Property owner shall perform operation and maintenance procedures listed in the Indiana Stormwater Quality Manual, the City of Carmel Stormwater Technical Standards Manual, the approved O&M manual, and the terms and conditions of the approved Stormwater Management Plan for each BMP. BMP Inspection and Maintenance • The BMP owner agrees to pay all the fees required by the City of Indianapolis, including annual inspection fees, and/or any additional fees required. • Routine inspections and maintenance are the responsibility of the BMP owner. The City of Indianapolis must be notified of any changes to BMP ownership, major repairs, or BMP failures within 30 days. • In the event that the city finds a BMP in need of maintenance or repair, the City will notify the BMP owner of the necessary repairs or maintenance and give the owner a timeframe for completion. If the maintenance or repairs are not completed within the designated timeframe, the City shall perform the work and bill the owner for the actual cost of the work. • Personnel from the City of Carmel have the right to enter the Carey Grove Park property to inspect the referenced BMP’s in this manual as needed. Record Keeping The property owner should keep a file containing all information pertaining to repair, replacement, and maintenance of the site infrastructure. Files should be readily accessible to parties performing maintenance on the infrastructure and local regulatory agencies. Site Information This manual contains the inspection and maintenance criteria for the proposed Carey Grove Park Rehabilitation. The project is located on Carey Road between Hawthorne Drive West and Driftwood Drive in the City of Carmel, Hamilton County, Indiana. For reference, the project site is located at approximately latitude 39° 59’ 32” N and longitude 86° 06’ 28” W. The proposed project includes the construction of a new playground area, basketball court, parking area, two infiltration trenches, and a dry detention area. Stormwater runoff from the development will be collected and conveyed natural grading. The stormwater runoff will convey to two infiltration basins. Once stormwater runoff is treated in the infiltration basins, stormwater will then be conveyed to dry detention area. From the dry detention are, the stormwater runoff will be conveyed north, offsite, where it will ultimately be collected into the existing stormwater sewer system. III. Inlet Maintenance Inlets, Catch Basins and Manholes Inspect inlet castings monthly and after each rainfall event. More frequent inspections should be performed in areas where there is higher potential for trash or litter and during the fall when leaves are present on the ground. Inspect structures (including sumps and gas hoods) two times per year (preferably in spring and fall) to ensure that the all components are working in their intended fashion and that they are free of debris. Clean structures when sediment depths reach ¼ of the pipe diameter with a maximum of 6-inches. At a minimum, remove floating debris at the time of the inspection . If structure is constructed with a sump, the sump shall be cleaned when sediment depths reach approximately 3 inches. Additionally, gas hoods shall be inspected to ensure excess residue does not collect inside the hood. Sediment from cleaning procedures should not be dumped into a sanitary sewer but disposed of in accordance with all federal, state, and local requirements. Good House Keeping Periodic maintenance and inspections of the storm sewer network will reduce stormwater runoff pollution. Inspect Inlets for debris and sediment. Remove debris and sediment and dispose of properly. Properly cleanup and/or report any chemical spills. Minimize fertilizer, pesticide and herbicide applications. Avoid applying before any rain event. Property owner shall keep the site free from litter, woody growth, and shall mow the property when needed, but average grass blade height is not to exceed five (5) inches. IV. Conveyances Maintenance Storm Sewers Inspect storm sewers monthly and after each rainfall event. More frequent inspections should be performed in areas where there is higher potential for trash or litter and during the fall when leaves are present on the ground. Clean storm sewers when sediment depths reach ¼ of the pipe diameter with a maximum of 6-inches. Rip-rap Inspect rip-rap semi-annually and after major rainfall events to ensure proper flow and to make sure it is free of trash/debris. Remove any obstructions to flow, including accumulated sediments, debris, and vegetated growth. Flowlines Inspect flowlines monthly and after each rainfall event to ensure they are working in their intended fashion and that they are free of sediment and debris. Remove any obstructions to flow, including accumulated sediments, debris, and vegetated growth. Flowlines to remain unobstructed from buildings, fences, and have a uniform slope. Vegetated Areas Property owner shall keep the site free from litter, woody growth, and shall mow native vegetation once per year, wither in late fall or early spring. Concrete and Hard Surfaces Clear accumulations of winter sand on hard surfaces and along walks and pavement at least once a year, preferably in the spring. Accumulations on may be removed by sweeping. Maintenance Item Inspection Frequency Maintenance Vegetation 1) Vegetation Monthly and after major storm events Reseed, fertilize and mow as needed. Mowing shall not blow excess clippings into the detention area. Remove invasive vegetation when it adversely affects the ability of the system to perform as a water quality control device. 2) Vegetative health Annually Replace/replant dead vegetation. Inspect gas hood (if applicable): remove any collected residue. 