LAND DESCRIPTION:
A part of the Northwest Quarter of Section Thirty (30), Township Eighteen (18) North, Range Four (4) East,
described as follows:
Begin Thirteen (13) rods East, and One Hundred Twenty-two and five tenths (122.5) feet South of the
Northwest comer of said Section, Township and Range, and run thence South Fifty (50) feet, thence East One
Hundred Sixty-five (165) feet, thence North Fifty (50) feet, thence West One Hundred Sixty-five feet (165), to
the place of beginning, in Hamilton County, Indiana.
SURVEYOR'S REPORT
In accordance with Title 865, Article 1, Chapter 12 of the Indiana Administrative Code ("Rule 12"), the
following observations and opinions are submitted regarding the various uncertainties in the locations of the
lines and corners established this survey as a result of uncertainties in availability and conditions of reference
monuments; in lines of occupation; in clarity or ambiguity of the record descriptions; and as introduced by
random errors in measurement ("Relative Positional Precision"). There may be unwritten rights associated with
these uncertainties. The client should assume there is an amount of uncertainty along any line equal in
magnitude to the discrepancy in the location of the lines of possession from the surveyed lines.
There may be differences between deed or plat dimensions and measured dimensions along some of the
boundary lines shown hereon.
This survey and report are based in part upon opinions formed in accordance with an Indiana Land Surveyor's
responsibility to conduct a survey in accordance with “1aw or a precedent” (865 IAC 1-12-11(5), Rules of the
Indiana State Board of Registration for Land Surveyors). Since Indiana has no statutes addressing how to
resolve boundary lines, a solution based on principles derived from common law precedent must be relied upon
as the basis for a boundary resolution.
Unless otherwise noted or depicted hereon, there is no evidence of occupation along the perimeter lines of the
subject tract. All survey monuments set or found this survey are flush with existing grade unless otherwise
noted.
The purpose of this survey was to perform a Boundary Retracement Survey of a 0.189 acre ± parcel in the
Northwest Quarter of Section 30, Township 18 North, Range 04 East as described in Instrument 2020035362 in
the office of the Recorder of Hamilton County, Indiana for use in real estate development.
The horizontal location data shown on this survey is based upon standard surveying measurement practices
utilizing Topcon Real Time Kinetic (RTK) Global Navigation Satellite System (GNSS) units, a Topcon
GTS-602 total station and/or data obtained from the INDOT, INCORS network. Any coordinates, if shown or
used on this survey are referenced to a local system.
The basis of bearings for this survey is referenced to the North line of said Northwest Quarter, using
monuments found as described on references provided by the Hamilton County Surveyors Office. Said bearing
is North 88 degrees 43 minutes 10 seconds East, according to the local system noted above.
Only rights-of-way (R/W or ROW) of record are graphically depicted on this survey.
A.Availability and Conditions of Reference Monuments:
A Mag Spike was found marking the Northwest corner of the Quarter Section and a brass plug was found
marking the Northeast corner of the West Half of said Quarter Section. Both monuments were as described on
the aforementioned Surveyors Office references, and were held..
No monument was found at the Southwest corner of the Quarter Section. This location was re-established
using dimensions from reference ties found. The uncertainty in this location is negligible.
All monuments found or set are flush with the surface, unless otherwise noted.
There may be references made to monuments found at or near the corners, or along the deed lines of the subject
real estate. In cases where the monument is not exactly in agreement with this survey but within the Relative
Positional Precision of the measurements on this survey, no new monument was set and the difference is shown
only to accentuate the uncertainty of that corner. In those cases where the difference is greater than the
Relative Positional Precision and uncertainty in referenced monuments, caution should be exercised before
making any improvements along those lines affected. Those uncertainties should be considered to be
significant and are discussed below.
B.Lines of Occupation:
Occupation along the North line of the subject tract is to a 4 foot high chain link fence which was found to be
approximately along said line at its West and 4.2 feet South of said line at its East end.
Occupation along the East line of the subject tract is to the improvements along 1st Avenue NE.
Occupation along the South line of the subject tract is to a 6 foot high wood fence which was found to be
approximately along said line at its West end and 0.5 feet South of said line at its East end.
Occupation along the West line of the subject tract is to the edge of the asphalt parking for the West adjoiner to
the subject tract, which was found to be approximately along said line.
C.Clarity or Ambiguity of the Record Descriptions:
Unless discussed above, there are no discrepancies between the record land descriptions of the subject real
estate and the adjoiners. A title company and/or legal counsel should be consulted regarding any deed overlap
and deed gap areas if shown on this survey. The lines of the subject real estate can be considered to be
contiguous with the adjoiners' lines if no gap or overlaps are noted.
D.The Relative Positional Precision of the Measurements:
The Relative Positional Precision (due to random errors in measurement) of this survey is within the
specifications for an Urban Class Survey Suburban Survey (0.13 feet plus 100 ppm) as defined in IAC 865.
Theory of Location:
Using the monuments described in the Availability and Condition of Reference Monuments section of this
report, the North and West lines of the Quarter Section were established. Though no specific controlling calls
for parallelism with said lines were used in the record descriptions for the subject tract and its adjoiners, they
did call for equidistant measurements along their West and East lines as well as their North and South lines.
Therefore, for the purposes of this survey, the North and South lines of the subject tract were established
parallel with the North line of the Quarter Section and the East and West lines of the subject tract were
established parallel with the West line of the Quarter Section.
Using the deed dimensions along the above described parallel lines, the North line of the subject tract was
found to fall approximately 2.0 feet into the home on the North adjoining tract and the South line of the subject
tract was found to fall approximately 2.8 feet into the home on the subject tract. Long standing fences were
found as described in the Lines of Occupation section of this report. The fence along the South line of the
subject tract was found to be continued through the line between the subject's West adjoiner and the tract South
of said West adjoiner. It was decided that this occupation evidence constituted the best available to establish
the West end of the North and South lines of the subject tract, with the Northwest and Southwest corners of
said tract being established using the record dimension East of the West line of the Quarter Section and parallel
with said line. The East end of said lines was established using the record dimension along lines parallel with
the North line of the subject tract, as described abvove. The resulting North and South lines of the subject tract
were found to be approximately 3.7 feet South of the locations of said lines established using deed dimensions
alone.
E.Positional Uncertainty:
As a result of the above observations, it is my opinion that the uncertainties in the location of the lines and
corners established on this survey are as follows:
Due to Variances in reference monuments:Negligible
Due to Inconsistencies in lines of occupation:3.7 feet
Due to Discrepancies in record descriptions:None observed
