(V) Napleton Kia Variance.
The applicant seeks the following development standards variance approval:
6. Docket No. PZ-2020-00107 V UDO Section 5.10 (Floodplain Standards) and City Code
Chapter 10, Article 5, Chapter 5.A.11 (a) and (b) Floodplain compensatory storage required
on site, Off site storage proposed at King of Glory church site, 2201 E. 106th St.
The site is located at 9675 Randall Dr. (near 4600 E. 96th St.) in East 96th Street Auto Park Subdivision,
Block A. The site is zoned B3/Business and SFHA/Special Flood Hazard Area. Filed by Jim Shinaver of
Nelson & Frankenberger on behalf of Napleton of Carmel Imports, LLC dba Napleton Kia of Carmel.
General Info:
The Petitioner seeks variance approval to install off-site storm water floodplain mitigation at a site near
106th/Keystone, rather than on the main Randall Dr. site. Please see the Petitioner’s info packet for more
detail on the variance request.
Analysis:
The Petitioner seeks approval for one variance from the Carmel Flood Hazard Areas Ordinance, in order to
install compensatory floodplain mitigation off site, rather than on site.
Napleton Kia of Carmel is the Applicant, owning a parcel of real estate that is approximately 3.74 acres in size,
located generally northeast of the intersection of Randall Drive and 96th Street. In 2019, Napleton obtained
DP/ADLS approval from the Plan Commission and signage and landscape variance approval from the Board of
Zoning Appeals.
The off-site storm water mitigation is planned on property located near 106th Street and Keystone Parkway and
is owned by the King of Glory Church. The Carmel Dept. of Engineering has recently reviewed and approved
the off-site mitigation plan. However as noted, to provide off-site mitigation, consideration of variance approval
from the Flood Hazard Ordinance, pertaining to off-site mitigation is required for the subject site. The
mitigation project will consist of a cut on the site ranging in depth from about 1' at the southwest corner of the
proposed site to approximately 5' at the north east project site. The area will be graded at approximately 0.5%
slope from northwest to southeast. At the southeast corner of the site, a small berm (about 1.5') will be created
to maintain separation from the existing Millbrook Subdivision pond. The drainage will be conveyed directly to
the ditch within the right of way of Keystone Parkway.
The Petitioner addressed all planning/zoning review comments, and the Planning Dept. supports this
variance request.
