My original intent of the Determination was twofold; to clarify the application of the September 25, 2017 Letter of Decision from the Board of Zoning Appeals ("BZA Order") to the operation on the Property of a Special Events Venue/Meeting or Party Hall in the S-1 Residential Zone, and to explain that despite the BZA Order, the City of Carmel Unified Development Ordinance ("UDO") would allow a limited number of Short-term Outdoor Special Events as a Temporary Use on the Property. Pursuant to my authority under UDO 1.27, I interpreted the text of the definitions for "Special Event, Outdoor" and "Use, Temporary to mean that your client could hold an outdoor short-term entertainment styled special events once per season, for a maximum of four (4) events per year. However, your client disagreed with my interpretation of the UDO and appealed the Determination. Throughout the appeal, the City of Cannel attempted to negotiate a settlement agreement with your client. Unfortunately, even after formalized mediation efforts, any attempt to achieve a reasonable resolution failed. Therefore, it now seems prudent to withdraw my Determination and allow the BZA Order to stand on its own merits, without any attempt at further clarification or interpretation by me. Articles in the IBJ following the BZA ruling against the Zoning Variance in the Fall of 2017, indicated that Mr. Lucas intended to ignore the BZA Ruling in September 2017, and continue commercializing his personal home. 4. There are SUV's plastered with Lucas Estate Wraps, advertising the commercial use of the Lucas Estate are driving all around Carmel, which flies in the face of their claim they do not advertise or seek new business!! 5. We have done this by purchasing property in 1984 that enabled us to run a commercial business of this type in the proper zoning area of Carmel, adhering to all codes, requirements, zoning laws, and state and county Health Department requirements, and State Liquor Licensing laws. We have performed this in good faith always acknowledging our responsibility as a commercial enterprise in our city. We also pay well over 85,000 per year in Property Taxes necessarily a result of our zoning commitments. During this time many venues have followed our lead in providing these types of services throughout our community and county. We do no object to this type of competition that is the backbone of our American Economy. We welcome competition as it generates more interest in our services. What we do object too in this application for variance is the creation of a profit oriented business in a residential zoned neighborhood. This goes beyond the comparison of fair and equitable competition in a host of ways. As we were the caterer for the Hilbert's in the 90's at the estate, every event we performed for them on that property was a charitable donation or personal event for the Hilbert's, never was there a for profit event held at the property. Clearly by simply going to the Lucas Estate website you will see this is a for profit venture, we have also been informed that the goal of the enterprise was to significantly increase the demand for estate rental and catering over the next few years. Our objection to this variance request is rooted in the practical application of zoning ordinances created by our civic and elected leaders over the past 30 years. In short there is zoning that allows commercial enterprises to perform, and zoning that protects areas from such operations. Simply saying that "it's ok with the neighbors" is not good enough. Allowing commercial operations to operate in residential sends a message that we too can look for opportunities that circumvent zoning requirements. I.E. suppose Ritz Charles purchased the large property on Clay Center Road just up the street and began renting it out for public events. Imagine citizens being able to open retail on their properties, run schools and churches from their homes, as the list goes on. Zoning has been created in the City Of Carmel allowing business to compete on equal footing, abide by all laws governing such, pay a much higher property tax, and market their endeavors according to those requirements that fit their application such as, parking, fire safety, health permitting, ABC permitting, State Sales tax requirements and city tax, ingress and egress to and from the commercial site. Properly zoned businesses also hire and train local employees and pay all mandated benefits. All of these are circumvented with a business is allowed to operate in a lessor zoning environment. If the Lucas Estate were to purchase property in a properly zoned area of Carmel, we would welcome and appreciate their entrance into the hospitality industry, the suggestion that the variance does not affect ours or other similar businesses in our community who play by the zoning rules is far from true. I would be happy to support a TOTAL REZONE of this property and the surrounding area to Commercial as this is the proper channel in creating a profit oriented endeavor. We ask that you the Board of Zoning appeals reject this request in all areas that are applicable and enforce the codes as they stand or require the applicant to apply for a rezone of the property to commercial status. August 29, 2017 Ty,evlous\ LMv"rI� To: Carmel Board of Zoning Appeals RE: Lucas Living Trust 1704002 UV Special Events Venue Board Members: APR 12 2016 D BY — Last evening, we had an opportunity to hear many views regarding the use variance request of the Lucas Estate Group, due to the time constraints that were present, I was unable to complete my remonstrance to this use variance; also I would like to clarify some misgivings and misinformation that was disseminated. Ninety percent of the in- favor public speakers were charitable officers or members of various not for profit organizations that have or are using the Lucas Venues. I can't state enough that the charitable and philanthropic endeavors of the Lucas Family are undeniable, but this has nothing to do with the requirements of granting a use variance of this magnitude and scale. Some clarification based on 33 years' experience in the event business: • The last time I "pulled the plug" on sound at an event at Ritz Charles, the bride's parents refused to pay, saying that we ruined their daughter's big day. Sound is an unmanageable fact of this business, today young people like it loud and there is nothing, not special speakers, pulling the plug, turning down the sound, or any other imaginable solution that works. I have tried every method conceivable. • Non -independent studies of sound and traffic are geared to meet the requirements of the person paying for the service, plain and simple. Unless you order your own with the right circumstances present and fluid, you will never get the true reading. • The petitioners comment last night; "The owner of Ritz Charles should be happy that the 1.5 million he is losing in business to the Lucas Venue is going to Charity" was not only absurd but again has nothing to do with the variance request. 1. Ritz Charles has given to charity and various groups over 4 million dollars in the past 33 years. It's insulting to think that the Lucas Family has a corner on philanthropy. 