Estate"). Lennar is seeking development plan ("DP") approval and architectural design, lighting, landscaping
and signage ("ADLS") approval before the City of Carniel's Plan Commission in order to develop the Real
Estate for a residential townhome community (collectively, the "Application"). In addition, if Lennar
determines that other approvals may be required or deemed necessary (collectively the "Other Approvals"), the
foregoing Consent and Joinder in Application shall apply to the Application and for any Other Approvals

FALCON NEST II, LLC OWNER'S CONSENT TO AND JOINDER IN APPLICATIONS
The undersigned, on behalf of Falcon Nest II, LLC ("Falcon Nest 11"), as the owner of a parcel of real estate
consisting of approximately 12 acres that is identified per the records of the Hamilton County, Indiana

Estate"). Falcon Nest II hereby consents to, authorizes and joins in the filing of applications by Lennar Homes of

Project Description
Lennar Homes of Indiana, Inc. (“Lennar”) is proposing the development of a residential
townhome community to be known as the “Legacy Townhomes” that will consist of approximately
23 buildings consisting of approximately 146 individual townhomes. The site is located west of
Community Drive and adjacent to the Play School at Legacy and south of 146th Street within the
Legacy development and is identified on the enclosed aerial photograph (the “Real Estate”). The
site consists of approximately 12 acres and is currently zoned pursuant to the “Legacy PUD
District” Ordinance No. Z-501-07.
The Legacy PUD District zoning permits the development of residential townhomes on the
Real Estate. As shown on the site plan, connectivity within the Legacy development for the
“Legacy Townhomes” is provided by street connections from Equality Boulevard, James Dean
Drive and Larson Drive. Enclosed are renderings of the proposed townhome building elevations.
The anticipated price range for the individual townhomes is between approximately $260,000 to
$320,000.
The applications before the Plan Commission include (i) Primary Plat approval for the site
design; and, (ii) Architectural Design, Lighting, Landscaping and Signage (“ADLS”) approval.
