The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The fence will be placed in the actual back yard, not affecting vehicular sight lines or safety. The taller fence height (60") will, in fact, improve safety for the neighborhood by securing the dog in the backyard and preventing neighborhood children from accessing the new swimming pool. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The black ornamental iron fence aligns with homeowners association guidelines and will be seen as an asset and improvement to the neighborhood. The 60" height will match the existing fence height of the adjoining neighbor. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: The 42" fence height will not contain our dog on the property, causing potential harm to the neighborhood children or the dog. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. PZ-2020-00134 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