2) Hydrodynamic Separator Biannually and after major storm events Completely drain structure and vacuum all debris/sediment from structure sump Rip-Rap 1) Rip-Rap Semi-Annually and after major storm events Remove collected debris and any vegetation in rip rap. Replace any rip rap that has been lost. Pipes Type: Reinforced concrete 1) Storm Sewers Monthly and after major storm events Remove sediment at depths ¼ of the pipe diameter with a maximum of 6-inches. V. Detention System Maintenance Outlet Control Structure Outlet control structure shall follow a maintenance schedule similar to the “Inlets, Catch Basins and Manholes” section above. The outlet control structure casting should be inspected monthly and after each rainfall event. More frequent inspections should be performed if in an area where potential for trash or litter is high and during the fall when leaves are present on the ground. Inspect structure two times per year (preferably in spring and fall) to ensure that the all components are working in their intended fashion and that they are free of debris. Clean structure when sediment depths reach ¼ of the pipe diameter with a maximum of 6-inches. At a minimum, remove floating debris at the time of the inspection. Inspect and clean orifice to prevent and ensure clogging hasn’t occurred. Additionally, head wall shall be inspected to check for any leaks or structural damage. VI. Water Quality System Maintenance Infiltration Trenches BMP Facilities shall follow a maintenance schedule similar to the “Vegetated Areas” section above. Property owner shall keep the site free from litter, woody growth, and shall mow the property when needed. Additionally, property owner is responsible to replant or replace dead/dying vegetation. VII. NOW, THEREFORE, in consideration of the mutual covenants herein set forth and other good and valuable consideration, the receipt of which is hereby acknowledged, the Grantor hereby grants to the Grantee a non-exclusive, perpetual easement on the terms and conditions that follow: Section 1. Easement Area. The portion of Real Estate on, under and through which this Easement exists is legally described and graphically depicted in what is attached hereto and incorporated herein by reference as Exhibit “A” in two parts (the “Easement Area”). Section 2. Storm Water Quality System. Located or to be located within the Easement Area, in the manner and areas specified in the Permit, is certain drainage and storm water quality infrastructure, which may include, without limitation, pervious pavement, manholes, infiltration basins, pipes, and structural and non-structural best management practices (collectively the “Storm Water Quality System”) to be constructed, installed and maintained by Grantor, at Grantor’s expense, in accordance with the Permit and the Ordinances. Section 3. Purpose of Easement. Grantee shall be and hereby is permitted at all times to enter upon the Easement Area for purposes of (i) accessing, inspecting, examining, monitoring, testing and sampling the Storm Water Quality System, and (ii) identifying and verifying compliance with the requirements of the Permit and the Ordinances. Section 4. Maintenance and Repair. It shall be Grantor’s obligation to maintain in proper working order and to repair and/or replace the Storm Water Quality System, or parts thereof, such that (i) the effectiveness and performance of the Storm Water Quality System is not diminished from the capabilities set forth in the Permit and (ii) the Storm Water Quality System remains in compliance with the Permit and the Ordinances. Section 5. Failure of Storm Water Quality System. In the event that the condition of the Storm Water Quality System or the outflow therefrom violates or fails to comply with the requirements set forth in the Permit and/or any of the Ordinances, Grantee shall have the right, but not the obligation, after providing reasonable notice to Grantor, to perform, at Grantor’s expense, such maintenance, repair, modification and/or replacement of the Storm Water Quality System as is necessary to restore compliance with the requirements set forth in the Permit and/or the Ordinances; provided, however, that the performance by Grantee of any such maintenance, repair, modification and/or replacement of the Storm Water Quality System shall under no circumstances relieve Grantor of its responsibility to maintain and operate the Storm Water Quality System, which responsibility shall be continuous and ongoing. Section 6. Reimbursement of Expenses and Enforcement. Grantor shall reimburse Grantee for costs and expenses incurred by Grantee in the performance of the maintenance, repairs, modifications and/or replacements specified in Section 5 above and, in the event of litigation to recover such expenses, the prevailing party shall be entitled to recover reasonable attorney’s fees. Section 7. Character of Easement. This Easement shall be perpetual and, further, shall inure to the benefit of and be binding upon the parties’ respective successors and assigns. Section 8. Use by Grantor and Other Easements. Grantor shall be permitted to use the Easement Area and also to grant other easements within the Easement Area for any purposes which do not impair the Storm Water Quality System and which are not inconsistent or conflicting with this Easement and the Grantee’s rights under this Easement. Section 9. Amendment. This Easement may be amended only by a written instrument signed (i) by then owner of the Real Estate and Board of Public Works & Safety of Carmel, Indiana or its successor or (ii) by an order of a court of competent jurisdiction. In the event that the Real Estate is later redeveloped and, as such, the site plan made the subject of the Permit is revised, then the Grantee and then the owner of the Real Estate shall amend this Easement to reconfigure the Easement Area, accordingly, so that Easement Area is adjusted to and does not conflict with such revised site plan. Section 10. Authority.
