DEPARTMENT REPORT
MONDAY, SEPT. 28, 2020
(V) Shoppes at Weston Pointe Drive Thru Variance.
The applicant seeks the following development standards variance approval for I Heart Mac & Cheese:
1. Docket No. PZ-2020-00131 V UDO Section 3.95.F Drive-thru stacking allowed at rear of
building, Stacking at side of building requested. The site is zoned B2/Business and US 421 Overlay
Zone. It is located at 10895 N. Michigan Rd. Filed by Joe Farr of JDF Development.
General Info & Analysis:
The Petitioner seeks approval for a food pick up window along the north side of the building, rather than at the
rear, east side of the building. A pickup window is slightly different than a drive thru window – less time and
vehicle idling is spent at a pickup window, and there is little to no speaker noise.
The original project was approved 5-0 at the May 2, 2017 Plan Commission Committee Meeting (Docket No.
17020003 DP Amend/ADLS - JDF Development – Shoppes at Weston Pointe). Please see the Petitioner’s
informational packet for more detail on the variance request.
Just north of the building exists the open space common area for The Townes at Weston Pointe subdivision,
before you get to Weston Pointe Drive. The subject site’s main street frontage it to the west, along Michigan
Road. The view of the pickup window and north building façade will also be screened with a 10-ft wide
bufferyard area and perimeter landscaping.
Then Unified Development Ordinance - UDO Section 3.95.F requires the following: Stacking for drive-thru
lanes shall be confined to the rear of the tract or parcel with outlet from such lines also being to the rear of the
building. Lines for drive-thru facilities shall not be permitted along the front and sides of structures within the
Overlay District, nor permitted to spill onto adjoining properties.
The Petitioner addressed all the planning/zoning review comments, and the Planning Dept. supports this
variance request.