2. The constant reference of NOT FOR PROFIT use of the venue would indicate that those groups are not paying for food and beverage costs. To say that the Venue can continue to host only NOT FOR PROFIT events does not change the commercial nature of the request. They are still paying 941 taxes on staff, paying the staff, collecting and withholding, and I would guess over 90% of those events are paying for their event food and beverage tabs. There is still commerce activity at each event. There was a constant reference last night by the petitioner that "we do not charge rent on the facility", Ritz Charles has not charged rent at our main facility since opening in 1985, the costs associated with operating and maintaining the facility can be put in a number of charges associated with the event, most notably food and beverage. There were consistent references last night to who would be able to use the venue and that the Lucas Family had to approve every user, in fact some perspective users where turned away and referred to other venues. If the litmus test for approving this use variance as indicated in findings of fact are that this venue is "a benefit to the public interest, and or a benefit to the community" how do you explain that this venue is not for everyone, you must be approved to be there. It should be noted that in some cases it benefits the community. If you charge for food and beverage, charge sales tax, pay wages, collect tax withholdings of employees, you are a commercial business with ethical standards that must be met including inclusiveness. Having the sound diminished at a certain time does not mean that the event ends. It is our experience that many of the attending guest at any event would stay up to two additional hours, after that we have remained open to accept rental item pickups, had staff reset for the next day or morning, cleaning of the facility, and on and on. • We have been informed by service staff that have worked at the mansion that there is a clear and present effort on the behalf of the operating staff to ramp up the business, to say that they are" not in this for the money" is purely condescending verbiage. • Over thirty years our company has spent very little on marketing, when you operate a event venue, WORD OF MOUTH, is the best avenue for marketing. Marketing the Lucas Venues will be totally dependent on their performance, based on the petitioner's comments last night, no other company can match the level of the Lucas expectations and control, there isn't really a need for marketing beyond that. Again, to say they will not be advertising in anyway is just not the case. These clarifications as listed above will hopefully help in understanding the event business as I know. However, and again the real question here is; does the request of the petitioner meet the threshold of approval based on the findings required for such. 1. Clearly there is no economic burden on the petitioner or the property to exist as a residential home. 2. The grant of this variance will be contrary to the public interest because it will not be available to the entire public who wish to use the venue, in fact this in itself creates a unnecessary hardship to the public. 3. The scale of the site, the uniqueness of the property, the zoning as it exists, is no different than 40 other properties West of Meridian Street that could be considered unique place to host venues. There is no NATURAL condition peculiar to this site. 4. While the remaining of the S-1 classification would not interfere with the Carmel Comprehensive Plan, the use certainly does. If a salon operator lived in her home 128 hours a week and then operated a salon out of her home the other 40, would this interfere with the comprehensive plan or does she belong in a commercial environment. 5. Competition is a wonderful part of the strength of our wonderful American System of Commerce, it keeps prices in check, allows citizens to find the job or occupation they want, unfettered, and frankly is the backbone of a free enterprise system. To arbitrarily allow competition to be tilted mechanically by a government agency places that system in jeopardy. In the eastern part of our county there is a city that supported and allowed a wonderful venue for exercise to exist, within 9 months six entrepreneurial matching business exited the city. This board of volunteers to our city has a tough decision to make, I completely realize the compassion that you must have to try and help every citizen with their request and needs for variance help. It's natural that we want all our citizens to be happy with every outcome. The Lucas family is extremely generous with their philanthropic endeavors, denying this request does not change that ability for them to give back to the community. There are a hundred ways to channel their charity. I ask that you vote on this next month from a perspective that looks at the facts of the use vs. the stature of the applicant and those that spoke on their behalf. The letter states (6t" paragraph) that "... Use of the property by Mr. Lucas for legitimate residential purposes, including for private parties and fundraising events sponsored by and hosted by the Lucas's, is not an issue to the City of Carmel." The functions Lucas has at their property are not for legitimate residential purposes. Please see following on how Lucas is operating and what industry practices are for charging for such events. 1. Facility charge is not free: Lucas says they do not charge for the facility, that it is free. It is not. Not charging for the facility is a standard industry practice. At Ritz Charles we also do NOT CHARGE fees for use of our facility, yes, it's free. In our world you price your events (food and beverage) to adequately cover all overhead of your campus. To say that free facilities is ok on Lucas is a joke. They are still charging for food, beverage, labor and overhead expenses. 2. Not for Profits are paying Lucas: While we have always discounted special events for those organizations, they still cover our basic costs associated with the event, I. E. a 10 or 20 % discount for those groups doesn't mean they are free. The venue still gets paid, so they can purchase food, beverage, alcohol, etc. If Lucas holds an event and does it entirely for free, no cost to the user at all, they would be very few and far between. There are all types of ways to conceal someone paying for an event; it might be that a donor pays it on the side or a related organization pays, but the event is still listed as a free donated event to the users - there is still payment. A basic fact remains: there are many non -facility costs even besides food and beverage: servers, bartenders, security, other staff who must get paid on fundraising events. That Not For Profits don't pay is ludicrous. Carmel should not allow Not For Profit events unless Lucas covers ALL costs, not just some such as the facility. Otherwise, it is a commercial event. 3. Lucas plans to grow: Because we compete head-on with Lucas we learn from the inside, from our ex - employees. Sadly, we have lost good employees to a business that should not exist where it is located. We know that at many employee meetings that were and are held, our past employees have been told that Lucas intends to ramp up the business. 