COMMERCIAL COMMITTEE
Tuesday, December 3, 2019 Meeting

The Commercial Committee met to consider the following items:

2. Docket No. 18070013 ADLS Amend:Pennwood Professional Park-Revision
The applicant seeks site plan and design approval to modify a previously approved building from 3 stories to 2
stories.The site is located at approximately 11505 N. Pennsylvania Street and is about 3.76 acres in size. It is zoned
B-5/Business and is located within the West Homeplace Commercial Corridor, High Intensity Overlay Zone. Filed
by Kevin Buchheit of Krieg Devault on behalf of the owner, SCB Home Office, LLC.
Petitioners: Kevin Buchheit:
• This is not a new site,but a slight modification since 2018. Reduced from 3 stories to 2.This resulted in a
decrease in parking footprint.
• I did not include side by side copies of the 2018 approval and the current request.
• Kevin passed around a document titled Site Plans Old and New(Committee handout 12-03-19).
• The Submitted Packet(Packet for COM 12-03-19)contains the amended site plan,amended landscape plan
reflecting initial comments from the Urban Forrester,revised building elevations under tab 3 (pages 7-8),
and revised building perspectives under tab 4(pages 9-10).
• There are a few items not before you tonight, but they are relatively minor. The items the Department of
Community Services(Staff) identified,we have no issue with complying with.
• The first is the vehicular access to Washington Blvd. I do not believe we planned full access onto
Washington Blvd.,but I seem to remember a possible comment for the Cannel Fire Department(CFD)for
an alternate access to the site because this is essentially because it is a large cul-de-sac.This might be an
emergency access. If this is the case, if Staff determines we need a variance then we will comply.Rachel
Keesling: In the approved site plan from last year one can see a grey hatched area near Washington Blvd.,
but there is no label there. When researching the area I asked if this was the emergency access. Kevin
Buchheit: There is a label that reads"15' Drainage&Access Easement."Rachel Keesling: But it is more
than 15'.Kevin Buchheit: it looks like it is.Rachel Keesling: I don't think that[label] is correct.That may
refer some of the other lines on the site plan.Kevin Buchheit: You are correct.
• Bike parking will be added to the site.On earlier iterations it was near the north access point,but it may be
best placed to the west of the sidewalk at the north entrance.
• Dumpster design; we did not have it submitted in the previous petition. I spoke with the project architecture
and he confirmed the materials will be compatible with the building skin.
• Site lighting details. It is in the process. I managed to compile all the CAD files,but they are just not

