Brief Description of Waiver:
In deciding whether or not the applicant has presented sufficient proof to permit the granting of a
waiver of quantitative standards of this Chapter (up to 35%), the Plan Commission should consider
the following requirements:
(1)The proposal shall be in harmony with the purposes and the land-use standards contained
in Section 9.16: Waiver of Development Standard.
(2)The proposal shall enhance the overall Development Plan, the adjoining streetscapes and
neighborhoods, the surrounding area.
(3)The proposal shall not produce a Site Plan or street/circulation system that would be
impractical or detract from the appearance of the Development Plan, the surrounding area,
and shall not adversely affect emergency vehicle access or deprive adjoining properties
of adequate light and air.
(4)The proposal exhibits extraordinary site design characteristics, including, but not limited
to: Increased landscape treatment, tree preservation, public art, provisions for bicycles,
and/or mass transit, reduced surface parking coupled with provisions for above or
below ground parking facilities.
Based on all the evidence presented by the petitioner, I approve of the requested
waiver.
In granting a waiver, the Commission may impose such conditions that will, in its
judgment, secure the purposes of this Chapter. (List Conditions on back.)

WAIVER OF DEVELOPMENT/DESIGN STANDARDS APPLICATION
ATTACHMENT
PZ-2020-00206: Requesting a 22’6” and a 22’ maximum building height.
Section of Unified Development Ordinance for which waiver is being requested:
Sec. 3.88.C states that building heights for proposed buildings that are adjacent to residential uses
shall be no more than one and one-half (1½) stories or twenty (20) feet on the facade(s) nearest
the residential use.
State explanation of why waiver is being requested:
We are requesting a maximum building height of 22’6” for the southern building’s west façade
columns (27’ total building height) and a maximum building height of 22’ for the northern
building’s west façade columns (23’6” total building height), per the provided elevations. City
staff has requested this design height and we are willing to seek the variance at staff's request in
order to develop this building consistent with the building directly to the south.
State reasons supporting waiver request:
The southern building’s west façade columns exceed the standard by only 2’6’ in height, and the
northern building’s west façade columns exceed the standard by only 2’ in height. The additional
building height enhances the building's west façade consistent with the encouragement of taller
buildings within the US 421 Corridor Overlay District.
PZ-2020-00207: Requesting a minimum 20’ Greenbelt width.
Section of Unified Development Ordinance for which waiver is being requested:
Sec. 3.91.A.1 states that A landscaped Greenbelt area shall extend along the Right-of-Way of U.S.
Highway 421 with a minimum width of thirty (30) feet.
State explanation of why waiver is being requested:
We are requesting a minimum width of twenty (20) feet, per the provided site plan. The site is not
deep enough west to east to design a functional layout and meet this standard.
State reasons supporting waiver request:
The reduction in Greenbelt minimum width is a 33% reduction - within the 35% reduction
threshold which may be approved by the Plan Commission. The required number of
Greenbelt/parking lot perimeter plantings shall still be provided.
PZ-2020-00208: Requesting a minimum of 80 required parking spaces.
Section of Unified Development Ordinance for which waiver is being requested:
Sec. 5.30 states that the Minimum Parking Spaces Required is 101 Total Required Spaces (please
see calculation breakdown on the Site Plan).
State explanation of why waiver is being requested:
We are requesting a Minimum Parking Spaces Requirement of 80 Total Spaces, per the provided
site plan. The site is not deep enough west to east to design a functional layout and meet this
standard. We believe that 80 parking spaces is more than enough for this site.
State reasons supporting waiver request:
We are leasing to tenants that are a combination of morning, mid-day and evening when it comes
to their busiest times of the day. The parking area will also be inter-connected to the Sherwin-
Williams/Moe’s Southwest Grill site directly to the south. The reduction in minimum parking
spaces requirement is a 20.8% reduction - within the 35% reduction threshold which may be
approved by the Plan Commission.
