The applicant seeks to amend the Unified Development Ordinance in order to amend Section 5.39 Sign Standards, Sections 7.11 & 7.12 Entryway Feature Standards, Section 5.66 Food Stand Use Standards, Section 1.29 Filing Fees, and Definitions for signage. Filed by the Department of Community Services on behalf of the Carmel Plan Commission. Contents: — Red Line Version — Clean Version — Sign Standards Visual Guide — This is for reference and is not included with the UDO. Proposed Amendments Summary: Attached is a proposed UDO Amendment in order to add new sign types, allow different sign types for various uses, promote pedestrian scale signage, and better tailor the recently adopted (2017) Unified Development Ordinance to meet Carmel's signage needs. Article 1: Ordinance Foundation: - Section 1.29: Filing Fees, Lines 35-37: Adding a fee type for new proposed sign type; Sign, Construction Fence Article 5: Development Standards: - Section 5.18: Home Occupation Standards, Lines 47-49: Refer sign standards for Home Occupation to Section 5.39 Sign Standards - Section 5.39: Sign Standards, • Throughout this section all defined terms have been capitalized (i.e. Wall Sign or Entryway Feature). • Line 56: Color is not restricted unless by a Sign Plan. • Line 88: Address numeral size is no longer regulated. • Lines 100-102: Flag Pole standards have been included. • Line 103: Section was originally for valet stands. Residential uses are then allowed signage by their setback to the right-of-way line. ■ Lines 211-217: Section 7.11 Residential Entryway Features is referred to and language regulating the relationship between Signage and Entryway Features and better established. • Lines 246-331: Permanent Signs for Single Tenants for Non -Residential Uses ■ Line 248 & 261-265: Blade Signs have been included; this is a longer and larger sign compared to a Projecting Sign. ■ Sign types are permitted depending on the setback of building(s): 15-ft. or greater and allowed ground signage. 15-ft. or less are allowed signage installed on the building itself. ■ Language restricting sign types where residential structures have been converted to a commercial use has been added in multiple section to reinforce the standard. ■ Lines 284-285: Signage on an awning valence is less restrictive. ■ Lines 323-324: A delineated cornice is now required for all Ground signs. • Lines 332-486: Permanent Signs for Multi -Tenant Buildings for Mixed -use and Non - Residential Uses ■ Sign types are permitted depending on the setback of building(s): 15-ft. or greater and allowed ground signage. 15-ft. or less are allowed signage installed on the building itself. ■ Language restricting sign types where residential structures have been converted to a commercial use has been added in multiple section to reinforce the standard. ■ Line 326 & 391-395: Blade Signs have been included; this is a longer and larger sign compared to a Projecting Sign. ■ Lines 367-369: Section 7.12 Non -Residential Entryway Features is now referred to. ■ Lines 373-374: Vehicular Entrance signage ("parking") is included for Mixed -use building. ■ One Zone asked that instead of using the language "Front Yard" Staff use "set back from". This is now consistent with the rest of the UDO. (ex: Lines 381-382) ■ Line 399: Projecting Signs have been given a maximum square footage. ■ Lines 451-462: Signage on an awning valence is less restrictive. ■ Lines 371-472: A delineated cornice is now required for all Ground signs. Lines 487-502: Window Signage ■ Removed the district and uses applicability. ■ Removed the Number section. The Maximum Sign Area section is effective to limit the number and size. Lines 503-518: Drive-Thru Signage ■ Changed the applicability from districts to use. ■ Included additional masonry base standards to be more consistent with other masonry base standards in the UDO. • Lines 538-567: Construction Signage ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571-2417 ■ Included a new sign type; Construction Fence. This will allow signage on fences when demolition or construction is occurring. ■ Line 554-555: Added a provision limiting how close Ground Signs may be to each other. ■ Line 559-560: Included a section allowing Ground sign faces to be split up to sixty degrees and still count as one sign. • Line 593: Clarifies the duration a For Sale/lease sign is permitted. • Line 609: Clarifies that a Temporary Use permit, issued by Building and Code Services, is required before a Temporary Use Sign is permitted. • Line 627-629: These two locations are no longer available for Street Banners. • Line 630: Allows one Banner per Street Frontage • Line 634: Clarifies that a Public Event Permit is required for the banner. • Lines 654-674: Allows greater flexibility for temporary signage for Carmel Redevelopment Commission projects. This is similar to Section L (Line 519), which allows greater flexibility for permanent signage in C1 and C2 zoning districts. • Line 675-701: Reduces the Ground Sign Chart to better portray the type of signage requested. The