4. Alcohol commerce: Special care is required when alcohol is provided, especially with underage and driving consequences. I have not checked recently, but previously it was unclear if Lucas had a license or was having the bar catered by another entity. Regardless of "free" drinks, alcohol commerce is being conducted on a residential property. 5. Effective monitoring of Lucas is not possible: Each event would have to be investigated: was it free, was it for an old friend or a new convenient friend, were there payments to Lucas indirectly. There is a real possibility that every event they conduct could be a "friend" or not for profit. Opening even the slightest crack in that door allows for mis-interpretation that all will get eventually tired of researching. It should be no events period in my mind. The only exception might be their own company events, or immediate family, and then that still leaves a lot of room for speculation. We used to live in the Houston area where the zoning is virtually non- existant, so commercial buildings are often built right next to residential areas. The effect is awful! One of the reasons we moved to Carmel was the beautiful residential neighborhoods and the protected zoning. The Lucas estate should not be re- zoned to allow commercial use as it violates the rights of everyone who lives within a mile or more of the property. I am a 40-year resident of Carmel. In 1988, 30 years ago, I moved to west to Queens Manor to obtain a larger residential lot to live in a peaceful and serene residential neighborhood. Our neighborhood has now been disrupted by the noise, traffic, and commotion in connection with the operation of the Lucas Estate and Party Hall as an entertainment facility. I am writing relating to your letter of May 18, 2018 to counsel for the Lucas Estate. The Lucas Estate and Party Hall presents two distinct issues. First, it is a non - permissible commercial activity in a residential neighborhood on property that is zoned residential. Second, the activities at the facility consistently violate the City's noise ordinance. Your letter clarifies that the BZA has already denied the Lucas Estate's request for a use variance to utilize the property as a special events venue. As such, the continued commercial use of this property must cease. However, the commercial use of the property for weddings, graduation parties, bar/bat mitzvahs, and other events has continued this spring and summer. Thank you for letter and your efforts to strictly enforce the Carmel Zoning Ordinance to restrict the use of this residential property from being utilized in a commercial manner. Mr. Michael P. The problem is that prior owners constructed large buildings (party barn, basketball court, patios, and other facilities) as part of their residential mansions and estates. New owners including the Lucases have found out that the facilities are not usable for residential purposes and simply are not sustainable for residential purposes. This circumstance cannot be allowed to result in the owners utilizing those facilities that they no longer deem usable as part of their residential property to become facilities used for commercial purposes. The fact of the matter is that the Lucases have exacerbated the situation by the construction of a commercial kitchen on the property and additional parking and roads to connect parking lots for the large structures on the property without appropriate zoning approval. At the same time, I believe several items in your letter should be clarified and emphasized. You indicate that the Lucases may use the property for private parties and fundraising events sponsored and hosted by the Lucases. The letter should be clear that, for an event to be hosted by the Lucases, Forrest Lucas and/or his wife, Charlotte, would be required to be present. Specifically, an event could not be hosted in their absence solely by their events promotion staff and catering staff. Your letter indicates that internet advertisement of the Lucas Estate for weddings and other special events must cease. As you know, this internet advertising has continued in many forms and on many sites. It must be clear that no advertising should occur, internet or otherwise, including advertising and other promotional activities conducted by staff or employees on their personal social media sites. Your letter indicates that groups holding events at the property, hosted by the Lucases, must not charge fees, surcharges, or other forms of payment for use of the property. But as others have noted, enforcement of these rules at the Lucas Estate outdoor facility (with an adjacent indoor venue) doesn't seem possible. There have already been at least 11 events since warm weather arrived. The Carmel Police Department (CPD) has not enforced the noise provisions of the City code (6-158, copied below) at the Lucas Estate residence zoned S-1. The nonenforcement appears to be caused by conflicts of interest and misinformation on what the code is. We are not aware of any citations issued. Important is that Carmel off -duty Police Officers are used by Lucas as private security for their events. When I call for a noise complaint and request an officer, the dispatched officer admits he first calls the off -duty CPD officer at Lucas and advises them of the complaint. Sometimes he stops first at Lucas. Only once has he had a sound measuring device. If he called the Carmel off -duty Officer he is told they are in compliance. The dispatched "Officer" is two levels down from a Lieutenant in the CPD organization and is unlikely to challenge the Lucas Off -Duty Lieutenant. • 60 db is above the Carmel code limit at any time, a violation not cited when admitted by the Off -duty. We stood in his driveway ai about the noise as he wanted to speak with an officer directly. No reading was taken from his specific house, read 75 decibels on the second call. Lawnmowers were present in the area at the time of the call and the prio Mr. Flanigan. The music and voices from the party in question were able to be heard from Mr. Flanigan's di decibel reading was able to be captured at the time. • The Officer stated he heard the music and voices on my driveway, a distance of almost 800 feet from the music source. • Additionally, note he heard the music above even the lawnmower noise. • The music is usually so loud that we cannot listen to room level music on our deck because of sound interference. • The Officer had no sound meter to measure the sound and issue a citation. 