I’ve issued the Board of Zoning Appeals (BZA) Docket Number for this item. It is the following:
(V) Aria Apartments Ground Sign.
The applicant seeks the following development standards variance approval:
Docket No. PZ-2020-00032 V UDO Section 5.39.D Prohibited Signs, Off premise sign
requested.
The site is zoned B3/Business and US 421 - Michigan Road Overlay. It is located at approximately 10900 N.
Michigan Rd. Filed by Tim Ochs of Ice Miller LLP on behalf of Aria Land JV, LLC.

Filing Dates & Deadlines - Petitioner, please note the following:
1. This item does not need to be on any meeting agenda of the Technical Advisory Committee (TAC).
2. All Mailed, Posted, and Published Public Notice needs to occur by Friday, April 17 (but may occur
earlier).
Due to the site’s area zip code, the published notice (legal ad) is required within The Current in
Zionsville*; please contact them at least 11 days prior to that in order for them to publish it on time (317-
489-4444 ext. 5 or legals@youarecurrent.com.
The mailing of letters to adjoining property owners & placement of public hearing sign on the subject
property is also required by the BZA Rules of Procedure, Article VI, Section 6 (see Application and see
Calendar).
3. Make sure the public notice meeting time in the newspaper, on the sign, and in letters to neighbors read
5:15 PM and make sure the location on the legal ad/letters reads Virtual Meeting (and that the public can
contact the Planning Dept. for a web link to the meeting). The Location on the sign can just read Virtual
Meeting.
4. The Filing Fee and 1 digital copy of the BZA Info Packet must be delivered to BZA administrative
assistant Joe Shestak no later than Noon, Friday, April 17. (Failure to submit the Informational Packet by

this time will result in the automatic tabling of the petition.) The filing fee should be mailed to Joe (no
courier) or the fee can called in and paid via credit card (with a small processing fee). Failure to submit
Informational Packets by this time will result in the automatic tabling of the petition. Please include the
following in your Info Packets:
a) Short memo/letter introducing the project
b) Statement of Variance request (short paragraph explaining what you are asking for)
c) Statement of Support (short paragraph explaining reasons supporting the request, including analysis
and comparison of what is allowed vs. what is proposed)
d) Location Map
e) Reductions of all plans (site plan, aerial photo of site, signage design details, sign base landscape
plan, etc. on 8.5”x11” or 11”x17” paper).
f) Page 10 of app. – Ballot Sheet (leave blank except for Docket No. & Petitioner)
g) Page 11 of app. – Findings of Fact sheet (question sheet filled out, statements completed)
h) Any other pertinent information for the Board to explain this request (such as letters of support).
5. The Proof of Notice needs to be received by this Department no later than Noon, Wednesday, April 22.
Failure to submit Proof of Notice by this time will result in the tabling of the petition.
6. This item will appear on the Monday, April 27 agenda of the Board of Zoning Appeals hearing officer
meeting under Public Hearings, at 5:15 PM.
7. The petitioner needs to provide a Ballot Sheet and a fully filled-out Findings-of-Fact sheet for each
docket/petition the night of the meeting for the Board’s use (Sheet 11 of the application). On Ballot sheets,
only fill out docket number, petitioner, and date (Sheet 10).
8. Either the Petitioner or someone representing the Petitioner must be present at the meeting to present the
item to be heard. If no one appears, it will be tabled.
9. Please refer to your application’s instruction sheet for more detail.
Preliminary Review Comments - Petitioner, please respond in writing to the following by April 17:
a) Please make checks payable to City of Carmel.
b) Provide a copy of the Official List of Adjacent Property Owners from the Hamilton County Auditor’s
Office. (Make sure to check ‘Carmel BZA’ on their form.)
c) *The Current in Zionsville only prints on Tuesdays, and their filing deadline is usually 7 days prior to
their printing date. Please submit your Word file of the legal ad to them by Noon, Tuesday, April 7 so that
it prints on time. Their contact info is 317-489-4444 ext. 5 or legals@youarecurrent.com. (Use the Notice of
Public Hearing form in the Variance Application as a template for what to have published in the newspaper
and what to mail out to the neighbors.)
d) The mailings/notices to the neighbors should be done by first class mail with Certificate of Mailing (not
Certified Mail). (Please provide us with the certificate of mailings for the file on or before April 22.)
e) Please provide the filled out & notarized Placement of Public Notice Sign Placement Affidavit form
(found in Variance application) once the sign is placed.
f) Please provide the filled out & notarized Petitioner’s Affidavit of Notice of Public Hearing form (found in
Variance application).
g) Please provide the filled out Notice of the Public Hearing form/template (found in Variance application).
h) Please provide proof of notice, such as Publisher’s Affidavit from the newspaper, once you receive them.
i) Please make sure to list out the true practical difficulties and hardships associated with having to comply
with the zoning ordinance.

j) Additional review comments from the Planning/Zoning Department will be issued through ProjectDox,
our electronic plan review software.
