01 Courvsei: Additionally, we would request that the previously tabled Developmental
Steven If. lienke Standards Variances (Docket Nos. PZ-2020-00230 V; PZ-2020-00233 V; PZ-2020-
00234 V; PZ-2020-00235 V; PZ-2020-00237 V; PZ-2020-00238 V; PZ-2020-00240 V;
PZ-2020-00242 V; and PZ-2020-00243 V) be tabled until there is a determination made
by the Plan Commission and Carmel City Council on the Re -Zone Application filed on
behalf of Tomahawk Holding, LLC and The Greatest of All Taverns, LLC d/b/a The
GOAT which was filed on July 12, 2021. If the Developmental Standards Variances
are not tabled, we would agree to withdraw those Variances as well and refile only those
needed following action on the Re -Zone Application that are necessary for the
contemplated future development of the building. We believe that number will be
substantially fewer than the presently pending Developmental Standards Variances. If
withdrawn, we would request the filing fees paid for the Developmental Standards
Variances be applied to any new Developmental Standards Variances necessary
following the re -zone.

and the previously tabled Developmental Standards Variances (Docket Numbers PZ-
2020-00230 V — PZ-2020-00243 V) until there is a determination made by the Plan
Commission and Cannel City Council on the Re -Zone Application filed on behalf of
Tomahawk Holding, LLC on July 12, 2021.
We would also seek to re -zone the GOAT property to a B-2 zone classification
without the Old Towne Overlay Zone requirements.

Agreement in place with City to allow GOAT to reopen
Strict compliance with new conditions required
CARMEL, IN - The Department of Community Services (DOCS) for the City of Carmel has
reached an agreement with the owners of the GOAT that will allow the venue to
temporarily operate under certain conditions until the use variance is decided on February
25, 2021. The owners of the GOAT have agreed that their strict compliance with the
requirements included in the agreement is required to remain open. If there is a failure to
comply with the requirements, the venue will have 24 hours to make changes necessary. If
those changes are not accomplished in that time period, then DOCS can require that the
GOAT cease operations immediately.
The following is the list of conditions in the agreement:
1. New hours of operation:
a. Sunday through Thursday - 10 a.m. toll p.m.
b. Friday and Saturday- 10 a.m. to 12 a.m. (midnight)
c. All food and beverage service will end one hour prior to closing, which would
be 10 p.m. Sunday through Thursday and 11 p.m. on Friday and Saturday.
2. Noise Levels and Capacity:
a. Noise levels will be at or below 50 decibels.
b. If an ordinance is passed by the City requiring new lower levels, operator will
comply with those new levels.
c. No live music.
d. Only 40 persons or less per toilet in compliance with standards in the State
of Indiana Building Code. If more restrooms are added, then the capacity can
increase accordingly. The occupancy includes the indoor area and the three -
season patio area.
e. The Sandlot outdoor area, including the fire pit, will be closed unless use
of that area is approved as part of the use variance.
3. Security:
a. Operator will control the entrance, and exits of the premises to ensure all
employees and patrons are using only public streets, sidewalks, paths and
the Monon Greenway and not accessing through private residences.
b. If necessary, operator will employ private security to ensure compliance
with this and other requirements and to prevent endangerment of
neighboring properties.
c. There will be only one entrance into the building and it will be on the east
side of the restaurant. Operator will make any improvements necessary to
prevent entrance from Sandlot outdoor area or Monon Greenway directly.
d. Operator will employ full time employee "Bouncer" to be at the main
entrance to confirm legal age of all who enter, prevent patrons from taking
beverages outside the restaurant building, to ensure that all persons, except
employees and staff, have left the building at closing and to prevent loitering
in the immediate area after closing.
e. Operator will direct all ride sharing activities to the drop off/pick up point
near Midtown Garage.
4. Cleanliness:
a. Operator will install a water hose to be used on a regular basis to clean
outside of premises and surrounding area.
b. Operator will be responsible for collection of trash in a three -block area
following daily closing of the premises.
"We are pleased that the owners of the GOAT have agreed to these critical steps to take
control of the activities at their venue. This will also give them the opportunity to show
their commitment to be better neighbors and that they can coexist in this vibrant area of
our city prior to the final vote on the variance in early 2021. We appreciate the input and
patience of those who have expressed concerns and hope that they see an immediate
difference," said Mayor Jim Brainard.
It was also agreed that the City of Carmel or the DOCS may seek injunctive relief from the
courts in Hamilton County, if necessary, in order to enforce these commitments. DOCS has
sole discretion to determine if the GOAT is at all times in compliance with the conditions of
the agreement.