05/12/2018 : 22:46:04 cpmkeinsley Narrative: Lt. Iviiller and I walked the property lines all the way up to the address in question. We utilized the CPD issued decibel meter to take readings from the street, property line fence row. All readings were photographed on my department issued cell phone. All decibel readings were including voice noise that had not been amplified, just attendees speaking and singing. We made contact wit showed him the pictures of the decibel, readings. No violation of ordinance observed at the time of the call an, The Officer and a Lieutenant who had a sound meter informed me of their readings along my property line. I expect they are correct, but please note they were all taken just prior to 10:46 PM and the music was already turned off. Additionally, please remember that the reading for just the attendees talking and singing resulted in a reading in the "55 dB or below" range, and furthermore "along the property line" is 300 to about 800 feet from the source, not a distance of 50 feet as the Carmel Code requires. Some think there being no music is caused by the Off -duty being told sound readings will be taken. The Lieutenant advised my dB meter is not accurate, perhaps. The physics of sound travel laws are old and have not changed. If the sound at the Lucas Estate after 10pm were SUB at 50 feet (as the code requires), at 800 feet where the officer measured, the sound would be about 26bB (50-24), almost inaudible. Sound has for thousands of years dropped 6db for each doubling of distance (504100, 4200, -->400, 4800). My iPhone dB meter is not off that much. We are not aware of any CPD sound meter reading 50 feet from the source (about the Lucas property line) by a CPD Officer when the music is played at usual loudness. Readings should be taken without advising the Off -duty Lucas -paid CPD Officers and taken repeatedly during music events as the code requires. Whether an Officer level CPD person will issue a citation to an off -duty Lieutenant is unknown but doubtful. Additionally, citations should be issued multiple times during an event if the violation persists. A $2,500 fee is not sufficient when Lucas is making upwards of $25,000 per event. The issue, of course, is not the sound. The former resident Steve Hilbert had fundraisers and parties, but these were few and far between. Here we are again today, almost a year later in June of 2018. Regardless of your rulings and decisions, the events at the Lucas Estate still continue. Within the recent and short time frame of April 2018 to June 17, 2018 there have already been 11 events at the Lucas property. These all have been observed, and often simultaneously heard, by residents of Queens Manor including the following dates: April 7"', April 220d, May 11', May 12', May 20"', May 22"d, May 26"', June 2"d, June 9"', June 1P, June 16" . Furthermore, there is already an event scheduled for June 22"d, as well as events for July and August that are being advertised on the internet. In addition, a recent event of an engagement on May 22"d, 2018 is already advertising their wedding reception at the Lucas Estate for the fall of 2018, and so on and so on. Of the 11 events from April 2018 to June 17, 2018. seven (7) were indoor and four (4) were outdoor. All four (4) outdoor events required multiple calls to the Carmel Police Department (CPD) regarding noise and nuisance. None of these four (4) events had filed for the required Outdoor Special Event Temporary Use Permits. Also, the off -duty Carmel Police officers who work the security at these events have not filed their Conflict of Interest Disclosure Forms, even though the Town of Carmel and the internal CPD Policy and Procedures requires it. In this letter I will re -demonstrate the issues Queens Manor residents face, as the Lucas Estate continues to not comply with any of the Carmel BZA denials, DoCS determinations, Carmel Zoning Ordinances, Carmel's Comprehensive Plans, and Carmel City Codes. l will also remind you that last year we submitted a 13-page letter and a petition signed by Queens Manor residents regarding this issue. Due to our recognition of the fact that without your ability to bear witness to the types and frequency of the events taking place at the Lucas Estate, and to experience the crowds and noise level that the events create firsthand, we will outline much of the activity for you. There is an immeasurable influx of cars that that drive through our neighborhood looking for the entrance to Lucas Estate venue before the events (particularly now that 116"' street is closed). This includes UBER and LYFT cars that drive through our neighborhood from 10:00 pm to 11:30pm looking to pick up Lucas Event venue attendees. There have been concerns about intoxicated drivers that leave the Lucas Estate venue and drive down Ditch Road and through Crooked Stick. Furthermore, we cannot imagine the stress on the sanitary infrastructure (since it is a residential property) that events of many hundreds of event attendees would cause. Finally, we are mindful of the negative impact on the values of our homes this unsanctioned usage of the Lucas Estate as a commercial event space is having on all the homes in its vicinity. A major challenge continues to be enforcement of the rulings, regulations, and laws. Regardless of your decision that the Lucas Estate cannot continue in the manner that they have been, the Carmel PD has not an acted upon your instructions. Despite the number of times we have called to report noise violations, and despite the frequency with which the Lucas Estate has had events already this year, no fines or violations have been brought against Lucas Estate by law enforcement. This may be due to the fact that the Lucas Estate hires off -duty members of the Carmel PD to work the events on their property. As such we feel that the Carmel PD off - duty officers have a conflict of interest. We also only recently discovered in conversations with the on - duty officers who are sent to respond to our calls that they are unaware of the zoning ordinances. Even more disturbing was when we learned that the officers were hosted at the Lucas Estate for a luncheon, and they were under the impression that the Lucas Estate is a legitimate commercial venue and not a residence. Keeping that in mind, we contacted the Carmel Law Department to obtain records of Conflict of Interest documents that members of the CPD must submit to work off -duty at Lucas Estate. However, the Carmel Law Department has responded that no such documents have been filed by CPD officers, We also requested documents of outdoor special event permit(s) that the Lucas Estate should have filed for events occurring on the property, both for past, current and future events, as it's required by law and instructed by DoCS. The Carmel Law Department has also responded that no such documents have been filed by Lucas, even though it's required. For your convenience, included with this submission are those responses from the Carmel Law Department. In addition to those copies, for your convenience, I have assembled a myriad of documents showing the true nature of the events at the Lucas Estate. However, the Lucas Estate Facebook site, as well as a myriad of other websites, show the Lucas Estate's true function: a commercial for -profit event venue that hosts weddings, birthdays, concerts, and not -for -profits .... FOR A PRICE!!!! fl These websites include contact information, instructions on how to book, how much Lucas charges for corporate and wedding events as well as property etc. o Included are samples of websites, including the Lucas Estate's Facebook page, referenced above. Some of the local event planners even go as far as to say that they can facilitate the Lucas Estate as a venue for your event. a The fact is that if you or I host an event at our own homes, we greet our guests personally, we spend time with our guests personally, we say good bye to our guests personally, and, we provide them food and drink, and we DON'T CHARGE THEM!!! Lucas Estate Event Staff information o Again, the wonderful thing about the internet is that one only has