When we met initially about the sign for Shahram’s Kitchen in February, we had a similar misunderstanding which I tried to clarify per the attached email, and in subsequent conversations. At the time, in February, my offer to assist you with getting the sign approved, was not an approval. There is nothing ‘sudden’ here with the requirement to get a variance. We have talked about it and I followed up last Thursday with an update and guidance. Now your email below to Angie, which is very confusing and disappointing. As for the Kuaba Gallery sign, that is an entirely different situation. The Monon and Main PUD allows for sign area to be calculated at 1.5 square feet per 1 linear foot of building frontage. The building where Kuaba is located has approximately 70 feet of combined frontage on Main Street and Harlin Blvd. With more frontage, more signage is also allowed. The building frontage for 246, site of Shahram’s, it has approximately 22 feet. There is quite a difference between the two situations. That a sign permit was issued for Kuoba Gallery, an upper floor tenant without a variance is a result of what may have been a miscommunication with DOCS staff, but you were allowed the sign because the total sign area for 404 W. Main Street allowed up to 32 square feet of additional signage. That was ultimately my mistake, but it is not a mistake I will replicate in this instance. Especially when the ordinance for Monon & Main is so clear about signage being for first floor tenant , and sign area being calculated at 1.5 square feet for every 1.0 feet of frontage. A second sign at 246 W Main is not allowed without a variance. If you would like assistance with the variance application process, I am happy to assist, but I am not willing or able to grant an exception or see a way for additional signs at 246 other than by getting the correct approval from the BZA. This sign is at the same NONON AND MAIN COMMUNITY, It is under same Covenant, Just tell me why you are making it hard for me? Why you don’t treat me The same As you did with the KUABA GALLERY? Mike Hollibaugh Email dated 07,02,20 Soori, good afternoon. The variance application for Shahram’s Kitchen sign is on file now but we still have a few things to handle for it to move forward. One is the application and review fee for the Hearing Officer Variance which is $371 . That is something we can’t avoid, but is less than the normal amount for commercial variance at the Hearing Officer which is normally $749. The fee needs to be paid no later than July 17. I will be working on the public notice to the Current for you which will also have a cost to it. That is due this coming th Monday July 7 by noon. I will have the notice prepared and email it to you in the morning of the 7 at the latest. I will try to have a ball park cost to you so you know in advance. Written notice to neighbors is due by July 17, I will handle that and sign placement, although I will need your signature on the letter. When you asked to meet last month to meet, after our discussion, we agreed a handful of things including:  That the meeting was very short notice and it wasn’t practical to ask staff into the meeting because they were attending to city business,  that DOCS was supportive of what you wanted to do, and would find a way to accommodate new signage  that Nathan was the best person for you to work out the location and design details for the new signage, since that is his role in DOCS and he had the most knowledge about what is allowed by the PUD, including where new signage can be placed. I am sorry if you left thinking your sign was approved. That is certainly not my recollection, as I don’t recall seeing a proposed sign design, only a general discussion around the current sign, and that Nathan was best to work this out with you. Please know that having my support, or Department support, is not the same as having an approved sign design or an approved sign permit. DOCS (and you) have to operate within the approved PUD for the project; Let me assure you that Nathan and I will do our best to work out an acceptable location for the new sign that is within the parameters of the PUD. February 07,2020 Mr Nathen Chavez emailed us (below email) providing us the Sign’s dimensions and identifying the position of blade sign. 1 February 07,2029 We met the sign company sales person and provided all the information and asked her to start fabricating the Shahram’s Kitchen sign. Suddenly February 14 Mr Nathen Chavez sending us changes which isn’t possible for few factors. 1)-Rain pours down due to malfunctioning of the highest level facets ( repair has tried still same issue) and its dangerous bc of The electrical component of the sign. 2)-The sign will be posted less than 8 feet from the ground . 3)-There is no space since there’s second floor black balcony railing. 4)-The electrical access is limited . 5)-KUABA gallery is the second sign for the building too which was approved. I like to meet you on site when we come back to Indy March 06,2020 since We are back to Denver bc of my son’s health issues .
