Good afternoon,
After discussing this storm system internally, we have determined that the following will need to be
completed:
Please video the pipe, collect pipe information (invert elevations, material types, diameters),
and determine which sections of it have been vacated. Provide video and pipe information to
City of Carmel and Hamilton County Surveyor’s office. It appears that Old Town Companies
owns or plans to develop all of the lots that the storm line traverses. If the pipe does not
facilitate drainage outside of the lots that will be redeveloped, the City would not object to its
removal and abandonment of any associated easements. However, it is owned by the County
so you will need to petition and gain approval from the county drainage board to take it out of
service and have the easement abandoned.

I have been working on the requested revisions for the Primary & Replat. I think an issue will develop
concerning the old drain tile that crosses all of the lots....At issue a portion of this drain line has been
abandoned North of 2nd ST NW, while the pipe South of 2nd St NW has not been.
On the County GIS the line is shown connecting to Some storm inlets in 2nd Street but it does not! I
went back out this morning to inspect the storm structures and DID NOT find such a connection to the
old drain tile. I believe the county GIS is NOT correct. I went further to research the tile online and
found the abandonment documents for the portion of the drain North of 2nd Street in 2016 by Petitioner
Overby (See 1st attached Morrow -Follett pdf).
Next I found document on the construction / connection of the inlets in 2nd Street NW to the Drain in
the abandoned Monon RR. This included plan sheets for Crossroads Engineering that show in profile
the location of the remaining Morrow-Follet drain in relation to those inlets in 2nd Street NW (See 2nd
Morrow-Follett pdf).
Since the portion of the drain North of 2nd Street was abandoned and the plans for 2nd Street clearly
show it is NOT connected to those inlets in 2nd Street NW, we have a ex post facto (?) abandonment
of the line under our project and I do not believe that we need to show an easement for that line in
particular. I also believe that an official abandonment of this line needs to be sought, possibly after this
plat is approved and recorded, if City of Carmel would agree to this course of action and not hold up
our proposals for the new builds and closings.
However, in light of the alley improvements and existing utility along our West boundary I think we
should show a 10' D & UE along the west line, which I have shown on both Primary & Secondary plats
(see attached pdfs).
