APRIL 13, 2020
(V) The Hamlet at Jackson’s Grant, Lot 10.
The applicant seeks the following development standards variance approval:
9. Docket No. PZ-2020-00004 V Silvara PUD Ordinance Z-553-11, Section 6.1 Minimum
6-ft side yard building setback required, crossing 4.8-ft over property line onto Lot 9 requested.
The site is located at 477 Simon Dr. and is zoned PUD/Planned Unit Development. Filed by John
McKenzie of McKenzie Homes.
General Info & Analysis:
The Petitioner purchased Lots 9 and 10 in the Hamlet and seeks variance approval to build a house 4.8 feet over
the shared side property line. The homebuyer would like a home that is slightly wider than what is allowed.

The Hamlet is a higher density neighborhood within Jackson’s Grant at Williams Creek. The homes have a 0 -ft
setback on one side, and a 6-ft setback on the other. A decorative garden brick wall spans the distance along the
street, where the homes have outdoor living areas, giving the look of homes close together and attached on both
sides.
The Petitioner had options to either replat the two lots into one, or to seek BZA approval to build over the side
property line. They chose the latter. As part of the variance request, the Dept. would like the petitioner to record
a commitment that they would not build a house on Lot 9. Especially since the remaining area to be built on,
after the house if built, would only be 30.7 feet wide. (The homeowner also needs to gain Architectural Review
Board approval from the Developer of the neighborhood.)
The Petitioner addressed all but one planning/zoning review comment, and the Planning Dept. supports this
variance request.

provide us with the copies of the certificate of mailings for the file).

Recommendation:
The Dept. of Community Services recommends positive consideration of Docket No. PZ-2020-00004 V, with
a commitment that no dwelling be built on Lot 9. (If approved, the Dept. needs copy of the recorded
commitments document within 30 days of the variance approval.)
