The applicant seeks the following development standards variance approval for a 47’ x 30’ garage with covered porch: 7. Docket No. PZ-2020-00109 V UDO Section 5.02.B Lots over 3 acres shall be exempt from the Maximum Ground Floor Area requirements for an accessory structure, 2.7 acres exists. The site is zoned S1/Residence. It is located at 949 W. 136th Street. Filed by Yvelina Ivanova Cox, owner. General Info: The Petitioner seeks approval to erect a detached garage with covered porch, with a footprint of 47’ x 30’. It will complement the house’s architecture and finishes. The subject parcel is 2.72 acres in size. The property is located in an area of the city where there are large estate sized lots, near Six Points Rd. and 1136th Street. This is the only variance needed. Please see the Petitioner’s info packet for more detail on the variance request. Analysis: A guest house with garage currently exists on the parcel, in addition to the main house with attached garage. On lots less than 3 acres in size, the zoning ordinance requires a maximum 24’ by 30’ detached accessory structure, as well as the total combined square footages of the accessory uses not exceeding 75% of the ground floor area of the principal building (main house). This parcel is 2.72 acres in size, so it falls 0.28 acres short for meeting the 3-acre exempt criteria for accessory uses/buildings. In this case, the proposed accessory building square footage will exceed the maximum allowed by 1,410 sq. ft. UDO section 5.02 states the following: AB-01: Residential Accessory Building and Use Standards 3. Maximum Ground Floor Area: a. The combined square footage of the Ground Floor Area of a Private Garage and/or Accessory Building shall not exceed 75% of the Ground Floor Area of the Principal Building. b. A detached garage, which is the only Accessory Building on the lot, may equal the maximum dimensions of 24’ x 30’ provided that the Ground Floor Area of the garage is less than or equal to the Ground Floor Area of the Principal Building. c. Lots over 3 acres and Multiple-family Residential shall be exempt from the requirements of this Section - Maximum Ground Floor Area. The Petitioner addressed all planning/zoning review comments, and the Planning Dept. supports this variance request. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. PZ-2020-00109 V.