to click around and find the truth. There appear to be three staff members of the Lucas Estate who function as liaisons for events at the Lucas Estate. Some may also serve as fronts for event - related charges. It may very well be possible that Lucas himself does not charge for use of the property, for some non-profit events, but he does indeed charge for catering, via various Lucas -related entities and staff. o Again all this information is available on google, I've just done some of the legwork for you. • Lucas Estate Events examples of Commerce o The other thing that is very clear and obvious when examining the websites of events held at the Lucas Estate: Lucas charges for use of the venue as they are always listed as a vendor location or event space. And, furthermore, it is clear that Lucas Estate uses several catering shell companies such as: Morgan Lucas Racing Catering, Lucas Estate Catering, Anthony Puma Lucas Oil Catering, Lucas Catering, etc_ This is true regardless of the type of event. Weddings, Engagement Parties, Bar/Bat Mitzvahs, Birthdays, Corporate Events, as well as "not- for -profit" events such as "Concert for Cause" held at the Lucas Estate a few weeks ago. ■ for example, the April 7th event for this non-profit claims it raised $19,000, but wait . _ . they sold 300 tickets at $75 ("which includes a "free" drink")_ With that, they collected $22,500 dollars based on ticket sales. However, the question you have to ask yourselves is: if they collected $22,500 and the staff volunteers, and the artist volunteers, and the "drinks are free", and the event venue is free ... where did the reaming $4,500 go? That's the difference between $22,500 that was "collected" and $18,000 that was "raised". o Mr. Lazzara noted in his letter to the BZA under section 4 and 5: "regardless of "free" drinks, alcohol commerce is being conducted on a residential property." Mr. Lazzara is also absolutely correct in his conclusion that "effective monitoring of Lucas is not possible." o Included are just a few clear examples found on websites of events hosted at Lucas Estate that include variations of names used as catering vendors. They are all clearly Lucas shell business names, already listed above. Lucas Estate Events examples of misuse of zoning ordinance and noise regulations o What is most disturbing is that Mr. Lucas continues to have events at his residential property regardless of Carmel's ruling. furthermore, these events have begun to erode the trust of the community and in the Carmel PD, which is not enforcing the rules. o Mr. Lucas hires Carmel Police Officers to work the events while they are off -duty. In doing so, when calls are made to Carmel PD to complain about noise, nuisance, drunk drivers, etc. these off -duty officers "communicate" with the on -duty officers. And, as a result, the events are never stopped, violations are never issued, etc. What always happens is that the on -duty officers comes to investigate the complaint, he communicates that he is with the 10-17 (code for meeting with the complainant), the music is lowered for 10 minutes while the officer is in the Queens Manor neighborhood, and, as soon as the officer leaves the music is back on at full blast, requiring a 2nd call to Carmel PD. c Furthermore, when the Carmel PD are called regarding the noise complaints, we have reminded them to bring a dB meter. When they do, measurements of the noise levels have been taken — proving that the noise levels exceed the maximum allowed according to Carmel's regulations. However, not only that, the dB measurements are taken from distances far greater than the 50 feet specified in the ordinance. This proves that the noise levels are significantly greater, and more disruptive, than should be endured. In addition, a reminder that since April 2018 to June 17, 2018 (three days ago) there have been 11 events within that short time -frame that the Queens Manor residents have witnessed and heard. ■ Four of these events (i.e. 40% of the events so far this year) resulted in Queens Manor residents making calls to Carmel PD for noise and nuisance. There was a breeze blowing and I believe the sound being recorded was the noise from that breeze blowing over the sensor. Since May there has been at least 11 events most in violation of the noise ordinance. The police are called however, the Carmel police are also at the Lucas residence doing security. This seems to be a conflict since the police who come to the adjoining neighbors never want to help us enforce the noise. I would think the BZA would be offended that they have made a ruling that Mr Lucas is ignoring. No fine will really solve the problem as Mr Lucas will just take the money and pay the fine from the profit he makes off of the events. If you check his books many believe he takes money to cover his grounds and maintenance cost off the top, giving the remaining to the charity. So is this really giving to charity when you profit personally? Please note Mr Lucas is totally aware of what he is doing and if you look at the attached page..Mr Lucas actually advertises his home as a "CONCERT VENUE". Please help the BZA to not look like a committee that can not enforce someone to obey their ruling after it has been made. Everyone is able to have a party at their home, but most don't charge for the food when you come and most are attending their own parties. Mr Lucas is not at most parties, instead, his event planner attends for him. Beyond the noise we have over 1,000 people at times turned out on 1161h street or Ditch road. Most have been drinking. I do not believe that the request satisfactorily fulfills any Standards set forth by the BZA. I will address only two of those standards in this letter. While I am not an adjacent neighbor, I hear the noise, music and amplified voices from both venues — the "party barn" and outside venue -- which host events on the Lucas estate. This has happened after 10:00 pm and I have repeatedly visited the estate and requested that the music be turned down. At a graduation party event I witnessed kids walking around the grounds, standing next to Ditch Rd. and cars dropping kids off at the driveway along Ditch Rd. while other cars were backed up on Ditch Rd. Hosting events where hundreds of cars are exiting onto streets in a concentrated residential area is not good for the public health and safety of local residents. Our community has 5-12 acre parcels for the purpose of providing privacy and solitude. Property values will fall once our neighborhood is tagged with the stigma of being forced to listen to unwelcomed music. While only 5 properties are adjacent to the Lucas estate, all community properties suffer from the stigma. Our community has only two lots which have not developed, one is close and the other adjacent to the Lucas estate. Is it any wonder that the lot next to the estate has been for sale for years? Would you buy a house or land in a neighborhood with such a reputation? I believe the change of variance will adversely affect the property values of our neighborhood. Also, that since the Party Barn can no longer be used for events, the event spaces have just shifted to elsewhere on the property. The June 2018 letter from adjacent Queen's Manor HOA President, Dr. Sima Sciopu, describing and illustrating