Dear Mr. Ochs:
At the virtual meeting held on Tuesday, May 26, 2020 the Carmel Board of Zoning Appeals took the following action regarding the
Special Use Amendment and Development Standards Variance requests filed by you for the property located at 55 4th Ave SE:
APPROVED with Conditions: The Special Use Amendment and Variances listed below were approved with the following Conditions:
a.) The Petitioner does not need to construct 4th Ave SE at this time; instead, they will contribute monies for what it costs to construct their
portion of the road into the Non-Reverting Thoroughfare Fund (either paying now, or committing to paying later, at a time when the
Carmel Engineering Dept. constructs 4th Ave SE all the way down to City Center Dr.)
b.) The pedestrian entrance on the southern elevation of the parking garage will include glass panels and window to the doorway, and the
pedestrian traffic redirected / accessible to this area.
c.) Addressing the remaining review comments of the Technical Advisory Committee.
1. Docket No. PZ-2020-00030 SUA UDO Section 2.09 Permitted Use, Institutional Special Use Expansion granted.
2. Docket No. PZ-2020-00042 V UDO Section 2.10 Maximum 35’ building height permitted, 51’ 9” granted.
3. Docket No. PZ-2020-00044 V UDO Section 2.10 Maximum 35% Lot Coverage allowed, 62.1% granted.
4. Docket No. PZ-2020-00045 V UDO Section 5.02.B Minimum 25’ Parking Garage setback behind library
building face as accessory structure along 4th Ave SE required, 0’ granted.
5. Docket No. PZ-2020-00046 V UDO Se ction 5.19.F Minimum 30’ landscape buffer along east/side property
line required, 5’ granted in some areas.
6. Docket No. PZ-2020-00047 V UDO Section 5.30 Minimum 511 parking spaces required, 407 granted.
7. Docket No. PZ-2020-00051 V UDO Section 1.07.E Transportation Plan Compliance, 90’ right of way Collector
Street required, 56’ ROW Residential Street granted for 4th Ave SW.
Please be advised that per Articles 9.09 and 9.15 of the Unified Development Ordinance, the aforementioned Special Use Amendment
and Development Standards Variance approvals are valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must have been received
and approval granted by this Department. The expiration date of the approval is May 26, 2023.
