This space is to include a 18’ x 35’ gunite pool with autocover and a modest paver pool deck on the east and south sides. The outdoor space will be adjoining an existing elevated paver patio and replacing a lower paver patio. The space will be landscaped to integrate the structure into the existing terrain. We are asking for a variance in UDO Section 2.10 Max 35% lot cover allowed. We are asking for 42.5% coverage. The reason for this additional coverage is so that a pool and associated pool deck of appropriate architectural scale and styling can be constructed on the site. Without a variance the necessary adjustments to the proposed project may have an adverse effect to the safety of the property due to the reduced size of the pool and associated pool deck as well as the closer proximity to other outdoor spaces with alternate uses. It may also negatively affect the property value as alternatives may be inferior in styling and architectural design and appropriateness. It will limit the ability improve the property as proposed. The strict application would limit the ability to safely and aesthetically integrate the pool and associated elements into the property. We are asking for a variance in UDO Section 5.02.C.7. The standard states that a pool and associated pool deck be 3’ from any easement. We are asking to encroach 3 feet into the rear drainage and BMP easement. The reason for this additional encroachment is so that a pool and associated pool deck of appropriate architectural scale and styling can be constructed on the site. Without a variance the necessary adjustments to the proposed project may have an adverse effect to the safety of the property due to the reduced size of the pool and associated pool deck as well as the closer proximity to other outdoor spaces with alternate uses. It may also negatively affect the property value as alternatives may be inferior in styling and architectural design and appropriateness. Due to the topography of the site and distance from the drainage elements, in this case a communal rain garden for the Coombs minor plat, the encroachment should not have an adverse effect on the access or usage of the aforementioned easement.
