Special Use: Place of worship FINDINGS OF FACT—SPECIAL USE 1. The premises in question is particularly physically suitable for the proposed Special Use because: The premises is relatively level, of regular configuration, and provides adequate size and area to construct the proposed structure, to provide the required parking and to allow for an extensive landscape bufferyard on the property line adjacent to the residences. The site is also located adjacent to two thoroughfares capable of accommodating anticipated traffic generation and is already served by utility and public safety services. This Special Use application includes the 9.73- acre North parcel, which allows for site design flexibility to increase distance between proposed site improvements and the adjoining residential uses as well as the 5.05-acre south parcel previously approved as a special use under Docket 17120001 SU. 2. The Special Use will not injuriously or adversely affect economic factors, such as cost/benefit to the community and its anticipated effect on surrounding property values because: Special Uses to establish places of worship are generally to be considered favorably by the Board of Zoning Appeals. This site is like the many other sites where churches and places of worship are located in the City of Carmel without any depreciation in property values. Additionally, the Board, at its meeting on February, 26, 2018, approved a Special Use application (place of worship)for the South parcel, which approval included a commitment to file an application to expand the Special Use place of worship to include the North parcel. 3. The Special Use will be consistent with social/neighborhood factors, such as compatibility with existing uses and those permitted under current zoning in the vicinity of the premises under consideration and how the proposed Special Use will affect neighborhood integrity because: Special Uses to establish places of worship are generally to be considered favorably by the Board of Zoning Appeals. This site is like the many other sites where churches and places of worship are located in the City of Carmel without any depreciation in property values. This Special Use application includes the North parcel, as required by recorded commitment, which allows for site design changes to locate parking spaces farther away from adjoining residential uses. A fence has been erected and extensive landscaping has been added along the west site boundary (commitment to the south parcel) proximate to proposed site construction for the place of worship. 4. The Special Use will not injuriously or adversely affect the adequacy and availability of water, sewage and storm drainage facilities and police and fire protection because: All necessary utility service is available to the site, the storm water drainage system will be designed and constructed to conform with the standards of the City of Carmel, police and fire protection is already available to the site and the proposed use of the site will not negatively affect the provision of those services. 5. The Special Use will not adversely affect vehicular and pedestrian traffic in and around the premises upon which the Special Use is proposed because: As stated in the Traffic Impact Study, the Special Use will not adversely affect traffic in the area, and a multi-use path will be installed on the site to promote pedestrian traffic in the area.
