Re: BZA Docket Nos. PZ-2020-000140-141 V: L’Etoile Variances
Dear Mr. Moriarity:
At the meeting held on Monday, September 28, 2020 the Carmel Board of Zoning Appeals Hearing Officer took
the following action regarding the Development Standards Variance (V) requests filed by you for the property
located at 833 W. Main Street:
APPROVED: L’Etoile Variances - Dev elopment Standards Variance approvals for:
• Docket No. PZ -2020-000140 V, Wide Lot width – at least 2 principal buildings required, covering
85% of lot frontage; only 1 principal building requested, but it covers 95% of lot frontage.
• Docket No. PZ -2020-000141 V, Stepback – cannot have more than 3 stories in the same vertical plane
(this contradicts Article 5.16.C UC, Height Standards, which says stepbacks are only required if the
public ROW is 90’ or less. The ROW on Main Street is 120’.)
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is September 28,
2023.
Please include a copy of this letter with any permit application.
