COMMON COUNCIL
MEETING MINUTES
MONDAY, DECEMBER 7, 2020 – 6:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEETING CALLED TO ORDER
Council President Laura Campbell; Council Members: Kevin D. Rider, Adam Aasen, Anthony Green,
Tim Hannon, H. Bruce Kimball, Miles Nelson, Sue Finkam, Jeff Worrell and Deputy Clerk Jacob Quinn
were present.
Council President Campbell called the meeting to order at 6:00 p.m.
AGENDA APPROVAL
Agenda was approved unanimously.
INVOCATION
Pastor Tim Ayers, Grace Church, delivered the Invocation
Councilor Worrell led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS
Mayor James Brainard and the City Council honored retiring Street Commissioner Dave Huffman.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL
There were none.
COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS
Councilor Finkam thanked city staff for organizing the Santa tours around Carmel.
Councilor Hannon thanked Mayor Brainard for the video he put out about Covid-19 directed at healthcare
workers.
CONSENT AGENDA
Councilor Rider moved to approve the consent agenda. Councilor Green seconded. There was no Council
discussion. Council President Campbell called for the vote. The motion was approved 9-0.

COMMITTEE REPORTS
Councilor Finkam reported that the Finance, Utilities and Rules Committee had met. Ordinance D-2540-
20 remain in committee, Ordinance D-2553-20 is returning to Council with a positive 4-0 vote and
Ordinance D-2555-20 is returning with a positive 4-0 vote.
Councilor Green reported that the Land Use and Special Studies Committee had met. Z-658-20 is
returning with a positive 4-0 recommendation, Ordinance Z-659-20 is returning with a positive 4-0
recommendation, and Z-660-20 is returning with a positive 4-0 recommendation.
OTHER REPORTS – (at the first meeting of the month specified below):
Henry Mestetsky, Director of the Carmel Redevelopment Commission, presented the monthly report.
Michael Klitzing, Director of Carmel Clay Parks and Recreation, gave the quarterly report.
Nancy Heck gave a report on events happening in Carmel.
Council President Campbell announced the Fifth Reading of Ordinance D-2540-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 3, Division II, Section
2-42 of the Carmel City Code; Item Remains in the Finance, Utilities and Rules Committee.
Council President Campbell announced the Third Reading of Ordinance Z-658-20; An Ordinance of the
Common Council of the City of Carmel, Indiana, Establishing Standards and Approval Process for Group
Homes in the Unified Development Ordinance. Councilor Green announced that the item is returning
from the Land Use and Special Studies Committee with a positive 4-0 recommendation. Councilor Rider
moved to approve Ordinance Z-658-20. Councilor Aasen seconded. There was no Council discussion.
Council President Campbell called for the vote. Ordinance Z-658-20 was approved 9-0.
Council President Campbell announced the Second Reading of Ordinance Z-659-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Establishing The Ambleside Point Planned Unit
Development District. Councilor Green announced that the item is returning from the Land Use and
Special Studies Committee with a positive 4-0 recommendation. Steve Pittman, Pittman Partners,
addressed Council. Councilor Rider moved to approve Ordinance Z-659-20. Councilor Worrell seconded.
There was no Council discussion. Council President Campbell called for the vote. Ordinance Z-659-20
was approved 9-0.
Council President Campbell announced the Second Reading of Ordinance Z-660-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Rezoning 4 Parcels Located at the Northeast Corner