amendment changes the distance of right-of-way column, the maximum sign area column, and in one instance the maximum height. ■ A table displaying the Ground Sign approvals in 2018-2020 will be included with the Department Report. — Section 5.66: Food Stand Use -Specific Standards, Lines 705-707: Refers sign standards for Food Stand uses to Section 5.39 Sign Standards Article 7: Design Standards: — Section 7.11 & 7.12: Residential and Non -Residential Entryway Standards, Lines 711 & 722: These two sections were not in the previous zoning ordinance and were introduced with the UDO in 2017 when the UDO was introduced. Entryway Features allow subdivisions and larger commercial developments to construct a structure which meets their theme or adds to the character of the area. This does not allow for larger or taller signage, but rather a taller structure. The proposed revisions are meant to mold these sections to better fit with the Sign Standards as proposed in this rewrite including; Adding a 5' setback requirement. Referring the section to the Sign Standards. Requiring ADLS or ADLS Amendment for approval Article 11: Definitions: — Line 821: Adding a definition for Construction Fencing to allow a new sign type. — Line 824: Adding a definition for Entryway Feature which was previously not defined. — Line 827: Amending Residential Complex definition so it applies to all types of Residential Uses. — Line 830: Adding a new definition for proposed sign type Construction Fence Sign. — Line 833 & 839: Differentiating between a Blade Sign and Projecting Sign. — Line 844: Adding a definition for Flag Sign which was previously not defined. — Line 850: Adding a definition for Vehicular Entrance which was previously not defined. Synopsis: This ordinance amends the Unified Development Ordinance in order to add new sign types, allow different sign types for various uses, promote pedestrian scale signage, and better tailor the 2017 Unified Development Ordinance to meet Carmel's signage needs. 15 WHEREAS, it is in the public interest to regulate signage to ensure the protection of property 16 values, the character of various neighborhoods, the creation of a convenient, attractive and harmonious 17 community, and encourage economic development; and 18 WHEREAS, the City wishes to maintain an orderly, consistent and streamlined unified 19 development ordinance; and 20 WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in IC 36-7- 21 4), each unit of local government that wishes to adopt land use and zoning ordinances must first approve 22 by resolution a comprehensive plan for the geographic area over which it has jurisdiction; and 23 WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the 24 text of the unified development ordinance; and 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 WHEREAS, pursuant to Indiana Code 36-7-4-610 and City of Carmel Ordinance D-2391-17, the Carmel Unified Development Ordinance is incorporated by reference into the Carmel City Code; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, that, pursuant to IC 36-7-4-600 et seq. and after Docket No. PZ-2020-00119 OA having received a favorable recommendation from the Carmel Advisory Plan Commission on Tuesday, , it hereby adopts this Ordinance to amend the Carmel Unified Development Ordinance (Ordinance Z-6XX- 20, as amended), to read as follows: Section I: Amend Article 1: Ordinance Foundation as follows: 1.29: Filing Fees Amend Sians Fee Table as follows: Sign Permit $107.00 Sign Installation Improvement $43.00 plus $2.05 per s . ft. Purpose and Intent: Signs obstruct views, distract motorists, displace alternative uses for 55 land, and pose other problems that legitimately call for regulation. The purpose of Section 56 5.39: Sign Standards is to regulate the size, eele-, illumination, movement, materials, 57 location, height and condition of all signs placed on private property for exterior 58 observation, thus ensuring the protection of property values, the character of the various 59 neighborhoods, the creation of a convenient, attractive and harmonious community, 60 protection against destruction of or encroachment on historic convenience to citizens and 61 encouraging economic development. Section 5.39: Sign Standards allows adequate 62 communication through signage while encouraging aesthetic quality in the design, location, 63 size and purpose of all signs. Section 5.39: Sign Standards shall be interpreted in a manner 64 consistent with the First Amendment guarantee of free speech. 65 B. Sign Maintenance: 66 1. Every sign, including but not limited to those signs for which permits are required, 67 shall have all parts and surfaces cleaned, painted or replaced as necessary to 68 maintain the original appearance. 69 2. A Sign Permit shall not be required for sign maintenance (i.e. the repainting, cleaning 70 and other normal maintenance or repair), nor for change of copy for legal Changeable 71 Copy of a sign or sign structure for which a permit has previously been issued. 