Hollibaugh, Director L E T T E R of G R A N T May 28, 2020 Kevin Buchheit Krieg DeVault, LLP 12800 N Meridian St., #300 Carmel, IN 46032 Re: BZA Docket Nos. 20020006 UV, 20020007-09 V: Salsbery Brothers Landscaping Inc., Amendment Dear Mr. Buchheit: At the virtual meeting held on Tuesday, May 26, 2020 the Carmel Board of Zoning Appeals took the following action regarding the Use Variance Amendment (UV Amend) and Development Standards Variances (V) requests filed by you for the property located at 4317 E. 146th Street: APPROVED with Conditions: Salsbery Brothers Landscaping Inc., Amendment - 1. That a commitment is recorded by the Petitioner regarding timing and location of landscaping installation for the north half/section of the east bufferyard area (where a copy of the executed and recorded document is provided to the Planning Dept. in 30 days), and 2. That the Petitioner addresses the TAC - Technical Advisory Committee Members’ remaining review comments before building permit submittal. • Docket No. 20020006 UV: Non-permitted use, commercial landscape business expansion granted. • Docket No. 20020007 V: 30-ft wide East perimeter bufferyard required, 15-ft granted. • Docket No. 20020008 V: Paved/curbed parking lots required, No curbs in drive aisles granted. • Docket No. 20020009 V: Transportation Plan Compliance, 60-ft half right of way required, Keep existing 50-ft half granted. Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development Standards Variance approvals are valid for three (3) years and also per Article 9.15 of the Unified Development Ordinance, the aforementioned Use Variance approvals are valid for three (3) years. By that time, either continuous construction of the improvements must be underway, or a written request for a one-time, six-month extension of the approval must have been received and approval granted by this Department.
