HomeMy WebLinkAboutFindings of Fact 5.A.10FINDINGS OF FACT SHEET - DEVELOPMENT STANDARDS VARIANCE CARMEL ADVISORY BOARD OF ZONING APPEALS (Petitioner to fill out 1-3 + first two blanks) Docket No.: Petitioner: The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The existing parking lot, driveway, and sidewalks, much of which will remain in place, are not currently constructed as permeable pavement systems. The construction of the imposed non -permeable. pavements within the subject site is contiguous with the existing non -permeable pavements. There are non -permeable pavements within Special Flood Hazard Areas (SFHA's) throughout the community, including the adjacent section of East 116th Street, and none of these pavements has been documented to be injurious to public health, safety, morals, and the aeneral welfare of the communitv. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: The application of permeable pavement systems within an SFHA does not reduce the Base Flood Elevation (BFE). Expensive cleaning and maintenanee of the perrneable pavernent�— systems located in a SFHA after each flooding event is required so that the permeability of those systems is not significantly reduced ue to flood sedimentation. I his maintenance cost is a sianificant burden to the owner with no aaareciable benefit to the level of the BFE. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
