Petitioner seeks a variance from the provisions of Section 5.39(D)(3) of the UDO to
allow for an off premise ground sign that will be placed at the northwest corner of Weston Point
Road and Michigan Road. The ground sign will advertise only the apartment community located
on the parcel located adjacent to and west of the subject real estate. The subject real estate is
part of a larger parcel that is located in both Boone County and Hamilton County, Indiana. But
for the fact that apartments are being built on only the Boone County side of the larger parcel,
the variance would not be necessary. Moreover, the only access to the apartments is from
Michigan Road, so a sign is necessary to alert those members of the travelling public not familiar
with the apartments where to turn to gain access to the apartments.
