The BZA Rules state that he has 5 days to file an appeal; is that 5 days or 5 business days? Please let me know. Thanks! “(b) A decision of a Hearing Officer may not be a basis for judicial review, but it may be appealed to the BZA. The BZA shall conduct a new hearing on the matter and shall not be bound by any findings of fact made by the Hearing Officer. A person who wishes to appeal a decision of the Hearing Officer must file the appeal with the BZA within five days after the decision is made, as provided in IC 36-7-4-924.” Angie Conn, AICP Planning Administrator Carmel Planning & Zoning Dept. 1 Shestak, Joe From:Conn, Angelina V Sent:Monday, June 8, 2020 11:52 AM To:Chavez, Nathan Cc:Shestak, Joe Subject:RE: Temp Use & Sign permit Follow Up Flag:Follow up Flag Status:Completed Nathan, thanks for writing him back about the sign permit status. He can do the Tropical Sno shaved ice stand, as long as he follows all the UDO regulations for a food stand. He is going to finalize the temp. use permit with Nick Mishler right now. He is also going to appeal the BZA-HO's decision to the full BZA, to try and get approval to store the food stand on the premises each night, rather than having to haul it away each night and bring it in each morning. I’ll make sure I take it off the premises each night. What do I need to do to finalize the sign and temp use permit? 1