finished. I believe the same lighting fixtures from last year will be used.The poles are not 25' but shorter.
• At the previous petition we were able to achieve the 0 foot-candle at the property line. I am certain we will
achieve that again. Light Source is the consultant on that.
• I spoke briefly about the landscape plan. I believe the plans in the Submitted Packet will be approved by th
Urban Forester, as they incorporate comments from him.
• We are seeking approval with the conditions Staff has outlined.
Department Report: Rachel Keesling:
• While we don't like to see buildings decrease in size,there is no three story minimum requirement.After
approval the tenant believed two stories would better fit their needs and occupying the building after
examining the amount of available office space in the area.The owner would occupy the building?Kevin
Buchheit: Yes.Rachel Keesling: They would have to lease out the rest of it.
• This is a re-review because the original review never really finished.
• The engineering of the site was still under review.There is a new engineer who believes the pond does not
need to be as large [as the previous engineer thought].They pushed the building away from the pond. Kevin
Buchheit: The project engineer believes the capacity of the existing pond is more than enough to
accommodate the site. We have all the calculation into the Carmel Engineering Department.
• The amount of pavement is being reduced because the building square footage is shrinking requiring less
parking.
• The previous variances remain applicable.The primary change under review is that the building is shrinking
from three to two stories.
• The outstanding items are: the vehicular entrance from Washington Blvd. will need to be resolved. It is not
allowed without a variance. If they had some kind of CFD access then Staff might be okay with it. It cannot
be a full cut/main access entrance.Kevin Buchheit: We do not want that.Rachel Keesling: They are
willing to not have a full cut. For the other items,with a little bit more time I can approve the items
administratively. They are simple including updating the site lighting plan,providing a dumpster enclosure,
updating landscaping,and adding bike parking to the site plan.
Committee Comments:
Alan Potasnik:
• I saw bike parking on the site plan.Rachel Keesling: On the old one.Alan Potasnik: It won't be in the
same place?Kevin Buchheit: We have not determined this. I'm guessing in the area just to the north of the
west entrance.Rachel Keesling: It has to be within 50' of the main entrance.Kevin Buchheit: Actually, if
you look at the landscape plan you can see the bike racks,just to the east of the north entrance.
• I can't see where approval upon these conditions is a problem. The petitioner touched on the lighting,
dumpster enclosure,and Washington Blvd. access easement.
• It seems like an attractive building.
Laura Campbell:
• Please explain the reasoning for reducing the pond,than previously planned.Kevin Buchheit: When there
is a new engineer there might be a different thought process. The new engineer determined that the existing
capacity of the pond would accommodate the reduced footprint of the impervious surface.Those two things
together caused that need. If through the Cannel Engineering Department review,the pond needs to be
enlarged then we will certainly proceed as required.
Joshua Kirsh:
• This is not the US 31 corridor?Rachel Keesling: It is outside.Joshua Kirsh: I just hate that three stories
were agreed upon and it is now being reduced.
• I do now see the bike parking on the plans.It seems to me that having two bike racks near the north and
south entrance makes more sense than having four racks near the north entrance. [My vote is not dependent
on this issue.] Kevin Buchheit: The floor plan is not greatly changed from the 2018 approval. There is a
sort of spine public area on the first floor between the two entry points.Joshua Kirsh: Bikers are likely to
enter the site and then head to the south entrance.

• Councilman Anthony Green may have some interest in discussing the storm water. For the adjoining
neighborhood(Northern Heights Subdivision)water flows towards them. I suggest having a discussion with
the Cannel Engineering Department. Councilman Green and I have discussed sharing some expense from a
city perspective to alleviate some of the flooding that is occurring on Washington Blvd. Is there an
opportunity to cost share or look at storm water more critically.
• With regards to the access point off of Washington Blvd., it seems like the residents may feel this is a bait
and switch since during the public hearing process there was no access. Having a finished access point for
CFD with a knock box should be fine.Alan Potasnik: I think the petitioner is committing to none. Kevin
Buchheit: I think the inclusion is part of the transition between project engineers.
• I like the shrinking of parking spaces.
John Adams:
• If I am entering the site off of Pennsylvania St., I will go off of the existing drive and to enter the parking
lot.Are you sure you have enough room in the drive aisle for cars to pass without hitting each other or
parked cars?Have you looked at your impact on the Police&Fireman's Insurance Association building to
the north?Kevin Buchheit: The 25 ft. width is compliant for a parking lot drive aisle. I am not sure the
width of the easement across the property,but will find that out.25' should accommodate traffic.Rachel
Keesling: That is the standard width. Rachel Keesling: The proposal shouldn't have any impact on the
Police&Fireman's Insurance Association building and their access.
Joshua Kirsh:
• What is the recommendation?Rachel Keesling: Approval subject to finalizing the five outstanding items
with Staff.John Adams: Do we have authority here to approve it?Rachel Keesling: Yes.
Joshua motions to approve Docket#18070013 with the conditions that landscaping,dumpster enclosure,lighting
an,Washing Boulevard access easement,and bike plan are handled administratively.John seconds.4-0.I .

Laura Campbell:This is my last Commercial Committee meeting.My term as a Plan Commission member is up.John
Adams: This is also my last Commercial Committee meeting. My term expires at the end of the year and I am stepping aside
for others to take my place. I have enjoyed working with all of you. I will miss it,but it is time to let younger people serve.
