HomeMy WebLinkAboutD-2506-19 Amending Residency Requirement for City Police and Fire SPONSOR: Councilors Worrell and Carter ORDINANCE NO.D-2506-19 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,INDIANA, AMENDING SECTION 6-33 TO CHAPTER 6,ARTICLE 3 OF THE CARMEL CITY CODE Synopsis: Amending the residency requirement concerning members of the City's Police and Fire Departments. WHEREAS, the Common Council has previously established procedures concerning appointments and reappointments of members of the City's Police and Fire Departments; and WHEREAS, the State Legislature has recently amended the residency requirement concerning members of a city's police and fire departments,under Indiana Code Section 36-8-4-2; and WHEREAS, corresponding with the changes to Indiana law, the Common Council now desires to amend Carmel City Code Section 6-33(d)(3)to expand the residency requirement concerning members of the City's Police and Fire Departments. NOW,THEREFORE,BE IT ORDAINED,by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. The following subsection of Carmel City Code Section 6-33 is hereby amended to read as follows: § 6-33 Carmel Fire and Police Department Merit System. (d) Merit Selection; Procedures. (3) All persons appointed or re-appointed to the Fire or Police Department must establish their place of residence in accordance with Indiana Code Section 36-8-4-2(a), as the same may be amended from time to time,within twelve(12) months of their appointment or re-appointment. Section 3. The remaining provisions of Cannel City Code Sections 6-33 are not affected by this Ordinance and shall remain'in full force and effect. Section 4. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance, such repeal to have prospective effect only. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. If any portion of this Ordinance is for any reason declared to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 6.
