained the gavel. Councilor Carter moved to approve Resolution CC-10-21-19-03. Councilor Campbell seconded. There was no Council discussion. Council President Worrell called for the vote. Councilor President Worrell announced Resolution CC-10-21-19-02: A Resolution of the Common Council of the City of Cannel, Indiana, Expressing Interest in the Purchase of Certain Property Valued at Over$25,000. Councilor Rider moved to introduce the item into business. Councilor Finkam seconded. John Duffy presented the item to Council.
