DISASTER EMERGENCY DECLARATION
WHEREAS, the persons and property of the residents of the City of Carmel, Indiana, are
threatened by a public safety emergency caused by the recent rioting, destruction of
property, injuries, loss of life, and acts of domestic terrorism that have occurred in cities
nationwide as a result of the tragic death of George Floyd while in police custody, and
WHEREAS, on Friday, May 29, 2020 and Saturday, May 30, 2020, what had initially
been peaceful protests in Indianapolis, turned decidedly violent, resulting in three deaths
and numerous assaults, as well as significant and widespread property damage and loss
caused by thrown projectiles, arson, looting, vandalism and/or the defacement of at least
80 local businesses and government buildings, which has resulted in Indianapolis imposing
a curfew, the mobilization of numerous police officers, and the placement of hundreds of
Indiana National Guardsmen and Guardswomen on alert; and
WHEREAS, Indianapolis and Carmel are adjacent to one another and share a street; and
WHEREAS, Carmel has now received information that the protests which resulted in
extensive damage and loss of life in Indianapolis are planning to take place into Cannel on
June 1-2, 2020, and for some time thereafter; and
WHEREAS, there have been recent threats to Cannel made on social media, including
those attached to this Declaration; and
WHEREAS, as shown by the information summarized above, as well as by the recent
events in Indianapolis, an imminent threat exists that may inflict widespread and severe
injuries to persons and/or damage to property in Cannel; and
WHEREAS, Indiana Code §10-14-3-1 defines a "disaster" subject to Indiana's
Emergency Management Law to include an occurrence or imminent threat of widespread
or severe damage, injury, or loss of life or property resulting from a human act; and
WHEREAS, Indiana Code §§10-14-3-29 and 10-14-3-29.5 authorize me, as Cannel
Mayor, to declare a local disaster emergency, which may include a local travel advisory
restricting travel and activities in areas because of a hazardous situation, whenever Carmel
is faced with an imminent threat of a disaster; and
WHEREAS, an emergency declaration, to include a local travel advisory, is now an
appropriate and necessary response in order to address the imminent threat of widespread
or severe damage, injury, or loss of life or property resulting from the impending protests
in Cannel.
WHEREAS, Governor Holcomb, in his Executive Order 20-29, rescinded his earlier
restrictions on local travel restrictions.

Cannel, Indiana, and all applicable sections of the Indiana Code are hereby fully invoked
and in effect to allow for the exercise of all emergency authority necessary or prudent for
the protection of lives and property during this threatened civil unrest.
IT IS FURTHER ORDERED that, effective at 5:00 PM EDT on June 1, 2020, a
LOCAL TRAVEL EMERGENCY, pursuant to Indiana Code §10-14-3-29.5(a)(1), for
this declared disaster emergency is in effect for the City of Carmel. The Cannel Police
Department is hereby given the authority and discretion, in consultation with me as the
Mayor of Cannel, to temporarily close public streets, highways, and thoroughfares located
within Carmel's corporate limits as necessary or prudent in order to address the imminent
threat of widespread or severe damage, injury, or loss of life or property resulting from the
impending and beforementioned protests.
The Cannel Corporation Counsel will ensure that this Declaration is promptly filed with
the City Clerk and given prompt and general publication.
This Declaration will be in effect until a further declaration is issued or as otherwise
determined by me as the Mayor of the City of Cannel, Indiana.
This Declaration is executed on this the 1st day of June 2020.