what the neighbors have had to put up with, and still do, brings the point home. The 6/1/18 letter from Charles Lazzara was enlightening about how the Lucas events for "Not for Profits" game is played, and still involves commercial activity. We agree that "Carmel should not allow Not for Profit events unless Lucas covers ALL costs, not just some such as the facility." We also agree that "Effective monitoring of Lucas is not possible" (6/1/18), and that "sound is an unmanageable fact" of an event business (8/29/17). Director's Letter in response (5/18/18) to Lucas' Appeal Letter: * This seems vague, with "no teeth", and few meaningful or effective requirements/restrictions. * This letter essentially results in the Lucas Estate being able to do what it was mostly doing before (large charity/Not-for-profit events), except for the BZA's denial of event use of the "Party Barn". It provides no meaningful restrictions, protections, or realistic enforcement for the neighbors. * What does the City intend to do about the Lucases ignoring the City's decisions? (e.g., No commercial activity, filing a permit for each event, no advertising for events.) * The Director's response letter requests only that the Lucases clarify in writing the following, in order to result in the amendment or withdrawal of the Director's Determination Letter: (Our comments in parentheses and italics.) Intention to use the Lucas Estate property for soley residential purposes. (Not defined or realistically verifiable.) Social media and internet advertising of the property as a venue for weddings and other events will cease. (No mention of the Lucas vans with advertising on their sides. "That Outdoor Special Events at the Property which the Lucases desire to sponsor and host will not charge fees, surcharges, or other forms of payment for use of the Property." (Very difficult to verify. ) "That Outdoor Special Events at the Property will be limited to private events for friends and relatives of the Lucases, except for Events for the benefit of non-profit organizations or political or charitable causes sponsored and hosted by the Lucases." ("Non -Profit" or "charitable" does not necessarily mean non-commercial use. What does "sponsor and host" entail? All of this would be very difficult to verify.) The frequency and duration of Outdoor Special Events will not be a detriment or nuisance to adjacent residential property. (It has been and still is a nuisance, but is probably not going to change unless the City imposes some limits. How to obtain enforcement is confusing.) That an Outdoor Special Event - Temporary Use Permit will be obtained for each event. (For what purpose? Meant for approval or denial? By whom? Based on what criteria? Should this have to apply to everyone? ) The Events will comply with Carmel's noise ordinance, and other City provisions pertaining to public nuisance. (Neighbors have said that noise and nuisance complaints regarding Lucas events are not being adequately enforced.) uestions• * Is the Lucas Catering establishment not considered to be a commercial use if it is moved off -site, but is still used for their events? * Specifically, what does requiring the Lucases to "sponsor and host" their events actually mean? Should they be required to be onsite for each event? * What really separates an indoor event from an outdoor event? Seems like people would be moving in and out of a house or yard for both. Should indoor and outdoor events be treated the same? * If Lucas must file a permit for each event, then they could claim that the requirement should apply to every resident holding a typical celebration gathering. Should filing for a permit depend on the size of an event? * Does a "Party Hall" include event tents and pavilions? Sumestions and Requests: * It is problematic that the City did not enforce the S-1 Residential zoning from the start, knowing that commercial uses are not permitted on residential property. (Neither are "private parking areas", like Lucas' 420 parking spaces.) We request consistent and firm enforcement from this point forward. * Definitions: Vague or missing definitions remain a problem. The City can and needs to promptly fix this, by reviewing all definitions, or lack thereof, that could apply to Special Events in residential areas. There is no definition for "private surface parking area" or for "Short-term outdoor special event." The definition of "Special event, outdoor" needs to be made more specific about use and intent. Clarify what constitutes a "temporary use", and "commercial use" versus "residential use." * All advertising as an event venue should cease, including the Lucas Estate vans. * The Use Variance "Commitments" limitations became void when the Variance was denied. The City could have still applied some of those voided Commitments' restrictions to the Lucas Estate and to all S-1 residents' Special Events. The Lucas intense events should, at a minimum, have limits on frequency and hours of operation. So as to 2 not single them out, such reasonable restrictions could be applied to everyone who holds temporary, outdoor special events in zoned residential areas. That would not be much different than other activities that the City regulates for the benefit of all. * Since the burden of obtaining enforcement has been placed on the neighbors, the City needs to give them a clear and effective process to follow for where to report violations, how to ensure a trackable record of their complaints, and how to obtain and verify enforcement actions. * The "big picture" is that how the City handles the Lucas events issues will carry over to what other estate owners will then expect to be allowed to do in residential zoned areas. We urge the City to do what it takes, now, to get this right. conclusion. - Thank you for denying the Lucas Estate's Use Variance request, and trying to protect the surrounding residents from the disruptive and frustrating effects of nearby commercial events activity. Another reason to deny the petition and to enforce the zoning regulations is that so many neighbors are being denied the peaceful enjoyment of their homes by the business activities being carried on at the Lucas Estate. The Lucas Estate continues to function as an "unofficial' business while masquerading as a private residence Zoned S1 residential community. Since April 2018, there have been more than 15 events at the property, several of which were outdoor and required Carmel Police intervention. The Lucas Estate continues to staff an event coordinator and to provide on -site catering. They provide the organizers of the events with a menu book that is color -bound and approximately 40 pages long. But, they declare their activities to be "not a commercial enterprise"? Yet, how can you call their usage of the property as a "home"? Does your HOME come with a 40-page catering menu, with laid out prices for food, beverages, and bartender fees? Also, the Lucas Estate is said to charge a minimum of $10,000 per event "which can be waived at their discretion". There are dozens of websites promoting the availability to book the Lucas Estate for your event, some of which include pricing. There are also dozens of websites which show weddings and other functions that were held on the property, and they list the Lucas Estate and various Lucas Catering enterprises as vendors for the events. Additionally, even though the Lucas Estate website is currently "down for maintenance" it tells us to "check back soon". And, their Facebook site continues to function and advertise its self as a "Performance & Event Venue", including contact information and contact phone numbers to schedule an event. Furthermore, many of the events held at the Lucas Estate since April 2018 have required the Carmel Police Department to intervene due to noise. Each of these outdoor events exceeded the allowed noise decibel levels, no matter the time of day when these events occurred. There are clear conflicts of interest with regard to the Carmel PD officers who work at the estate, as well. Please let me outline. A typical event scenario is this: • 2:00 pm — 5:00 pm: lots of movement of cars and people is noticed at the Lucas Estate, including occasional intermittent short sound checks. Music is already audible. 