The undersigned affirms that the information included in this Application is correct and acknowledges a final
inspection is required and does hereby authorize City Staff permission to make site inspections as may be
necessary. Further, if the Application is approved, the undersigned will comply with all the requirements of the
City of Carmel Unified Development Ordinance and certifies that the measures proposed to mitigate adverse
impact will be completed in a timely fashion. The contractor/property owner is responsible for properly locating
the property lines; locating pins or surveying property. Also, the contractor/property owner is responsible for
contacting Indiana831 to locate underground utilities, and for scheduling the required final inspection.
Please contact the Building and Code Services office at 317-571-2444 to schedule your final inspection.
If an inspection is not called in after completion, a late fee of $696.00 may be applied.

"Payment Terms: 25 % down with balance due upon completion.
"If Buyer cancels or rescinds this contract prior to ordering material, the performance of any work or the supplying of any material then Seller will refund down payment less a $75.00 service fee.
"Buyer guarantees that all the persons named as owners (or in a proper case, as contract purchasers) of the real estate on which the fence is to be erected have signed this contract for Seller. Buyer
shall clear all lines for construction of the fence and shall properly mark with stakes. Seller shall not be responsible for any encroachments over Buyer's property lines or into drainage and utility easements
and solely relies on the Buyer's instructions with regard to the location of said property.
"Bullseye Fence is not responsible for damage done to unmarked underground obstructions including, but not limited to: sprinkler systems, sump pump lines, drain pipes, septic systems, satellite lines,
auxiliary power to lights or buildings, pool or hot tub lines, etc.
"Seller will complete the job within ninety (90) days from the dale of contract, unless prevented from doing so by delays beyond Seller's control. If Seller is unable to complete the job within ninety (90)
days from date of contract because of delays caused by Buyer or Buyer's agents, contractors, or employees, the contract price shall be null and void and subject to renegotiation between the parties.
**Seller guarantees that the fence installed is of good workmanship in accordance with the specifications supplied or agreed to by Buyer and expressly guarantees the same against defects in material
and workmanship for a period of 24 months from completion date. Seller makes no other warranty, expressed or implied; and any implied warranty or merchantability of fitness for a particular purpose
which exceeds the foregoing warranty is hereby disclaimed by Seller and excluded from any agreement made by acceptance in a contract pursuant to this proposal. Seller will not be liable for any
consequential damages, loss, or expense arising in connection with the use of or inability to use its fence for any purpose whatever. Seller's maximum liability shall not in any case exceed the contract
price for goods claimed to be defective or unsuitable.

"A FINANCE CHARGE equal to FOUR PERCENT (4%) of the total owed will be added to the account SEVEN (7) days past due. Thereafter, a FINANCE charge of FOUR PERCENT (4%) per month
(21 % ANNUAL PERCENTAGE RATE) will be added and computed on the AVERAGE DAILY BALANCE due.
"Buyer responsible for obtaining all required county, city or neighborhood association permits and variances.
**Buyer agrees to be liable for Seller's court costs, attorney fees, and other costs of collection amount due under this contract in the event that referral to an attorney for non-payment becomes necessary.
In the event of non-payment, the right to access and remove is granted to Bullseye Fence.

WAIVER OF LIABILITY CONCERNING ENCROACHMENTS BY FENCES
Phillip Lodato and Kathryn Lodato , ("the Landowners") on behalf of themselves, their
heirs, assigns, and successors in title to the following described property acknowledge as follows:
1. The Landowners acknowledge that they are the owners of the following described real
property:
10665 Towne Road, Carmel, IN 46032
(hereinafter referred to as "the Real Estate").
2. The Landowners have applied to the City of Carmel ("the City") for a permit to construct a fence upon the
Real Estate.
3. The Landowners further acknowledge that the City will not inspect the location of the fence and,
therefore, in approving a permit for the fence, the City does not represent or -warrant that the fence is, or
will be located within the boundaries of the Real Estate, or that the fence will not encroach into, or across,
any easement or right of way (collectively an "Easement") which restricts the use of any part of the Real
Estate.
4. The Landowners, therefore, acknowledge that to the extent any part of a fence and/or any other
improvements which may be installed by the Landowner encroaches upon an Easement, whether a
drainage, utility, or any other easement, the City or any utility or unit of government benefited by such
Easement may:
a. Require the fence and/or other improvements to be removed upon the earlier of three (3) days of
written notice or as provided in any Easement or other governing document,
b. In the event of an emergency, remove the fence and/or other improvements without notice;
C. In the event the fence and/or other improvements are not removed, the City, utility or unit
benefited by the Easement, may, or through their agents and contractors may, remove the fence
and/or other improvements, and cause the materials of the fence and/or other improvements to be
stacked upon the Real Estate.
The Landowners agree to release the City, or any utility or unit of government, its officers, officials,
members, employees, invitees, licensees, agents and contractors from any liability to the Landowners,
their heirs, assigns or successors in title, for the removal, damage, or destruction of the fence and/or other
improvements.
6. The Landowners agree to indemnify and hold harmless the City, or any utility or unit of government, its
officers, officials, members, employees, invitees, licensees and agents from and against any and all losses,
liabilities, damages, claims, judgments, reasonable attorney fees and costs arising from the location of the
fence within an Easement.
Fences placed near a drainage easement must not impede the flow of storm water. In the event the flow of
storm water is impeded, the City shall have the rights set forth in Section 3 above to mitigate or alleviate
such condition.