of Old Meridian Street and Main Street From the UC/Urban Core District to the C2/Mixed Use District.
Councilor Green announced that the item is returning from the Land Use and Special Studies Committee
with a positive 4-0 recommendation. Steve Pittman, Pittman Partners, addressed Council. Councilor Rider
moved to approve Ordinance Z-660-20. Councilor Aasen seconded. There was no Council discussion.
Council President Campbell called for the vote. Ordinance Z-660-20 was approved 9-0.
Council President Campbell announced the Second Reading of Ordinance D-2553-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of Economic Development
Tax Increment Revenue Bonds to Support the Courtyards of Carmel Redevelopment Project, and
Authorizing and Approving Other Actions in Respect Thereto. Councilor Finkam announced that the item
is returning from the Finance, Utilities and Rules Committee with a positive 4-0 recommendation.
Councilor Finkam moved to approve Ordinance D-2553-20. Councilor Rider seconded. There was
Council discussion about the ordinance. Council President Campbell called for the vote. Ordinance D-
2553-20 was approved 9-0.
Council President Campbell announced the Second Reading of Ordinance D-2554-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Amending Chapter 6, Article 5, Division VIII,
Section 6-158 of the Carmel City Code. Item Remains in the Land Use and Special Studies Committee.
Council President Campbell announced the Second Reading of Ordinance D-2555-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Establishing Four Municipal Riverfront
Development Project Areas Within the City of Carmel. Councilor Finkam announced that the item is
returning from the Finance, Utilities and Rules Committee with a positive 4-0 recommendation. Councilor
Finkam moved to approve Ordinance D-2555-20. Councilor Aasen seconded. There was Council
discussion about the ordinance. Jon Oberlander, Assistant Corporation Counsel, addressed Council.
Council President Campbell called for the vote. Ordinance D-2553-20 was approved 9-0.
PUBLIC HEARINGS
Council President Campbell announced the First Reading of Ordinance D-2556-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Appropriation of
Funds from the Operating Balance of the Non-Reverting Events and Festivals Fund (#923). Councilor
Finkam moved to introduce the item into business. Councilor Rider seconded. Nancy Heck, Director of
Community Relations and Economic Development, presented the item to Council. Council President
Campbell opened the public hearing at 7:25:30 p.m.
Seeing no one who wished to address Council, Council President Campbell closed the public hearing at
7:25:45 p.m. Councilor Finkam moved to suspend the rules and act on this tonight. Councilor Finkam
seconded. There was no Council discussion. Council President Campbell called for the vote. The motion
was approved 9-0. Councilor Finkam moved to approve Ordinance D-2556-20. Councilor Rider
seconded. There was no Council discussion. Council President Campbell called for the vote. Ordinance
D-2556-20 was approved 9-0.
Council President Campbell announced the First Reading of Ordinance D-2557-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional

President Campbell opened the public hearing at 7:28:50 p.m.
Seeing no one who wished to address Council, Council President Campbell closed the public hearing at
7:29 p.m. Councilor Rider moved to suspend the rules and act on this tonight. Councilor Aasen seconded.
There was no Council discussion. Council President Campbell called for the vote. The motion was
approved 9-0. Councilor Rider moved to approve Ordinance D-2557-20. Councilor Rider seconded. There
was no Council discussion. Council President Campbell called for the vote. Ordinance D-2557-20 was
approved 9-0.
Council President Campbell announced the First Reading of Ordinance D-2558-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional
Appropriation of Funds from the General Fund #101 to the 2020 Department of Law Budget. Councilor
Rider moved to introduce the item into business. Councilor Finkam seconded. Jon Oberlander presented
the item to Council. Council President Campbell opened the public hearing at 7:31:00 p.m.
Seeing no one who wished to address Council, Council President Campbell closed the public hearing at
7:31:15 p.m. Councilor Rider moved to suspend the rules and act on this tonight. Councilor Finkam
seconded. There was no Council discussion. Council President Campbell called for the vote. The motion
was approved 9-0. Councilor Rider moved to approve Ordinance D-2558-20. Councilor Rider seconded.

was approved 9-0.
Council President Campbell announced the First Reading of Ordinance Z-661-20; An Ordinance of the
Common Council of the City of Carmel, Indiana, Rezoning 2.14 Acres at E. 116th Street from R-
1/Residential to the B-3/Business District. Councilor Rider moved to introduce the item into business.
Councilor Finkam seconded. Warren Johnson, the petitioner, presented the item to Council. Rachel
Keesling, Department of Community Services, presented on the item. Council President Campbell opened
the public hearing at 7:40 p.m.
Seeing no one who wished to address Council, Council President Campbell closed the public hearing at
7:40:20 p.m. Council President Campbell referred the item to the Land Use and Special Studies
Committee.
Council President Campbell announced the First Reading of Ordinance Z-662-20; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending the Clay Terrace Planned Unit Development
District. Councilor Rider moved to introduce the item into business. Councilor Finkam seconded.
Councilor Rider introduced the item to Council. Mark Leach, Faegre Drinker, presented the item to
Council. Council President Campbell opened the public hearing at 7:48 p.m.
Seeing no one who wished to address Council, Council President Campbell closed the public hearing at
7:48:20 p.m. Council President Campbell referred the item to the Land Use and Special Studies
Committee.
NEW BUSINESS
Council President Campbell announced Resolution CC-12-07-20-01: A Resolution of the Common
Council of the City of Carmel, Indiana, Authorizing a Transfer of Funds Within the 2020 Carmel Fire
Department Budget. Councilor Rider moved to introduce the item into business. Councilor Aasen