72 3. However, any Sign Alteration shall require sign permit approval. 73 4. Exempted Signs: The following types of signs are exempted from all provisions of Section 80 5.39: Sign Standards, but shall be established and maintained in such a manner as to not 81 cause safety hazards. Signs which are included as part of a Sign Plan may require approval 82 by the Planning Administrator, however, do not require fees. Otherwise, no procedures, 83 approvals, permits or fees are required for the following signs: 84 1. Each property owner shall mark their property using numerals that identify the 85 address of the property so that public safety departments can easily identify the 86 address from the public street. Integral Signs (3 square feet or less). Traffic control devices on private or public property shall be erected and maintained to comply with the Manual of Uniform Traffic Control Devices. Traffic Directional Signs not exceeding three (3) square feet in sign area for any one (1) sign; and not higher than three (3) feet above ground level. Standard traffic directional signs, such as STOP and Yield signs, shall comply with the "Manual for Uniform Traffic Control Devices" which can be found at www.mutcd fhwa.dot. gov. Government Signs. Flags Flag Poles shall meet the minimum yard setback requirements for a Principal Building or a minimum of ten (10) feet, whichever is more restrictive. Flag Poles mounted onto a building shall not extend above the cornice line of the 101 building. 102 -&c. Standalone Flag Poles shall not exceed 35 feet in height. 103 7. Accessory Structures less than ei-g t-five (95) feet in height may display a sign no 104 larger than three (3) square feetin area. 105 8. Parking lot row/area identifiers (3 square feet or less). 106 9. Umbrella signs (3 square feet or less). 107 D. Prohibited Signs: The following types of signs are prohibited. 108 1. Signs which contain obscene statements, words or pictures. 109 2. Signs which contain or are in imitation of an official traffic sign or signal or contain 110 the words "stop", "slow", "caution", "danger", "warning" or similar words, or are 111 of a size, location, movement, content, coloring, or manner of illumination which 112 may be confused with or construed as a traffic or street sign or signal. 113 3. Off Premise signs. 114 4. Signs with a Visible Light Source on the exterior of a Building unless they are 115 permitted specifically by other sections of Section 5.39: Sign Standards. 116 5. Signs of the flashing, blinking, animated, or audible type, except those giving 117 public service information placed by the City of Carmel and/or the State of Indiana. 118 (The message can change no more than 1 time per 10 seconds.) 119 6. Signs which rotate, swing, inflate or move as a result of wind (natural or man- 120 made), i.e. banners, posters, pennants, ribbons, streamers, strings of light bulbs, 121 spinners or similar devices, unless they are permitted specifically by other sections 122 of Section 5.39: Sign Standards (See Section 5.39(QR): Temporary Sign; Permitted 123 Banners). 124 7. Signs which are located in such a manner as to obstruct the view of the intersection 125 of a street, highway, ortrail crossing. 126 8. Signs which are projected on, located upon, over, or in any street or highway right- 127 of -way, except for official highway and regulatory signs of the City of Carmel and 128 the State of Indiana. 129 9. Portable signs which are not permanently affixed to anything or are movable. 130 10. Signs which are established on trees, utility poles and fences, unless they are 131 permitted specifically by other sections of Section 5.39: Sign Standards (See 132 Section 5.39(QR): Temporary Sign; Permitted Banners). 133 11. Roof Signs 134 44-12. Signs which are established on Accessory Structures (such as parking_ garages, gas 135 station canopies, or sheds, etc.) unless they are permitted specifically in Section 5.39: Sign 136 Standards (See Section 5.39(C): Exempted Signs.) 137 42-13. In such cases, vehicles supporting signage shall be located 149 as far as possible from the public right-of-way, subject to determination by the 150 Director of Community Services. 151 e. Passenger vehicles, pick-up trucks, and vans of a size that can fully fit within a 152 standard parking space, containing signs painted on or permanently affixed on the 153 doors or integral body panels that do not exceed sixteen (16) square feet in area. 154 Permanent Sign Standards 155 E. General Permanent Sign Standards: 156 1. All signs require Sign Permit approval by the Planning Administrator. 157 2. All Sign Permits require fees per Article], Section 1.29 Filing Fees. 158 3. No sign shall interfere with Vision Clearance per Section 5.74 Vision Clearance 159 Standards. 160 4. All permanent Ground sSigns require a Landscaped Green Area at its base equal to the 161 Sign Area. For example, ornamental grasses, shrubs and seasonal flowers. 162 5. Wall Signs are allowed provided that they fit within the horizontal and vertical 163 elements of the Building and do not obscure architectural details of the Building. 