Joe Shestak Administrator Board of Zoning Appeals/Plan Commission City of Carmel Department of Community Services One Civic Square Carmel, IN 46032 Re: PZ-2020-00033 Dear Mr. Shestak, The Village of WestClay Owners Association, Inc. requests a variance to encroach a public right-of-way to install Village of WestClay entrance signs. It is the desire of residents of the Village and the Board of Directors to complete the Village Master Plan. When the Village was created in 2020, the master plan of the Village assumed every significant entrance to the Village would have an entrance plan. These entrance signs were approved in 1999 and 2020 per the master plan for the Village. For various reasons, this master signage plan was never completed. Based on resident feedback via annual meetings, surveys and emails, the Board of Directors desires to respond to resident requests and install the entrance signs. The signs are consistent with the other Village entrance signs and will be made by the same manufacturer. These signs will enhance the Village of WestClay and allow the Board to treat all sections of the Village with the same dignity and respect. FINDINGS OF FACT SHEET - DEVELOPMENT STANDARDS VARIANCE CARMEL ADVISORY BOARD OF ZONING APPEALS (Petitioner to fill out 1-3 + first two blanks) Docket No.: PZ-2020-00033 Petitioner: Village of WestClay Owners Association, Inc. 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The Entrance signs are consistent with the approved PUD Master Plan and will enhance the Village and serve as a positive impact on the property values. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The current property is Village Common area and is undeveloped. These entrance signs will enhance the Village and improve the landscaping. The signs will not be a negative impact on the community. If the Variance was denied, the signs would have to be place on private property and be located on individual owners property 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: If the strict application of the law was enforced, these signs would be prohibited in the right-of-way and thus the Village entrances would not be enhanced and the original vision of the Village could not be completed. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