0 5:00 pm — 6:00 pm: dozens of cars start to drive through our Queens Manor Neighborhood incorrectly looking for the entrance to the Lucas Estate, which is not within our neighborhood. • 5:30 pm: music becomes audible. • 6:00 pm to 8:00 pm: music becomes increasingly louder and becomes a nuisance as it registers from 60 dB to as high as 90 dB from as far as 3,000 feet (YES 3,000 feet - AWAY from the Lucas Estate — clear across Queens Way Circle and Royal Drive). • Between 7:00 pm — 9:00 pm: one or more of the residents of our neighborhood call the Carmel PD to complain. • Between 7:30 pm — 9:30 pm: the music is "magically" lowered and in a few minutes after the music is lowered, the Carmel PD arrives. The Carmel PD takes a dB measurement which is 55bd — 65Db. However, the measurement is not taken from a distance of 50 feet, as the ordinance requires, but instead is taken from the property of the resident who complained. In several cases, the resident's property is more than 1,000 feet from the source, and the dB level still exceeds the Carmel noise ordinances. • 9:45 pm: the Carmel PD officer leaves, and then minutes later, the music from the event at the Lucas Estate is again at full blast. • 10:15 pm: second call is made to the Carmel PD. • 10:45 pm: the music is "magically" lowered again, but this time the crowd of people, and the noise they make shouting and talking can't be lowered. As such, the yelling and singing can clearly be audible when the Carmel PD arrives. The officer chats with the neighbor who called, maybe takes a reading again from a distance (again) greater than the 50 feet as required by the noise ordinance (which again exceeds the limit), and tells the neighbor they can't do anything about the noise made by humans and leaves. 11:00 pm —11:30 pm: the event is over, and so now starts the parking lot drama. Hundreds of cars are started and moved about the Lucas Estate along the fence bordering the properties in Queens Manor, as they are driving out towards the exit on to Ditch Road. Because there is no lighting, the cars drive with their high beam lights on. And, in some cases, there are additionally now dozens of UBER and LYFT drivers that drive through Queens Manor at this late hour (when I walk my dog before we go to sleep for the night) looking for the Lucas Estate entrance (which again, does not exist from our neighborhood). (It's a good thing I have a collar that lights up for my dog to be extra careful of the unexpected cars driving around our quiet neighborhood at that hour). 11:00 pm —1:00 am: stadium style reflector lights are turned on at the Lucas Estate property. Dozens of people can be seen roaming the property. Talking can be heard. The breaking down and dragging of tables and chairs can be heard. The clanking of dishes and glass bottles can be heard. Commercial truck diesel engines can be heard running, as well. 1:30 am: clean-up and breakdown activity subsides and lights are turned off. Please deny the variances the Lucas Estate has requested, and allow this residential neighborhood to remain, in every way, as a beautiful and peaceful residential neighborhood, as the Carmel Comprehensive Plan intended. We have been wondering why there has been no updated information available to the public on the Lucas Estate Appeal Laser fiche file during the past several months of behind -the -scenes Lucas/City of Carmel negotiations. We appreciate Joe Shestak sending us a packet of new information from the Lucas attorney just a short time ago. We have not had a chance to read and process it yet, so we are not able to respond to it specifically at this time. However we were already finishing up the email below, so are sending this email to you for now. It is our understanding that any public emails sent after today will not be sent directly to you, but you will be able to look at them in the Lucas Estate Appeal Laser fiche file. Please keep checking, because this new packet of information came out too late for members of the public to be able to respond today. The public has already emailed plenty of evidence that: * The Lucas Estate is still operating as a BZA-denied commercial Special Events Venue. This includes so-called "not -for -profit" events, which Charles Lazzara of the Ritz Charles has stated (6/l/18 email) still involve commercial activity. (We certainly hope that no one believes the Lucas attorney's statement in the 7/17/18 WISH article that "it is not a commercial venue. Period.") * Even if the charity events were totally "free", the size/intensity/frequency of those gatherings, the effects on the neighbors, and the precedents set would go way above and beyond what any typical homeowner in a residential -zoned area would do or be allowed to do, especially on a regular basis. * It would not be an acceptable or effective "solution" to allow the residential Lucas Estate to continue operating as a party/event venue for large fundraising events (the majority of its events), but just less frequently. The detrimental effects on neighbors, and the open door for other estates to do the same would be unchanged. We add the following points for consideration: 1) The Lucas Estate events violate City Code, Chapter 6 (Public Health & Safety), Article 5 (Public Nuisances): [Especially the excess crowds, noise, light, and traffic; prevention of peaceful enjoyment of property; and drunk attendees and drivers. Neighbors called in noise and nuisance complaints for many Lucas events, sometimes multiple times per event. The police records indicate that these violations and complaints have generally not been taken very seriously, and no citations or fines resulted. Fortunately, just last night (7/17/18), a noise complaint made during a Lucas Estate GOP fundraising event resulted in some enforcement: shutting down the outside music at 9:30 p.m. because it was violating the Noise Ordinance regulations.] * 6-75 Public Nuisances Prohibited. (a) "No person shall erect, contrive, cause, continue, maintain or permit to exist any public nuisance within the City." * 6-76 Public Nuisances Defined. "A public nuisance is a thing, act, occupation, condition or use of property which shall continue for such length of time as to: (a) Substantially annoy, injure or endanger the comfort, health, repose or safety of the public; or (b) In any way render the public insecure in life or in the use of property; or (d) Unlawfully and substantially interfere with, obstruct or tend to obstruct or render dangerous for passage any street ... or other public way; or (e) Is ... offensive to the senses, or an obstruction to the full use of property, so as essentially to interfere with the comfortable enjoyment of life or property." * 6-79 Public Nuisances Affecting Peace and Safety., Additional conditions "declared to be public nuisances", include "All loud and discordant noises or vibrations of any kind, except as may be permitted under a zoning ordinance." 