164 6. No Wall Sign shall be allowed to extend above the cornice line of a Building, 165 beyond the edges of the wall upon which it is mounted, nor above the roofline. 166 7. All sign types shall be designed to relate to the architectural style of the main 167 Building or Buildings upon the site. 168 8. All signs shall be installed a minimum of five (5) feet from ethe street right-of-way. 169 F. A building owner with two (2) or more Street Frontages may elect to transfer a 252 permitted sign from one (1) Street Frontage to another. 253 c. However, no more than two (2) signs may be oriented to one (1) Street 254 Frontage as follows: One (1) Projecting or Wall Sign and one (1) Ground or 255 Suspended Sign. 256 3. Purpose and Intent: Signs obstruct views, distract motorists, displace alternative uses for 53 land, and pose other problems that legitimately call for regulation. Common Area or Landscape Easement: An Entryway Feature shall be located within 702 common area or within a Landscape Easement. If within common area, an Owners' 10/20/2020 Ordinance Z-6XX-20, Plan Commission Draft 15 703 Association shall own and maintain it in perpetuity. If within a Landscape Easement, the 704 Owners' Association shall maintain it in perpetuity and the easement shall grant access to 705 the Owners' Association and the City of Carmel. The easement may require the lot owner 706 to maintain turf grass that may partially or fully surround the Entryway Feature, but 707 otherwise shall not assign other maintenance to the lot owner. 708 3. Vision Clearance: An Entryway Feature shall not be permitted in the Vision Clearance 709 Triangle. 710 4. Entryway Median: Under no circumstances shall the identification portion (i.e. the 711 development name) be located within the right-of-way or a median carved out of the right- 712 of -way. 713 5. An Entryway Feature shall be installed a minimum of five (5) feet from the street right-of- 714 way. 715 F. Landscaping: The identification portion (i.e. the development name) of the Entryway Feature 716 shall be significantly subordinate to the landscaping and hardscaping features used to create the 717 entryway feature. 718 G. Hecht: The identification portion (i.e. the development name) of the Entryway Feature shall 719 not exceed six (6) feet in height above the pre-existing grade. The overall height of an 720 Entryway Feature's hardscaping or structures is limited to thirty (30) feet, but shall be in 721 proportion to the scale of the development and entryway. For Example, the maximum height is 722 set to allow a historic barn to be preserved and integrated into an entryway feature, or a clock 723 tower to be installed. Hardscape features or structures that would normally and traditionally not 724 be tall should be similar in scale to how they are used elsewhere in the region. 725 H. Signage: 726 1. The Entryway Feature shall be permitted signage per Section 5.39: Sign Standards. 727 L Lighting: The identification portion (e.g. the development name) of the Entryway Feature is 728 encouraged to be externally lighted, but is not mandatory. If lighting is utilized, only ground 729 mounted cutoff fixtures shall be used. Lighting shall be the minimum necessary to softly 730 illuminate the identification portion (e.g. the development name) of the Entryway Feature. 731 Other low -voltage landscape lighting may be used to softly illuminate other features of an 732 Entryway Feature as long as it does not cause as safety hazard or glare to motorist or 733 pedestrians. 734 735 7.12 EF-02: Non -Residential Entryway Feature Standards UDO Page 7-17 736 This Entryway Feature Standards (EF) section applies to the following types of development: 737 ICON: CM 738 A. Applicability: Commercial subdivisions and non-residential developments with four (4) or 739 more lots, and with internal public or private streets, may establish one Entryway Feature. 740 B. Approval Authority: ADLS or ADLS Amendment 741 C. Cross Reference: See Section 5.39: Sign Standards and Section 7.06: Common Area 742 Standards for approval, information regarding maintenance, repair, and replacement of 743 Entryway Features. 744 D. Disturbances: Entryway Features shall be designed to cause the least practicable 745 disturbance to natural infiltration and percolation of precipitation to the groundwater 746 table, through careful planning of vegetation and land disturbance activities, and the 747 placement of structures, hardscape features and impervious surfaces. 748 E. Location: 749 1. Any Entryway Feature shall be located at a Vehicular Entrance from a perimeter street. 750 2. For example, the maximum 763 height is set to allow a clock tower or similar, stylistic structure to be installed. Lighting: Exterior lighting of the entryway feature shall be designed so that light is not 770 directed off the site and the light source is shielded from direct offsite viewing. 771 Illumination levels shall not exceed 0.3 foot-candles at the property line. 772 J.
