HomeMy WebLinkAboutExecutive order 2020-04 - Covid-19 - Temporary Closure of Monon Greenway V./11 Isms 71 - [\1V1LL JAMES BRAINARD, MAYOR Executive Order: 2020-04 WHEREAS, the City of Carmel, Indiana("Carmel") is in the midst of a public health emergency created by the spread of the COVID-19 virus; and WHEREAS, at least 645 Indiana residents have tested positive for the COVID-19 virus, including 40 in Hamilton County and 315 in surrounding counties, and WHEREAS, there is currently no known vaccination for the COVID-19 virus and it poses a present and serious health risk to Carmel residents; and WHEREAS, pursuant to I.C. §§ 10-14-3-1, et seq., and by Executive Order 20-02, Governor Holcomb declared a public health disaster emergency as a result of the COVID-19 virus; and WHEREAS, by Executive Order 20-08, Governor Holcomb ordered Indiana residents to: (I) stay healthy at home; (II) not gather in groups of more than ten(10) persons; and, (III) when outside the home, stay at least six(6)feet away from other non-family members; and WHEREAS, any person who knowingly, intentionally, or recklessly violates an Executive Order issued by the Governor commits a Class B misdemeanor(I.C. § 10-14-3-34); and WHEREAS, Indiana law requires local law enforcement authorities to enforce the Governor's Executive Orders(I.C. § 10-14-3-24); and WHEREAS, although most Carmel residents and guests are complying with the Governor's Executive Orders, a significant number of persons are still ignoring them by congregating in groups of more than ten (10) persons, and not practicing social distancing protocols, especially on and near certain portions of the Monon Greenway; and WHEREAS, Indiana Code §§ 10-14-3-17, 10-14-3-24, 10-14-3-29, 36-8-2-4, 36-8-2-5, and 36-4-5-3 authorize me, as the Mayor of the City of Carmel, Indiana, to take actions to protect public health and safety, to limit non-essential travel within the City, and to enforce the Governor's Executive Orders, and WHEREAS, it is now prudent and necessary to close the Monon Greenway from Gradle Drive to the south and Main Street to the north in order to protect public health and safety. NOW, THEREFORE, by and under the powers invested in me, as the Mayor of the City of Cannel, I hereby DECLARE AND ORDER that the Monon Greenway from Gradle Drive to the south and Main Street to the north be CLOSED. This ORDER shall be in effect from 10:30 AM on March 26, 2020 until further notice. This ORDER is executed n this 26 day of March, 2020.