2) Precedent: Whatever the City decides to allow regarding the Lucas Estate's events, will surely be cited as a precedent for allowing the same accommodations for other estates and properties in residential -zoned areas. This could be especially damaging to established homeowners in West Carmel. * Scott Jones Estate: Would the City backtrack and allow non-residential use? Another venue for "not -for -profit" events? * Asherwood (formerly Simon) Estate: Is this estate already operating as a museum and events venue, neither of which is a permitted use in residential -zoned districts? The Actors Theatre of Indiana recently mailed out an advertisement for their "Annual Gala Fundraising Event" at the Asherwood Estate in March 2019. To our knowledge, the City has been silent about the use of this estate. * University High School: According to the 6/19/18 Current in Carmel newspaper, University High School has created a master plan that would include a public outdoor amphitheater (as soon as this fall) to be used for "community events, plays, musicals, concerts, and other gatherings." This type of public, noisy, large, frequent, non- residential "event" use is much like what the neighbors of the Lucas Estate are complaining about. Is the City going to allow this type of use to keep causing controversy with its S-1 zoned residential neighbors? Conclusion: We strongly urge the prompt amendment of the definition of "Special event, outdoor" to specify the intended type of use in residential districts, and the addition of a definition for "Special Events Venue" in order to differentiate between the two types of uses and where they would be permitted. Otherwise, we believe that the Lucas Estate issues will keep occurring. No one wants partying next to their home on a regular basis, especially not by hundreds of people. Homeowners who move to a residential area never expect to be next to a party venue. That's why we have zoning. No residential -zoned homeowner, irrespective of property size, should be allowed to routinely hold intense events that negatively affect their neighbors. We ask City officials to enforce the S-1 Residential zoning, and to not allow the Lucas Estate to function as a Special Events Venue/Meeting or Party Hall in a residential area. Whether events are labelled for -profit or not -for - profit, the effects on the neighbors and on West Carmel are the same for such intense events. Sincerely, Jill H. Also, let me know you received this. Thank you. Mr. Hollibaugh, I want to correct some of Mr. Wukmer's more important errors in his April 5 and May 29, 2018 letters to you. On page 1 of the April letter, "Historical Recap," he says "The (Hilbert) property ... was used extensively for public functions and private parties." We have no problem with Lucas using the property in the same way Mr. Hilbert did. The difference is many of Hilbert's functions were within the mansion and not outdoors and/or gym as Lucas does. Additionally, all of Irsay's functions were indoor. Hilbert's outdoor functions were few and far between, estimate up to five per year, rarely audible. Queens Manor residents and the Hilbert's lived side by side for all the years of his residence without issue. Lucas' use of the property changed that. Neither Hilbert or Irsay had an event staff and catering business to support the events they hosted, directly or indirectly. In the same paragraph above noted, there is a statement that Lucas's didn't receive any complaints. Mr. Wukmer forgets the many times Carmel Police "on duty" officers stopped by or called Lucas to tell/warn the "off -duty" CPD officers regarding the neighbors noise complaints, yet chose to not cite Lucas, we think because their fellow or senior officers were working for Lucas. Subsequent to my June 19 letter to the BZA (Letter #11) on police enforcement, we met with CPD Chief Barlow regarding the potential conflicts of interest of off -duty and on -duty officers caused by Lucas paying the off -duty officers for security services. Chief Barlow has since barred CPD off -duty work at Lucas and equipped his staff with new sound measuring devices. Last week, a responding officer agreed that the sound level was in violation. He was putting it in his report; we did not ask for a citation; he was going to Lucas, we think, to give a final warning. It will be in his report. I note too that paragraph E of the May 29 letter on CPD compliance with noise levels is mistaken and only shows the former conflict that allowed Lucas to avoid enforcement. In the same paragraph, you will see that Lucas suggests "harassment" from my neighbor's calls. The neighbor is our HOA President who received calls from others in our neighborhood who asked him to make calls on their behalf in many instances. Some of the police reports will show they met with the officers when they arrived on the scene. Additionally, others have made calls apart from our HOA President, for example, my June 19 letter shows copies of CPD records for some of the calls made by me. We thank Chief Barlow for his clear solution that better enforces the law. Lucas self -policing does not work as they appear to act as if they are above the law. Enforcement of the Department's rulings will need to address all aspects of Lucas because it is a business, not anything like Irsay and Hilbert events which helped the not for profit community without disturbing the neighborhood community. My concern is two items. • The Department of Community Services has not requested or allowed any input to the mediation from the affected neighbors. This includes those from the Queens Manor and Crooked Stick HOA's, who after being invited to the mediation, were not allowed to attend, nor provide any input. • The last document we have seen from the Department is the July 17, 2018 letter which included a "Draft Statement of Comments" to serve as a template for an agreement. L N wxl %, A r w. .r ♦ ♦ • r ws +eE s ,�.. a r ±Sr • r r While I understand it is a draft based on an earlier Lucas proposal, it appears from the Department's editing that the Department was countering the Lucas proposal of 90dB limit with 80dB, and further struck the last Lucas drafted sentence that limited the sound level to 60dB at the property boundary, which striking effectively says "no limit." 80d6 is the same sound level as a freight train or diesel truck at 50 ft. The Department is mistaken to think 80dB at about 50 feet (to the boundary) is lower than 60dB. As you know, the City's ordinance on sound in an S-1 is 55dB before 10 PM and 50dB after. Lucas claims he wants no more than his S-1 neighbor— he should also be restricted the same. The 50/55 should not be compromised. Thank you.
