HomeMy WebLinkAboutFindings of Fact SheetFINDINGS OF FACT SHEET - DEVELOPMENT STANDARDS VARIANCE CARMEL ADVISORY BOARD OF ZONING APPEALS (Petitioner fills out 1-3 and first 2 blanks) Docket No.: PZ-2020-00043 V Petitioner: Onyx and East The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The lot width permits an orderly development plan with density and open space that is appropriate and will not negatively impact the surrounding community. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: Given the nature and 3-4 story design of townhome developments, the proposed 20'+ wide units create at least 2,000 8F of livable space with at least 2 bedrounis, which is desirable. -- Flats units will have at least 1,500 SF of livable space with at least 2 bedrooms. The overall development will positively affect the use and value of the area adjacent to the property. The strict application of the terms of the Unified Development Ordinance to the property will result in practical difficulties in the use of the property because: The zoning classification permits townhome development with a density consistent with the proposed from wall to wall as is required in the case of townhomes. The strict application of the 4,000 SF lot size will require units to exceed the largest anticipated unit size of 3,000 SF of livable space, which is not as desirable to the public as units with small lot size. The lot size requirement is not applicable to the design of the flats building. DECISION It is therefore the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
