I’ve issued the Board of Zoning Appeals (BZA) Docket Numbers for this item. They are the following:
(V) VOWC Family Express Gas Station.
The applicant seeks the following development standards variance approvals:
Docket No. PZ-2020-00093 V VOWC PUD Section 8.11 Buildings in Peripheral Retail Area shall be
designed in conformance with the Peripheral Retail Area Design Guidelines, Deviation from guidelines requested.
Docket No. PZ-2020-00094 V VOWC PUD Section 15.8.1.D Required 10’ build-to line unless otherwise
indicated on an approved final plat or in another recorded instrument, 118’ requested.
Docket No. PZ-2020-00095 V VOWC PUD Section 15.11 Accessory buildings may be located in the rear and
side yards behind the rear facade of the principal structure, Accessory structure located in front of primary
structure requested.
Docket No. PZ-2020-00096 V VOWC PUD Sections 16.17.A & 16.17.D.5 Stacking shall be confined to the
sides and rear of the parcel, Stacking in front requested. Also the minimum number of vehicle stacking spaces
required for drive-thru lanes shall be 3 measured from the gas pump island, Request to include car parked at
pump. The site is located at 2425 Harleston St. (in Village of WestClay subdivision, Section 6003B, Block B.) It is
zoned Village of WestClay PUD/ Planned Unit Development Ordinance Z-465-04, as amended. Filed by Jim Shinaver of

Filing Dates & Deadlines - Petitioner, please note the following:
1. This item does not need to be on any meeting agenda of the Technical Advisory Committee (TAC) at this time.
2. All Mailed, Posted, and Published Public Notice needs to occur by Tuesday, July 7 (but may occur earlier).
Due to the site’s area zip code, the published notice (legal ad) is required within The Current in Carmel*; please
contact them at least 11 days prior to that in order for them to publish it on time (317-489-4444 ext. 5 or
legals@youarecurrent.com.
The mailing of letters to adjoining property owners & placement of public hearing sign on the subject property is
also required by the BZA Rules of Procedure, Article VI, Section 6 (see Application and see Calendar).

Make sure the public notice meeting time in the newspaper, on the sign, and in letters to neighbors read 6:00 PM

and that the location on the legal ad and mailings read: Carmel City Hall Council Chambers, 2 Flr, Carmel, IN 46032.
(The location on the sign can just read Carmel City Hall.)
3. The Filing Fee and 1 digital copy of the BZA Info Packet must be delivered to BZA administrative assistant Joe
Shestak no later than Noon, Friday, July 17. (Failure to submit the Fee and Informational Packet by this time will
result in the automatic tabling of the petition.)
Please include the following in your Info Packets:
a) Short memo/letter introducing the project
b) Statement of request (short paragraph explaining what you are asking for)
c) Statement of Support (short paragraph explaining reasons supporting the request, including analysis and
comparison of what is allowed vs. what is proposed)
d) Location Map
e) Reductions of all plans (site plan, aerial photo of site, exterior architecture, landscape plan, signage, etc. on
8.5”x11” or 11”x17” paper).
f) Page 10 of app. – Ballot Sheet (leave blank except for Docket No. & Petitioner)
g) Page 11 of app. – Findings of Fact sheet (question sheet filled out, statements completed)
h) Any other pertinent information for the Board to explain this request (such as letters of support, Owners
Association approval, etc.).
4. The Proof of Notice needs to be received by this Department no later than Noon, Wednesday July 22. Failure to
submit Proof of Notice by this time will result in the tabling of the petition.
5. This item will appear on the Monday, July 27 agenda of the Board of Zoning Appeals regular meeting under Public
Hearings, at 6:00 PM.
6. Either the Petitioner or someone representing the Petitioner must attend the meeting to present the item to be
heard. If no one appears, it will be tabled.
7. Please refer to your application’s instruction sheet for more detail.
Preliminary Review Comments - Petitioner, please respond in writing to the following by noon, Friday, July 17:
a) Please make checks payable to City of Carmel.
b) Provide a copy of the Official List of Adjacent Property Owners from the Hamilton County Auditor’s Office. (Make
sure to check ‘Carmel BZA’ on their form.)
c) *The Current in Carmel only prints on Tuesdays, and their filing deadline is usually 7 days prior to their printing
date. Please submit your Word file of the legal ad to them by Noon, Tuesday, June 30 so that it prints on time. Their
contact info is 317-489-4444 ext. 5 or legals@youarecurrent.com. (Use the Notice of Public Hearing form in the
Application as a template for what to have published in the newspaper and mailed out to the neighbors.)
d) The mailings/notices to the neighbors should be done by first class mail with Certificate of Mailing (not Certified
Mail). (Please provide us with the certificate of mailings for the file on or before Wednesday, July 22.)
e) Please provide the filled out & notarized Placement of Public Notice Sign Placement Affidavit form (see application)
once the sign is placed.
f) Please provide the filled out & notarized Petitioner’s Affidavit of Notice of Public Hearing form (see application).
g) Please provide the filled out Notice of the Public Hearing form/template (see application).
h) Please provide proof of notice, such as Publisher’s Affidavit from the newspaper, once you receive them.
i) Please make sure to list out the true practical difficulties and hardships associated with having to comply with the
ordinance.
j) Is the Village of WestClay Owners Association & Architectural Review Board supportive of the proposed site plan
layout? Please provide documentation.

k) Additional review comments from the Planning/Zoning Department will be issued through ProjectDox, our
electronic plan review software, once you upload your plans and documents.
