We are requesting variance approval for a 5-foot fence at our home at 2979 Winterset Drive,
Carmel, IN 46032.
According to UDO section 5.09, the current fence height allowed is 42 inches for a front yard or
corner lot. We are requesting approval for a 5-foot tall black metal ornamental fence to be
installed around the perimeter of our backyard, which is a corner lot. On the east side, the fence
will run parallel to Kings Mill Drive.
There are two reasons we are requesting this variance for a 5-foot fence. First, we would like to
safely contain our dog, Noodle, who as a puppy can already scale a 3-foot gate. Second, we
would like to ensure safety for our neighborhood children and pets. We are in the process of
installing a swimming pool in the back yard. Our back yard (corner lot) is accessible to the
common areas of the neighborhood. Having a 5-foot barrier will ensure that children and pets
cannot access the swimming pool.
The proposed fence has already received approval from our Kings Mill Homeowners Association
(see attached). The 5-foot fence will match the fence height and style of our adjoining neighbors.
The fence runs parallel to the street but does not extend to the corner intersection; it will not
obstruct vehicular sight lines or safety.

Statement of Variance Request
Petitioners request a variance to build a 5-foot tall fence along the perimeter of the back yard
(corner lot) at 2979 Winterset Drive in Carmel in order to contain the family dog and protect
neighborhood children and pets from the new swimming pool being installed in Fall 2020. The
current UDO section 5.09 only allows for a 42” fence in front yards and corner lots. The
proposed fence is black metal ornamental and has been approved by the Kings Mill Homeowners
Association.

To the Kings Mill Board:
After living in our home in Kingsmill for 19 years, we have decided to make a considerable
investment in improvements to our backyard space. Please consider approval of the following
changes to our lot:
- Install a 5’ tall black steel fence with concrete footings around the perimeter of the
backyard, starting from the back corners of the house.
- Install a 35’x16’ fiberglass swimming pool and paver patio
- Install a cedar pergola
- Remove dead and dying trees and upgrade/install landscaping beds
- Remove and replace existing paver walkway in backyard

Construction on the fence would begin as early as late August. Construction on the pool and
landscaping would begin in early September with an estimated completion date in early