seconded. Councilor Finkam recused herself from discussion on the resolution. Chief David Haboush
presented the item to Council. Councilor Rider moved to approve Resolution CC-12-07-20-01. Councilor
Aasen seconded. There was no Council discussion. Council President Campbell called for the vote.
Resolution CC-12-07-20-01 was approved 8-0 (Finkam abstained).
Council President Campbell announced the First Reading of Ordinance D-2559-20; An Ordinance of
the Common Council of the City of Carmel, Indiana, Adding Chapter 2, Article 4, Section 2-151 to the
Carmel City Code. Councilor Rider moved to introduce the item into business. Councilor Finkam
seconded. Councilor Finkam presented the item to Council. Mayor Brainard addressed Council. Councilor
Rider moved to suspend the rules and act on this tonight. Councilor Finkam seconded. There was no
Council discussion. Council President Campbell called for the vote. The motion was approved 9-0.

Council President Campbell announced Resolution CC-12-07-20-02: A Resolution of the Common
Council of the City of Carmel, Indiana, Approving a Transfer of Funds Between the 2020 Common
Council Budget and the Non-Reverting Sidewalk Program Fund (Fund #925). Councilor Rider moved to
introduce the item into business. Councilor Aasen seconded. Councilor Finkam presented the item to
Council. Councilor Rider moved to approve Resolution CC-12-07-20-02. Councilor Aasen seconded.
There was brief Council discussion. Council President Campbell called for the vote. Resolution CC-12-
07-20-02 was approved 9-0
Council President Campbell announced Resolution CC-12-07-20-03: A Resolution of the Common
Council of the City of Carmel, Indiana, Approving a Transfer of Funds Between the General Fund and the
Parks and Recreation Non-Reverting Capital Fund (#103). Councilor Rider moved to introduce the item
into business. Councilor Finkam seconded. Councilor Finkam introduced the item to Council. Michael
Klitzing presented the item to Council. Councilor Rider moved to approve Resolution CC-12-07-20-03.
Councilor Aasen seconded. There was no Council discussion. Council President Campbell called for the
vote. Resolution CC-12-07-20-03 was approved 9-0
Council President Campbell announced Resolution CC-12-07-20-04: A Resolution of the Common
Council of the City of Carmel, Indiana, Approving a Transfer of Funds Within the 2020 Information &
Communication System (ICS) Department Budget. Councilor Rider moved to introduce the item into
business. Councilor Worrell seconded. Councilor Worrell presented the item to Council. Councilor Rider
moved to approve Resolution CC-12-07-20-04. Councilor Nelson seconded. There was no Council
discussion. Council President Campbell called for the vote. Resolution CC-12-07-20-04 was approved 9-

Department Budget. Councilor Rider moved to introduce the item into business. Councilor Nelson
seconded. Councilor Rider presented the item to Council. Councilor Rider moved to approve Resolution
CC-12-07-20-05. Councilor Nelson seconded. There was no Council discussion. Council President
Campbell called for the vote. Resolution CC-12-07-20-05 was approved 9-0

Council President Campbell announced First Reading of Ordinance D-2561-20; An Ordinance of the
Common Council of the City of Carmel, Indiana, Adding Chapter 6, Article 5, Division VIII, Section 6-
164 of the Carmel City Code. Councilor Rider moved to introduce the item into business. Councilor
Kimball seconded. Councilor Kimball introduced the item to Council. Mayor Brainard presented the item
to Council. There was extensive Council discussion about this ordinance and the GOAT in Carmel. The
discussion about the GOAT centered around the use variance that was approved for the establishment,
noise complaints and steps the City is taking to work with the business and neighbors. Councilor Aasen
moved to suspend the rules and act on this tonight. Councilor Nelson seconded. There was no Council
discussion. Council President Campbell called for the vote. The motion was approved 9-0. Councilor
Finkam moved to approve Ordinance D-2561-20. Councilor Aasen seconded. There was brief Council
discussion. Council President Campbell called for the vote. Ordinance D-2561-20 was approved 9-0.
Council President Campbell announced First Reading of Ordinance D-2560-20; An Ordinance of the
Common Council of the City of Carmel, Indiana, Adding Subsections (66), (67) and (68) to Chapter 8,
Article 5, Section 8-47(a) of the Carmel City Code. Councilor Rider moved to introduce the item into
business. Councilor Aasen seconded. Councilor Kimball introduced the item to Council. Council
President Campbell referred the item to the Finance, Utilities and Rules Committee.
