The applicant seeks the following development standards variance approval for a fence along Main St.: 1. Docket No. 19090028 V UDO Section 5.09.B.5 Max.6' tall fence allowed when set back 6', 8' fence proposed with 0' setback.The site is located at 3 Ironwood Ct.,also with frontage on E.Main St.(Lot 199 in Cool Creek North Subdivision).It is zoned Rl/Residence.Filed by Shannon and David Minnaar,owners. Petitioners: Shannon and David Minnaar: • We have our home's security camera footage that is placed in our backyard and facing the street. It shows car lights shining from Main Street in our backyard. Public Comments: None Department Report: Angie Conn • I have nothing to add to what is already stated in the Department Report Board Comments: Leo Dierckman: • Is it your intention to go to the BPW to ask for permission to place the fence on the City's ROW? David Minnarr's: We don't intend to. We were told not to go that route. • If you want to go to the BPW and you can get an approval from them, I would like it as a 6' fence. I will approve an 8' fence that is only placed on your property. • I drove by and looked around this stretch of path that is behind the Minnaar's property. It's a complicated situation in the way the land grade difference is. Approved 1-0. An 8' fence granted if placed on Minnaar's property. If the fence will be located within the City ROW, then Consent to Encroach approval from the BPW(Board of Public Works& Safety) is required AND only a 6' tall fence height would be allowed.
