Please exercise caution and Do Not open attachments or click links from unknown senders or unexpected email. **** Dear Board of Zoning Appeals: I am writing to express my concern regarding the four (4) variance requests for the proposed gas station at 131st Street and Towne Road. First, I believe this gas station is in direct violation of a Hamilton County zoning ordinance that prevents elderly care facilities and schools from being within 300 feet of gas pumps, tanks or storage of flammable materials. The Stratford Retirement Home and Primrose Daycare Pre-School are both within 300 feet of this proposed gas station. Second, allowing this gas station will provide a dangerous precedent for future development. The two largest concerns are moving the pumps and parking from behind the building (like all other businesses are required to do) and reducing the amount of space required for cars to wait in line. This produces a big hazard that could impact the traffic and safety of pedestrians. Third, the Village of West Clay was incorrect with a letter to Mayor Brainard in stating that all the residents of the Village strongly support this gas station. The real situation is that with an email correspondence in 2015, The Village asked residents to support a motion to rezone Area 3 (where the gas station is planning on going) to commercial so they could put in a 'Pediatric Office.' We feel like we were lied to regarding this motion for rezoning. We are asking that the proposed gas station not be allowed to continue due to the safety of the residents, children, and elderly who live within 300 feet of this land.
